Opinion of the Advocate General
Mr Advocate General Jacobs delivered his Opinion on 26 April 1989. He proposed that the Court should rule as follows:
‘Article 3(2) of Council Regulation (EEC) No 2967/76 does not prohibit national rules whereby any batch of goods from which a sample has been taken must be withheld from the market until the inspection procedure is completed. Such national rules need not specify any time-limit for a suspension from the market; but any such suspension must not exceed the time which is necessary for the purposes of an effective system of inspection.’
