THIRD SECTION
Application no. 44368/18 Thomaïs ASLANOGLOU against Greece
(see appended table)
The European Court of Human Rights (Third Section), sitting on 1 October 2026 as a Committee composed of:
Úna Ní Raifeartaigh , President , Canòlic Mingorance Cairat, Vasilka Sancin , judges ,
and Viktoriya Maradudina, Acting Deputy Section Registrar,
Having regard to the above application against the Hellenic Republic lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) on 11 September 2018,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Ms Thomaïs Aslanoglou, was born in 1935. She was represented by Mr V. Dimakopoulos, a lawyer practising in Athens.
The applicant’s complaint under Article 7 of the Convention concerning a criminal conviction due to the non-payment of debts to the State was communicated to the Greek Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicant, who was invited to submit her own observations. The applicant’s observations and just satisfaction claims were received on 19 July 2024.
On 8 June 2026 the Court decided that further information was to be submitted by the parties by 6 July 2026. No reply was received by the applicant. By letter dated 16 July 2026, the applicant’s representative was notified that no reply had been received and was again requested to provide the said information by 31 July 2026. The applicant’s attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The letter was sent via the Court’s Electronic Communication Service (eComms) and was downloaded by the applicant’s representative on 20 July 2026. However, no reply followed.
THE LAW
In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 22 October 2026.
