Having regard to the above application against the Hellenic Republic lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) on 1 March 2021,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Giorgi Shotadze, was born in 1981. He was represented by Mr K. Chatziioannou, a lawyer practising in Thessaloniki.
The applicant’s complaints under Article 3 of the Convention concerning the inadequate conditions of detention, as well as under Article 13 concerning the lack of any effective remedy in domestic law in respect of inadequate conditions of detention, were communicated to the Greek Government (“the Government”).
On 14 March 2022 the Government informed the Registry that the applicant had died and requested that, in the absence of any heir or close relative who expresses a wish to pursue the application, the Court should strike the application out of the list of cases.
On 18 March 2022 the Court transmitted the information received by the Government to the applicant’s representative and requested any written comments he may wish to make by 15 April 2022. However, no response has been received since then.
THE LAW
In the light of the foregoing, the Court concludes that the applicant’s heirs, if any, do not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
