Regeringen beslutade den 23 maj 2002 att Sverige skulle ansluta sig till protokollet och dithörande tillägg I och II. Den 30 april 2004 deponerade Sverige sitt anslutningsinstrument till protokollet med tillägg hos Tullsamarbetsrådets (WCO) generalsekreterare. Protokollet har inte trätt i kraft.

Protokoll om ändring av internationella konventionen om förenkling och harmonisering av tullförfaranden

(utfärdat i Bryssel den 26 juni 1999)

De avtalsslutande parterna i Internationella konventionen om förenkling och harmonisering av tullförfaranden (som utfärdades i Kyoto den 18 maj 1973 och trädde i kraft den 25 september 1974), nedan kallad ”konventionen”, som tillkommit under beskydd av Tullsamarbetsrådet, nedan kallat ”rådet”,

som beaktar att det för att

– undanröja sådana skillnader mellan de avtalsslutande parternas tullförfaranden som kan hindra den internationella handeln och annat internationellt utbyte,

– möta den internationella handelns och tullförvaltningarnas behov av att tullförfaranden underlättas, förenklas och harmoniseras,

– uppnå adekvata normer för tullkontroll, och

– göra det möjligt för tullförvaltningarna att bemöta större förändringar av företags och förvaltningars metoder och arbetssätt,

är nödvändigt att ändra konventionen, som även beaktar att den ändrade konventionen,

– måste innehålla bestämmelser om att de centrala principerna för denna förenkling och harmonisering skall vara bindande för de avtalsslutande parterna i den ändrade konventionen,

– måste ge tullförvaltningarna möjlighet att tillämpa effektiva förfaranden som stöds av adekvata och effektiva kontrollmetoder, och

– kommer att göra det möjligt att uppnå en hög grad av förenkling och harmonisering av tullförfaranden, vilket utgör ett väsentligt mål för rådet, och således kommer att ge ett viktigt bidrag till målet att underlätta den internationella handeln,

har kommit överens om följande:

Artikel 1

Ingressen till och artiklarna i konventionen skall ändras i enlighet med tillägg I till detta protokoll.

Artikel 2

Bilagorna till konventionen skall ersättas med den allmänna bilaga som finns i tillägg II och de särskilda bilagor som finns i tillägg III till detta protokoll.

Artikel 3

1. Varje avtalsslutande part i konventionen kan uttrycka sitt samtycke till att bli bunden av detta protokoll, inklusive tilläggen I och II,

a) genom att underteckna det utan förbehåll för ratificering,

b) genom att deponera ett ratificeringsinstrument efter att ha undertecknat det med förbehåll för ratificering, eller

c) genom att ansluta sig till det.

2. Detta protokoll skall till och med den 30 juni 2000 vid rådets säte i Brys-

sel hållas öppet för undertecknande av de avtalsslutande parterna i konventionen. Därefter skall det stå öppet för anslutning.

3. Detta protokoll, inklusive tilläggen I och II, träder i kraft tre månader efter det att 40 avtalsslutande parter har undertecknat det utan förbehåll för ratificering eller har deponerat sina ratificerings- eller anslutningsinstrument.

4. Efter det att 40 avtalsslutande parter har uttryckt sitt samtycke till att bli bundna av detta protokoll i enlighet med punkt 1 kan en avtalsslutande part i konventionen godta ändringar av konventionen endast genom att bli part i detta protokoll. För en sådan avtalsslutande part träder detta protokoll i kraft tre månader efter det att parten har undertecknat det utan förbehåll för ratificering eller har deponerat sitt ratificerings- eller anslutningsinstrument.

Artikel 4

En avtalsslutande part i konventionen får, när den uttrycker sitt samtycke till att bli bunden av detta protokoll, godta vilken som helst av de särskilda bilagorna och vilket som helst av kapitlen i tillägg III till detta protokoll, och skall till rådets generalsekreterare anmäla detta godtagande och de rekommendationer för vilka den uttrycker förbehåll.

Artikel 5

Efter det att detta protokoll trätt i kraft får rådets generalsekreterare inte godta något instrument för ratificering av eller anslutning till konventionen.

Artikel 6

I fråga om förbindelser mellan parterna i detta protokoll skall detta protokoll med dess tillägg ersätta konventionen.

Artikel 7

Rådets generalsekreterare skall vara depositarie för detta protokoll och skall utföra de funktioner som avses i artikel 19 i tillägg I till detta protokoll.

Artikel 8

Detta protokoll skall från och med den 26 juni 1999 vid rådets säte i Bryssel hållas öppet för undertecknande av de avtalsslutande parterna i konventionen.

Artikel 9

I enlighet med artikel 102 i Förenta nationernas stadga skall detta protokoll och dess tillägg på begäran av rådets generalsekreterare registreras hos Förenta nationernas sekretariat.

Till bevis härpå har undertecknade befullmäktigade undertecknat detta protokoll.

Utfärdat i Bryssel den 26 juni 1999 på engelska och franska språken, vilka båda texter är lika giltiga, i ett enda original som skall deponeras hos rådets generalsekreterare, vilken skall överlämna bestyrkta kopior till samtliga enheter som avses i artikel 8.1 i tillägg I till detta protokoll.

