Having regard to the above application lodged on 2 April 2019,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

1 A list of the applicants is set out in the appendix.

2 The Turkish Government (“the Government”) were represented by their Agent.

3 The application concerned the alleged disappearance of Mr Erkan Irmak, the applicants’ relative, following his alleged abduction by unknown persons on 16 February 2019 and the alleged lack of an effective investigation into his disappearance.

4 On 11 April 2019 the Court decided to give notice to the Government of the applicants’ complaints raised under Articles 2, 3 and 5 of the Convention.

5 On 27 April 2021 the applicants informed the Court that they wanted to withdraw the application since Mr Irmak was found on 28 July 2019 and stated that he had not been abducted, as alleged.

THE LAW

6 In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

7 In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
