THIRD SECTION
Application no. 6487/25 Jelena MITROVIĆ against Serbia
The European Court of Human Rights (Third Section), sitting on 1 October 2026 as a Committee composed of:
Úna Ní Raifeartaigh , President , Canòlic Mingorance Cairat, Vasilka Sancin , judges ,
and Viktoriya Maradudina, Acting Deputy Section Registrar,
Having regard to the above application against the Republic of Serbia lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) on 12 February 2025,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Ms Jelena Mitrović, was born in 1975. She was represented by Mr S. Vidović, a lawyer practising in Belgrade.
The applicant’s complaint under Article 1 of Protocol No. 1 to the Convention concerning imposition of property tax on the applicant’s house was communicated to the Serbian Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicant, who was invited to submit her own observations. No reply was received to the Registry’s letter.
By letter dated 2 July 2026, sent through the Court’s Electronic Communications Service (eComms), the applicant was notified that the period allowed for submission of her observations had expired on 17 June 2026 and that no extension of time had been requested. The applicant’s attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The representative downloaded that letter on the eComms platform on 2 July 2026. However, no response has followed.
THE LAW
In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 22 October 2026.