Tillägg I

Internationell konvention om förenkling och harmonisering av tullförfaranden

(i ändrad lydelse)

Ingress

De avtalsslutande parterna i denna konvention, som tillkommit under beskydd av Tullsamarbetsrådet,

som strävar efter att undanröja sådana skillnader mellan de avtalsslutande parternas tullförfaranden som kan hindra den internationella handeln och annat internationellt utbyte,

som önskar ge ett verksamt bidrag till utvecklingen av denna handel och detta utbyte genom att förenkla och harmonisera tullförfaranden och genom att främja internationellt samarbete,

som noterar att de betydande fördelar som följer av att den internationella handeln underlättas kan uppnås utan att adekvata normer för tullkontroll äventyras,

som inser att denna förenkling och harmonisering kan uppnås genom att man i synnerhet tillämpar principerna om att

• program skall genomföras med syftet att kontinuerligt modernisera tullförfaranden och på så sätt göra dem mera effektiva,

• tullförfaranden skall tillämpas på ett förutsägbart, konsekvent och öppet sätt,

• berörda parter skall ges all nödvändig information om lagar, författningar, administrativa riktlinjer och förfaranden som rör tull,

• modern teknik skall införas, t.ex. riskhantering och bokföringsbaserade kontroller, och att informationsteknik skall användas i största möjliga utsträckning,

• samarbete vid behov skall ske med övriga nationella myndigheter, andra tullförvaltningar och näringslivet,

• relevanta internationella normer skall införas,

• berörda parter lätt skall få tillgång till administrativ och rättslig prövning,

som är övertygade om att ett internationellt instrument som inbegriper ovannämnda målsättningar och principer och som de förbinder sig att tillämpa kommer att medföra att tullförfaranden i hög grad förenklas och harmoniseras, vilket utgör ett väsentligt mål för Tullsamarbetsrådet, och således kommer att ge ett viktigt bidrag till målet att underlätta den internationella handeln,

har kommit överens om följande:

Kapitel I

Definitioner

Artikel 1

I denna konvention används följande beteckningar med de betydelser som här anges:

a) norm: en bestämmelse vars genomförande anses nödvändig för att tullförfaranden skall kunna harmoniseras och förenklas.

b) övergångsnorm: en norm i den allmänna bilagan för vilken en längre genomförandeperiod medges.

c) rekommendation: en bestämmelse i en särskild bilaga som anses utgöra ett framsteg på vägen mot harmonisering och förenkling av tullförfaranden och vars tillämpning i så stor utsträckning som möjligt anses önskvärd.

d) nationell lagstiftning: lagar, författningar och andra åtgärder som införs av en avtalsslutande parts behöriga myndighet och som är tillämpliga på hela den partens territorium, eller gällande fördrag som är bindande för den parten.

e) allmän bilaga: den samling bestämmelser som skall tillämpas på alla tullförfaranden som avses i denna konvention.

f) särskild bilaga: en samling bestämmelser som skall tillämpas på ett eller flera tullförfaranden som avses i denna konvention.

g) riktlinjer: en samling förklaringar av bestämmelserna i den allmänna bilagan, de särskilda bilagorna och dessas kapitel, vari anges några av de metoder som kan följas vid tillämpningen av normerna, övergångsnormerna och rekommendationerna, och i vilka särskilt beskrivs bästa praxis och rekommenderas exempel på större lättnader.

h) permanenta tekniska kommittén: rådets permanenta tekniska kommitté.

ij) rådet: den organisation som upprättats genom konventionen angående upprättande av ett råd för samarbete på tullområdet, vilken utfärdades i Bryssel den 15 december 1950.

k) tullunion eller ekonomisk union: en union som inrättats av och består av stater som har behörighet att anta för dem bindande författningar när det gäller frågor som regleras genom denna konvention och som har behörighet att besluta om att i enlighet med sina interna förfaranden underteckna, ratificera eller ansluta sig till denna konvention.

Kapitel II

Räckvidd och struktur

Konventionens räckvidd

Artikel 2

Varje avtalsslutande part skall åta sig att främja förenkling och harmonisering av tullförfaranden och att i detta syfte enligt bestämmelserna i denna konvention följa de normer, övergångsnormer och rekommendationer som anges i bilagorna till konventionen. Det skall dock stå varje avtalsslutande part fritt att bevilja större lättnader än de som avses i konventionen och varje avtalsslutande part rekommenderas att bevilja sådana större lättnader i så stor utsträckning som möjligt.

Artikel 3

Bestämmelserna i denna konvention får inte hindra tillämpning av nationell lagstiftning avseende förbud eller restriktioner för varor som omfattas av tullkontroll.

Konventionens struktur

Artikel 4

1. Konventionen består av en huvuddel, en allmän bilaga och särskilda bilagor.

2. Den allmänna bilagan och varje särskild bilaga till konventionen är i princip indelad i kapitel som består av

a) definitioner, och b) normer, varav några i den allmänna bilagan utgör övergångsnormer. 3. Varje särskild bilaga innehåller även rekommendationer.

4. Varje bilaga åtföljs av riktlinjer, vilka inte är bindande för de avtalsslutande parterna.

Artikel 5

Vid tillämpningen av denna konvention skall de särskilda bilagor eller kapitel däri som är bindande för en avtalsslutande part utgöra en integrerad del av konventionen, och för denna avtalsslutande part skall varje hänvisning till konventionen även gälla dessa bilagor eller kapitel.

