FOURTH SECTION
Application no. 43922/22 A against Russia and 6 other applications
(see appended table)
The European Court of Human Rights (Fourth Section), sitting on 1 October 2026 as a Committee composed of:
Lorraine Schembri Orland , President , Faris Vehabović, Anne Louise Bormann , judges ,
and Uğur Erdal, Acting Deputy Section Registrar,
Having regard to the above applications lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) on the various dates indicated in the appended table,
Having regard to the decision not to have the applicants’ names disclosed, in accordance with Rule 47 § 4 of the Rules of Court,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The list of the applicants and the relevant details are set out in the appendix.
The applicants were represented by Ms A. Kalynchuk, a lawyer practising in Kyiv.
The applicants’ complaints under Articles 3, 5, 6, 8, 13 and 34 of the Convention concerning their alleged ill-treatment and unlawful detention by the Russian authorities while they were held as prisoners of war were communicated to the Russian Government (“the Government”) on 22 April 2025. The Government did not submit observations.
By a letter of 5 June 2025 sent through the Court’s Electronic Communication Service (eComms), the applicants’ representative, Ms Kalynchuk, was invited to submit observations on the applicants’ behalf, together with any claims for just satisfaction. This letter was downloaded on the same day and again on 1 September 2025. No reply was received.
By a letter dated 27 October 2025 sent through eComms, Ms Kalynchuk was informed that the time-limit for submitting the applicants’ observations and claims for just satisfaction expired on 29 September 2025 and that no request for an extension had been received. Her attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue it. The letter was not downloaded by Ms Kalynchuk, although she continued to have access to eComms. No other response or communication was subsequently received.
THE LAW
Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.
The Court notes that neither the applicants nor their representative have responded to the Court’s correspondence or otherwise indicated that they wish to pursue the applications.
In the light of the foregoing, the Court concludes that the applicants may be regarded as no longer wishing to pursue their applications within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the applications.
Accordingly, the applications should be struck out of the Court’s list of cases.
For these reasons, the Court, unanimously,
Decides to join the applications;
Decides to strike the applications out of its list of cases.
Done in English and notified in writing on 22 October 2026.
