OPINION No 15/2019 OF THE EUROPEAN UNION AGENCY FOR THE COOPERATION OF ENERGY REGULATORS of 25 July 2019
ON THE ENTSO-E ANNUAL REPORT 2018
THE EUROPEAN UNION AGENCY FOR THE COOPERATION OF ENERGY REGULATORS, Having regard to Regulation (EU) 2019/942 of the European Parliament and of the Council of 5 June 2019 establishing a European Union Agency for the Cooperation of Energy Regulators , and, in particular, Article 4(3)(b) thereof, Having regard to Regulation (EU) 2019/943 of the European Parliament and of the Council of 5 June 2019 on the internal market for electricity , and, in particular, Articles 30(1)(l) and 32(2) thereof, Having regard to the favourable opinion of the Board of Regulators of 17 July 2019, delivered pursuant to Article 22(5)(a) of Regulation (EU) 2019/942, Whereas:

INTRODUCTION (1) On 12 June 2019, the European Network of Transmission System Operators for Electricity (‘ENTSO-E’) submitted its annual report for 2018 (the ‘ENTSO-E Annual Report 2018’) to the Agency for its opinion. The ENTSO-E Annual Report 2018, according to ENTSO-E, is intended to highlight ENTSO-E’s work in the area of internal energy, divided into network codes and the future power systems. (2) Pursuant to Article 4(3)(b) of Regulation (EU) 2019/942, the Agency is tasked to provide an opinion to ENTSO-E in accordance with the first subparagraph of Article 32(2) of Regulation (EU) 2019/943 on relevant documents referred to in Article 30(1) of Regulation (EU) 2019/943. Point (l) of Article 30(1) of Regulation (EU) 2019/943 refers to an annual report to be adopted by ENTSO-E. (3) Under Article 4(3)(b) of Regulation (EU) 2019/942, the Agency should take into account for its opinion the objectives of non-discrimination, effective competition and the efficient and secure functioning of the internal market in electricity. Further, the Agency regards it as essential to consider for its opinion the purpose of the annual report. By its nature, such a report shall provide transparent information about ENTSO-E’s activities. In particular, information about the fulfilment of the various tasks of ENTSO-E under Regulation (EU) 2019/943 is central.
2. SUMMARY OF THE ENTSO-E ANNUAL REPORT 2018 (4) In the ENTSO-E Annual Report 2018, ENTSO-E presents their key activity areas for 2018. The Report covers ENTSO-E’s activities in the area of the Internal Energy Market, which is divided into two parts related to i) network codes and ii) the future power system. The Report outlines the development of a new ICT approach and capability, including cyber-security and the development of the DSO partnership. The Report also gives an overview on the activities to coordinate and facilitate regional developments in order to develop transparency and trust, including stakeholder engagement activities.
3. ASSESSMENT OF THE ENTSO-E ANNUAL REPORT 2018 (5) The ENTSO-E Annual Report 2018 provides a good account of ENTSO-E’s activities in 2018 and communicates the relevant information in a way that is generally easy to understand for all stakeholders, HAS ADOPTED THIS OPINION:
1. The Agency considers that the ENTSO-E Annual Report 2018 is sufficiently in line with the requirements of Article 4(3)(b) of Regulation (EU) 2019/942.