Kapitel III

Konventionens förvaltning

Förvaltningskommitté

Artikel 6

1. Det skall inrättas en förvaltningskommitté som skall ta ställning till frågor som rör genomförandet av konventionen, alla åtgärder för att säkra en enhetlig tolkning och tillämpning av konventionen och alla föreslagna ändringar av konventionen.

2. De avtalsslutande parterna skall vara medlemmar i förvaltningskommittén.

3. Den behöriga förvaltningen för varje enhet som enligt artikel 8 kan bli avtalsslutande part i konventionen eller för varje medlem av Världshandelsorganisationen skall ha rätt att som observatör närvara vid förvaltningskommitténs möten. Rådet skall genom ett beslut fastställa sådana observatörers status och rättigheter. Dessa rättigheter får inte utövas innan det beslutet träder i kraft.

4. Förvaltningskommittén får erbjuda företrädare för internationella offentliga och icke-statliga organisationer att som observatörer närvara vid kommitténs möten.

5. Förvaltningskommittén a) skall för de avtalsslutande parterna rekommendera i) ändringar av konventionens huvuddel,

ii) ändringar av den allmänna bilagan, de särskilda bilagorna och kapitlen däri och införande av nya kapitel i den allmänna bilagan,

iii) införande av nya särskilda bilagor och nya kapitel i särskilda bilagor,

b) får i enlighet med artikel 16 besluta om ändring av rekommendationer eller om införande av nya rekommendationer i särskilda bilagor eller kapitel däri,

c) skall i enlighet med artikel 13.4 ta ställning till frågor som rör genomförandet av konventionen,

d) skall se över och uppdatera riktlinjerna,

e) skall ta ställning till alla andra frågor som är av betydelse för konventionen och som kan hänskjutas till kommittén,

f) skall informera den permanenta tekniska kommittén och rådet om sina beslut.

6. De avtalsslutande parternas behöriga förvaltningar skall till rådets generalsekreterare lämna förslag enligt punkt 5 a, b, c eller d, tillsammans med skälen till förslagen, liksom förfrågningar om uppförande av vissa punkter på dagordningen för förvaltningskommitténs möten. Rådets generalsekreterare skall göra de avtalsslutande parternas behöriga förvaltningar och de observatörer som avses i punkterna 2–4 uppmärksamma på dessa förslag.

7. Förvaltningskommittén skall mötas minst en gång per år. Varje år skall den välja en ordförande och en vice ordförande. Rådets generalsekreterare skall senast sex veckor före förvaltningskommitténs möte sända en inbjudan till mötet och ett utkast till dagordning till de avtalsslutande parternas behöriga förvaltningar och till de observatörer som avses i punkterna 2–4.

8. Om beslut i frågor som hänskjutits till förvaltningskommittén inte kan fattas i samförstånd skall beslut ske genom röstning av de närvarande avtalsslutande parterna. Förslag enligt punkt 5 a, b eller c skall antas med två tredjedelars majoritet av de avgivna rösterna. Beslut i alla andra frågor skall av förvaltningskommittén fattas med en majoritet av de avgivna rösterna.

9. I de fall artikel 8.5 tillämpas skall den tullunion eller den ekonomiska union som är avtalsslutande part vid omröstning ha ett antal röster som motsvarar det sammanlagda antal röster som tilldelats de unionsmedlemmar som är avtalsslutande parter.

10. Innan mötet avslutas skall förvaltningskommittén anta en rapport. Denna rapport skall överlämnas till rådet och de avtalsslutande parter och observatörer som avses i punkterna 2–4.

11. I de fall det i denna artikel inte föreskrivs några tillämpliga bestämmelser skall rådets arbetsordning tillämpas, om inte förvaltningskommittén fattar ett annat beslut.

Artikel 7

Vid omröstning i förvaltningskommittén skall beslut om varje särskild bilaga och varje kapitel i en särskild bilaga fattas separat.

a) Varje avtalsslutande part skall ha rätt att rösta i frågor som rör tolkning, tillämpning eller ändring av konventionens huvuddel och allmänna bilaga.

b) I frågor som rör en särskild bilaga eller ett kapitel i en särskild bilaga som redan är i kraft skall endast de avtalsslutande parter som godtagit den bilagan eller det kapitlet ha rätt att rösta.

c) Varje avtalsslutande part skall ha rätt att rösta om utkast till nya särskilda bilagor eller nya kapitel i en särskild bilaga.

Kapitel IV

Avtalsslutande part

Ratificering av konventionen

Artikel 8

1. Varje medlem av rådet och varje medlem av Förenta nationerna eller dess fackorgan kan bli avtalsslutande part i denna konvention

a) genom att underteckna den utan förbehåll för ratificering,

b) genom att deponera ett ratificeringsinstrument efter att ha undertecknat den med förbehåll för ratificering, eller

c) genom att ansluta sig till den.

2. Denna konvention skall till och med den 30 juni 1974 vid rådets säte i Bryssel hållas öppen för undertecknande av de medlemmar som avses i punkt 1. Därefter skall den stå öppen för sådana medlemmars anslutning.

3. Varje avtalsslutande part skall vid tidpunkten för undertecknandet eller ratificeringen av eller anslutningen till denna konvention ange vilken eller vilka särskilda bilagor eller kapitel däri den godtar. Den kan senare anmäla till depositarien att den godtar ytterligare en eller flera särskilda bilagor eller kapitel i konventionen.

4. Avtalsslutande parter som godtar en ny särskild bilaga eller ett nytt kapitel i en särskild bilaga skall anmäla detta till depositarien i enlighet med punkt 3.

5. a) En tullunion eller ekonomisk union kan i enlighet med punkterna 1–3 bli avtalsslutande part i denna konvention. Unionen skall i så fall informera depositarien om sin behörighet när det gäller de frågor som regleras i denna konvention. Unionen skall även informera depositarien om betydande ändringar av dess behörighet.

b) En tullunion eller ekonomisk union som är avtalsslutande part i denna konvention skall, i frågor som omfattas av dess behörighet, i eget namn utöva sina rättigheter och uppfylla de skyldigheter som genom konventionen uppstår för de medlemmar av unionen som är avtalsslutande parter i denna konvention. I detta fall får medlemmarna i unionen inte individuellt utöva sina rättigheter, t.ex. rätten att rösta.

Artikel 9

1. Varje avtalsslutande part som ratificerar denna konvention eller ansluter sig till den skall vara bunden av de ändringar av den, inklusive av den allmänna bilagan, vilka har trätt i kraft på dagen för deponeringen av partens ratificerings- eller anslutningsinstrument.

2. Varje avtalsslutande part som godtar en särskild bilaga eller ett kapitel däri skall vara bunden av de ändringar av normer i bilagan eller kapitlet som har trätt i kraft den dag parten anmäler godtagandet till depositarien. Varje avtalsslutande part som godtar en särskild bilaga eller ett kapitel däri skall vara bunden av de ändringar av rekommendationer i bilagan eller kapitlet som har trätt i kraft den dag parten anmäler godtagandet till depositarien, såvida parten inte i enlighet med artikel 12 uttrycker förbehåll beträffande en eller flera av dessa rekommendationer.

Konventionens tillämpning

Artikel 10

1. Varje avtalsslutande part kan antingen vid tidpunkten för undertecknande utan förbehåll för ratificering, vid deponeringen av sitt ratificerings- eller anslutningsinstrument, eller senare, anmäla till depositarien att denna konvention skall omfatta alla eller vissa av de territorier för vilkas internationella förbindelser parten i fråga är ansvarig. Denna anmälan skall träda i kraft tre månader efter den dag då depositarien mottog den. Konventionen får dock inte tillämpas på de territorier som nämns i anmälan innan den trätt i kraft för parten i fråga.

2. Varje avtalsslutande part som i enlighet med punkt 1 har anmält att denna konvention skall omfatta ett territorium för vars internationella förbindelser den är ansvarig, kan enligt det förfarande som anges i artikel 19 anmäla till depositarien att territoriet i fråga skall upphöra med att tillämpa konventionen.

Artikel 11

För tillämpningen av denna konvention skall en tullunion eller ekonomisk union som är avtalsslutande part anmäla till rådets generalsekreterare vilka territorier som ingår i unionen, och dessa territorier skall betraktas som ett enda territorium.

Godtagande av bestämmelser och förbehåll

Artikel 12

1. Alla avtalsslutande parter skall vara bundna av den allmänna bilagan.

2. En avtalsslutande part kan godta en eller flera av de särskilda bilagorna eller ett eller flera av kapitlen däri. En avtalsslutande part som godtar en särskild bilaga eller ett kapitel däri skall vara bunden av alla de normer som finns i denna bilaga eller detta kapitel. En avtalsslutande part som godtar en särskild bilaga eller ett kapitel däri skall vara bunden av alla de rekommendationer som finns i denna bilaga eller detta kapitel, såvida parten inte vid tidpunkten för godtagandet eller senare till depositarien anmäler de rekommendationer för vilka den uttrycker förbehåll och anger skillnaderna mellan partens nationella lagstiftning och rekommendationerna i fråga. Varje avtalsslutande part som uttryckt förbehåll kan när som helst återkalla dem, helt eller delvis, genom en anmälan till depositarien med uppgift om den dag då återkallandet träder i kraft.

3. Varje avtalsslutande part som är bunden av en särskild bilaga eller ett kapitel däri skall undersöka möjligheten att återkalla förbehåll beträffande rekommendationer som uttryckts enligt punkt 2 och skall, vid utgången av varje treårsperiod från och med den dag konventionen träder i kraft för den parten, till rådets generalsekreterare anmäla resultatet av denna översyn och ange de bestämmelser i den nationella lagstiftningen som parten anser strida mot ett återkallande av förbehållen.

Genomförande av bestämmelser

Artikel 13

1. Varje avtalsslutande part skall genomföra normerna i den allmänna bilagan och i de särskilda bilagor eller kapitel däri som den har godtagit senast 36 månader efter det att dessa bilagor eller kapitel har trätt i kraft för den parten.

2. Varje avtalsslutande part skall genomföra övergångsnormerna i den allmänna bilagan senast 60 månader efter det att den allmänna bilagan har trätt i kraft för den parten.

3. Varje avtalsslutande part skall genomföra rekommendationerna i de särskilda bilagor eller kapitel däri som den har godtagit senast 36 månader efter det att dessa bilagor eller kapitel har trätt i kraft för den parten, såvida förbehåll inte har uttryckts beträffande en eller flera av dessa rekommendationer.

4. a) Om en tidsperiod som avses i punkt 1 eller 2 i praktiken visar sig vara otillräcklig för att en avtalsslutande part skall kunna genomföra bestämmelserna i den allmänna bilagan, får den parten före utgången av den berörda tidsperioden ansöka om att förvaltningskommittén förlänger den. I denna ansökan skall parten ange för vilka bestämmelser en förlängning begärs och skälen till detta.

b) Förvaltningskommittén får under särskilda omständigheter besluta att bevilja en sådan förlängning. I detta beslut skall de särskilda omständigheter som motiverar beslutet anges och förlängningen får inte överskrida ett år. Vid utgången av den förlängda perioden skall den avtalsslutande parten underrätta depositarien om genomförandet av de bestämmelser för vilka förlängningen beviljats.

Tvistlösning

Artikel 14

1. En tvist mellan två eller flera avtalsslutande parter angående tolkningen eller tillämpningen av denna konvention skall i möjligaste mån lösas genom förhandlingar mellan parterna i fråga.

2. En tvist som inte kan lösas genom förhandlingar skall av parterna i tvisten hänskjutas till förvaltningskommittén, som därefter skall ta ställning till tvisten och framlägga rekommendationer för dess lösning.

3. Tvistande avtalsslutande parter kan i förväg komma överens om att godta förvaltningskommitténs rekommendationer såsom bindande.

Ändringar av konventionen

Artikel 15

1. Texten till en ändring som förvaltningskommittén rekommenderat de avtalsslutande parterna i enlighet med artikel 6.5 a i och ii skall av rådets generalsekreterare meddelas alla avtalsslutande parter och de medlemmar av rådet som inte är avtalsslutande parter.

2. Ändringar av konventionens huvuddel skall för alla avtalsslutande parter träda i kraft tolv månader efter det att de avtalsslutande parter som är närvarande vid det förvaltningskommittémöte vid vilket ändringarna rekommenderades har deponerat sina godtagandeinstrument, förutsatt att ingen av parterna framför en invändning inom tolv månader från den dag ändringarna meddelades.

3. En rekommenderad ändring av den allmänna bilagan eller av särskilda bilagor eller kapitel däri skall anses vara godtagen sex månader efter den dag då den rekommenderade ändringen meddelades de avtalsslutande parterna, såvida inte

a) en invändning har framförts av en avtalsslutande part eller, i fråga om en särskild bilaga eller ett kapitel däri, av en avtalsslutande part som är bunden av den särskilda bilagan eller kapitlet i fråga, eller

b) en avtalsslutande part informerar rådets generalsekreterare om att den visserligen avser godta den rekommenderade ändringen, men att de villkor som är nödvändiga för ett sådant godtagande ännu inte är uppfyllda.

4. Om en avtalsslutande part sänder ett sådant meddelande som avses i punkt 3 b till rådets generalsekreterare, får den, så länge som den inte har anmält sitt godtagande av den rekommenderade ändringen till rådets generalsekreterare, framföra en invändning mot ändringen senast 18 månader efter utgången av den sexmånadersperiod som avses i punkt 3.

5. Om en invändning mot den rekommenderade ändringen anmäls enligt punkt 3 a eller 4, skall ändringen inte anses vara godtagen och skall vara utan verkan.

6. Om en avtalsslutande part har sänt ett meddelande enligt punkt 3 b, skall ändringen anses vara godtagen vid den tidigaste av följande två tidpunkter:

a) Den dag då alla de avtalsslutande parter som sänt ett sådant meddelande har anmält sitt godtagande av den rekommenderade ändringen till rådets generalsekreterare, dock skall, i de fall alla godtaganden anmälts före utgången av den sexmånadersperiod som avses i punkt 3, denna dag anses vara den dag då denna sexmånadersperiod löper ut.

b) Den dag då den artonmånadersperiod som avses i punkt 4 löper ut. 7. En ändring av den allmänna bilagan eller de särskilda bilagorna eller ka-

pitlen däri som anses vara godtagen skall träda i kraft antingen sex månader efter den dag då den anses vara godtagen eller, om en annan period föreskrivs i den rekommenderade ändringen, vid utgången av den perioden räknat från den dag då ändringen anses vara godtagen.

8. Rådets generalsekreterare skall snarast möjligt underrätta de avtalsslutande parterna i denna konvention om alla invändningar mot den rekommenderade ändringen som framförts enligt punkt 3 a och alla meddelanden som mottagits enligt punkt 3 b. Rådets generalsekreterare skall därefter informera de avtalsslutande parterna om huruvida de avtalsslutande parter som sänt ett sådant meddelande framför en invändning mot den rekommenderade ändringen eller godtar den.

Artikel 16

1. Utan hinder av det ändringsförfarande som avses i artikel 15 får förvaltningskommittén i enlighet med artikel 6 besluta om att ändra rekommendationer eller om att införa nya rekommendationer i en särskild bilaga eller i ett kapitel däri. Rådets generalsekreterare skall inbjuda varje avtalsslutande part att delta i förvaltningskommitténs överläggningar. Texten till varje sådan ändring eller ny rekommendation som beslutats på detta sätt skall av rådets generalsekreterare meddelas de avtalsslutande parterna och de medlemmar av rådet som inte är avtalsslutande parter i denna konvention.

2. En ändring av en rekommendation eller ett införande av en ny rekommendation som beslutats enligt punkt 1 skall träda i kraft sex månader efter

det att de har meddelats av rådets generalsekreterare. Varje avtalsslutande part som är bunden av en särskild bilaga eller ett kapitel där sådana ändringar sker eller nya rekommendationer införs skall anses ha godtagit dessa ändringar eller nya rekommendationer, såvida den inte uttrycker förbehåll enligt förfarandet i artikel 12.

Anslutningens varaktighet

Artikel 17

1. Denna konvention skall gälla på obegränsad tid, men en avtalsslutande part får säga upp den när som helst efter dess ikraftträdande enligt artikel 18.

2. Denna uppsägning skall anmälas genom en skriftlig handling som skall deponeras hos depositarien.

3. Uppsägningen skall träda i kraft sex månader efter det att depositarien mottar uppsägningshandlingen.

4. Bestämmelserna i punkterna 2 och 3 skall även tillämpas på de särskilda bilagorna eller kapitlen däri, angående vilka en avtalsslutande part får återkalla sitt godtagande när som helst efter ikraftträdandet.

5. En avtalsslutande part som återkallar sitt godtagande av den allmänna bilagan skall anses ha sagt upp konventionen. Även i detta fall skall bestämmelserna i punkterna 2 och 3 tillämpas.

Kapitel V

Slutbestämmelser

Konventionens ikraftträdande

Artikel 18

1. Denna konvention träder i kraft tre månader efter det att fem av de enheter som avses i artikel 8.1 och 8.5 har undertecknat konventionen utan förbehåll för ratificering eller har deponerat sina ratificerings- eller anslutningsinstrument.

2. För varje avtalsslutande part träder denna konvention i kraft tre månader efter det att parten har blivit avtalsslutande part enligt bestämmelserna i artikel 8.

3. En särskild bilaga till denna konvention eller ett kapitel däri träder i kraft tre månader efter det att fem avtalsslutande parter har godtagit den särskilda bilagan eller kapitlet i fråga.

4. Efter det att en särskild bilaga eller ett kapitel däri har trätt i kraft enligt punkt 3 träder den bilagan eller det kapitlet i kraft för en avtalsslutande part tre månader efter det att parten har anmält sitt godtagande. En särskild bilaga eller ett kapitel däri träder dock inte i kraft för en avtalsslutande part innan konventionen har trätt i kraft för den parten.

Konventionens depositarie

Artikel 19

1. Denna konvention, alla underteckningar med eller utan förbehåll för ratificering och alla ratificerings- och anslutningsinstrument skall deponeras hos rådets generalsekreterare.

2. Depositarien skall a) motta och förvara konventionens texter i original,

b) göra bestyrkta kopior av originaltexterna och överlämna dem till de avtalsslutande parterna, de medlemmar av rådet som inte är avtalsslutande parter och Förenta nationernas generalsekreterare,

c) motta varje underteckning med eller utan förbehåll för ratificering och varje ratificering av eller anslutning till konventionen, samt motta och förvara alla handlingar, anmälningar och meddelanden som rör konventionen,

d) undersöka huruvida underteckningen på handlingar, anmälningar och meddelanden som rör konventionen har avgivits i korrekt form och vid behov göra den avtalsslutande parten uppmärksam på denna fråga,

e) till de avtalsslutande parterna, de medlemmar av rådet som inte är avtalsslutande parter och Förenta nationernas generalsekreterare anmäla

– underteckningar, ratificeringar och godtaganden av samt anslutningar till bilagor och kapitel enligt artikel 8,

– nya kapitel i den allmänna bilagan och nya särskilda bilagor eller kapitel däri för vilka förvaltningskommittén har beslutat rekommendera införande i konventionen,

– dagen för ikraftträdande av konventionen, den allmänna bilagan och varje särskild bilaga eller särskilt kapitel däri, i enlighet med artikel 18,

– de anmälningar och meddelanden som mottagits enligt artiklarna 8, 10, 11, 12 och 13,

– avtalsslutande parters återkallanden av godtaganden av bilagor och kapitel,

– uppsägningar enligt artikel 17,

– alla ändringar som godtagits enligt artikel 15 och dagen för dessas ikraftträdande.

3. I de fall en avtalsslutande part och depositarien har olika åsikter om den senares fullgörande av sina uppgifter, skall depositarien eller den berörda parten uppmärksamma de andra avtalsslutande parterna och undertecknarna eller, i förekommande fall, förvaltningskommittén eller rådet på detta.

Registrering och giltiga texter

Artikel 20

I enlighet med artikel 102 i Förenta nationernas stadga skall denna konvention på begäran av rådets generalsekreterare registreras hos Förenta nationernas sekretariat.

Till bevis härpå har undertecknade befullmäktigade undertecknat denna konvention.

Som skedde i Kyoto den 18 maj 1973 på engelska och franska språken, vilka båda texter är lika giltiga, i ett enda original vilket skall deponeras hos rådets generalsekreterare, som skall överlämna bestyrkta kopior till samtliga enheter som avses i artikel 8.1 i konventionen.

Kapitel 1

Allmänna principer

1.1Norm

Definitionerna, normerna och övergångsnormerna i denna bilaga skall tillämpas på de tullförfaranden som anges i denna bilaga och i tillämplig utsträckning på de förfaranden som anges i de särskilda bilagorna.

1.2Norm

De villkor som skall uppfyllas och de tullformaliteter som skall fullgöras avseende förfaranden i denna bilaga och i de särskilda bilagorna skall anges i nationell lagstiftning och skall vara så enkla som möjligt.

1.3Norm

Tullförvaltningen skall upprätta och upprätthålla formella förbindelser av rådgivande karaktär med handeln i syfte att öka samarbetet och underlätta deltagandet vid utformningen av de mest effektiva arbetsmetoderna i enlighet med nationell lagstiftning och internationella avtal.

Kapitel 2

Definitioner

I bilagorna till denna konvention används följande beteckningar med de betydelser som här anges: E1./ överklagande: en åtgärd genom vilken en person som direkt berörs av F23. ett beslut eller en försummelse av tullen och som anser sig förfördelad

av detta söker upprättelse hos en behörig myndighet. E2./ bestämning av tullar och skatter: fastställande av det belopp som skall F19. betalas i form av tullar och skatter. E3./ bokföringsbaserad kontroll: de åtgärder som tullen vidtar för att över- F4. tyga sig om att deklarationerna är riktiga och äkta genom att undersö-

ka berörda personers bokföringsböcker, andra redovisningsunderlag,

administrativa system och kommersiella uppgifter. E4./ kontroll av varudeklaration: de åtgärder som tullen vidtar för att över- F15. tyga sig om att varudeklarationen är riktigt ifylld och att nödvändiga

styrkande handlingar uppfyller de fastställda villkoren. E5./ klarering: fullgörande av de tullformaliteter som krävs för att varor F9. skall kunna övergå till fri konsumtion, exporteras eller hänföras till ett

tillämpa och vilkas efterlevnad tullen skall kontrollera, samt de för-

fattningar som tullen utfärdar inom ramen för sin behörighet. E11./ tullkontor: en administrativ enhet inom tullen som är behörig att ge- F2. nomföra tullformaliteter, samt de lokaler och områden som godkänts

för detta syfte av de behöriga myndigheterna. E12./ tullområde: det område inom vilket en avtalsslutande parts tullagstift- F25. ning gäller. E13./ beslut: en enskild åtgärd genom vilken tullen fattar beslut i ett ärende F6. som rör tullagstiftning. E14./ deklarant: en person som upprättar en varudeklaration eller i vars F7. namn den upprättas. E15./ förfallodag: den dag när tullar och skatter skall betalas. F5. digheters vägnar. E19./ varudeklaration: redogörelse i en av tullen föreskriven form genom F8. vilken en berörd person ansöker om att ett visst tullförfarande skall

tillämpas på varorna och lämnar de upplysningar som tullen behöver

för att detta förfarande skall kunna tillämpas. E20./ tullar och skatter vid import: tullar och alla andra avgifter, skatter eller F14. pålagor som tas ut vid eller i samband med import av varor, men som

inte inbegriper pålagor som högst motsvarar den ungefärliga kostna-

den för utförda tjänster eller som tullen tar ut på andra nationella myn-

digheters vägnar. E21./ ömsesidigt administrativt bistånd: de åtgärder som en tullförvaltning F1. vidtar på en annan tullförvaltnings vägnar eller i samarbete med en an-

nan tullförvaltning i syfte att tillämpa tullagstiftningen korrekt och fö-

rebygga, undersöka och bekämpa överträdelser av tullagstiftningen. E22./ försummelse: tullens underlåtelse att i enlighet med tullagstiftningen F21. och inom rimlig tid vidta en åtgärd eller fatta ett beslut i en fråga som

på ett korrekt sätt förelagts den. E23./ person: såväl fysisk som juridisk person, såvida inget annat framgår av F22. sammanhanget. E24./ frigörande av varor: den åtgärd genom vilken tullen tillåter berörda F20. personer att förfoga över varor för vilka klarering pågår. E25./ återbetalning: återbetalning, helt eller delvis, av tullar och skatter som F24. betalats för varor och eftergift, helt eller delvis, av tullar och skatter

som ännu inte har betalats.

E26./ säkerhet: det som övertygar tullen om att en skyldighet mot tullen F17. kommer att fullgöras. Säkerheten beskrivs som ”gemensam” om den

garanterar att skyldigheter som härrör från flera tullärenden kommer

att fullgöras. E27./ tredje part: varje person som direkt har att göra med tullen, för någon F26. annan person och på dennes vägnar, i samband med import, export,

förflyttning eller lagring av varor.

Kapitel 3

Klarering och andra tullformaliteter

Behöriga tullkontor

3.1Norm

Tullen skall utse de tullkontor vid vilka varor får visas upp eller klareras. Vid fastställandet av dessa kontors behörighet, belägenhet och öppettider skall de faktorer som skall beaktas särskilt inbegripa handelns behov.

3.2Norm

På begäran av en berörd person och av skäl som tullen bedömer som giltiga skall tullen, under förutsättning att resurser är tillgängliga, utföra de uppgifter som hänger samman med ett tullförfarande på andra tider än dess öppettider och på annan plats än tullkontoret. De avgifter tullen debiterar för detta skall inte vara högre än den ungefärliga kostnaden för de utförda tjänsterna.

3.3Norm

När tullkontor är belägna vid en gemensam gränsövergång skall de berörda tullförvaltningarna samordna öppettiderna och kontorens behörighet.

3.4Övergångsnorm

Vid gemensamma gränsövergångar skall de berörda tullförvaltningarna när det är möjligt utföra gemensamma kontroller.

3.5Övergångsnorm

När tullen avser att inrätta ett nytt tullkontor eller omvandla ett befintligt kontor vid en gemensam gränsövergång, skall den, om det är möjligt, samarbeta med grannlandets tull för att samordna tullkontoren så att gemensamma kontroller underlättas.

Deklarant

a) Personer som har rätt att agera som deklarant

3.6Norm

I den nationella lagstiftningen skall det anges under vilka villkor en person har rätt att agera som deklarant.

3.7Norm

Varje person som får förfoga över varorna skall ha rätt att agera som deklarant.

b) Deklarantens ansvar

3.8Norm

Deklaranten skall inför tullen ansvara för att uppgifterna i varudeklarationen är riktiga och att tullar och skatter betalas.

c) Deklarantens rättigheter

3.9Norm

Innan en varudeklaration inges skall deklaranten ha rätt att på villkor som får fastställas av tullen

a) granska varorna, och

b) ta stickprov.

3.10Norm

Tullen skall inte begära en separat varudeklaration för stickprov som får tas under tullens övervakning, förutsatt att stickproven inkluderas i varudeklarationen för sändningen i fråga.

Varudeklaration

a) Varudeklarationens format och innehåll

3.11Norm

Varudeklarationens innehåll skall bestämmas av tullen. Varudeklarationens pappersformat skall överensstämma med FN:s anvisningar för utformning.

I fråga om automatisk bearbetning i samband med tullklarering skall de elektroniskt ingivna varudeklarationernas format baseras på internationella standarder för elektroniskt informationsutbyte i enlighet med Tullsamarbetsrådets rekommendationer om informationsteknik.

3.12Norm

Tullen skall endast begära att sådana uppgifter anges i varudeklarationen som bedöms nödvändiga för bestämning och uttag av tullar och skatter, sammanställning av statistik och tillämpning av tullagstiftning.

3.13Norm

Om deklaranten, av skäl som tullen bedömer som giltiga, inte har tillgång till alla upplysningar som krävs för att upprätta varudeklarationen, skall han tillåtas att inge en preliminär eller ofullständig deklaration, förutsatt att den innehåller de uppgifter som tullen anser nödvändiga och att deklaranten åtar sig att komplettera den inom en bestämd tid.

3.14Norm

Om tullen registrerar en preliminär eller ofullständig varudeklaration skall varornas behandling i tullhänseende inte skilja sig från den som skulle ha beviljats om en fullständig och korrekt varudeklaration hade ingivits redan från början.

Frigörandet av varorna skall inte fördröjas, förutsatt att den säkerhet som krävs för att garantera uttag av tillämpliga tullar och skatter har ställts.

3.15Norm

Tullen skall kräva att varudeklarationen inges i original och att den åtföljs av endast det minsta antalet nödvändiga kopior.

b) Handlingar som styrker varudeklarationen

3.16Norm

Till stöd för varudeklarationen skall tullen endast kräva de handlingar som den anser nödvändiga för att kontrollera tullärendet och se till att alla krav som anges i tullagstiftningen har uppfyllts.

3.17Norm

Om vissa styrkande handlingar av skäl som tullen bedömer som giltiga inte kan inges tillsammans med varudeklarationen, skall tullen tillåta att dessa handlingar visas upp inom en bestämd tid.

3.18Övergångsnorm

Tullen skall tillåta att styrkande handlingar inges elektroniskt.

3.19Norm

Tullen skall inte kräva att uppgifterna i styrkande handlingar översätts, utom när det är nödvändigt för bearbetningen av varudeklarationen.

Ingivande, registrering och kontroll av varudeklarationen

3.20Norm

Tullen skall tillåta att varudeklarationen inges till vilket som helst av de utsedda tullkontoren.

3.21Övergångsnorm

Tullen skall tillåta att varudeklarationen inges elektroniskt.

3.22Norm

Varudeklarationen skall inges mellan de tider som anges av tullen.

3.23Norm

När det i den nationella lagstiftningen anges en tidsgräns för ingivande av varudeklarationen, skall denna tid vara tillräcklig för att deklaranten skall kunna fylla i varudeklarationen och skaffa fram de styrkande handlingar som krävs.

3.24Norm

På begäran av deklaranten och av skäl som tullen bedömer som giltiga, skall tullen utsträcka den föreskrivna tidsgränsen för ingivande av varudeklarationen.

3.25Norm

Den nationella lagstiftningen skall innehålla bestämmelser om ingivande och registrering eller kontroll av varudeklarationen och de styrkande handlingarna före varornas ankomst.

3.26Norm

När tullen inte kan registrera varudeklarationen, skall den ange skälen till detta för deklaranten.

3.27Norm

Tullen skall tillåta deklaranten att ändra en redan ingiven varudeklaration, förutsatt att tullen varken har börjat kontrollera deklarationen eller undersöka varorna när den mottar denna begäran.

3.28Övergångsnorm

Tullen skall tillåta deklaranten att ändra en ingiven varudeklaration även om begäran mottas efter det att kontrollen av varudeklarationen har påbörjats, förutsatt att tullen bedömer deklarantens skäl som giltiga.

3.29Övergångsnorm

Deklaranten skall tillåtas att återkalla en varudeklaration och ansöka om tillämpning av ett annat tullförfarande, förutsatt att hans begäran om detta lämnas till tullen innan varorna har frigjorts och att hans skäl bedöms som giltiga av tullen.

3.30Norm

Kontroll av varudeklarationen skall göras samtidigt som eller snarast möjligt efter det att varudeklarationen registreras.

3.31Norm

Vid kontroll av varudeklarationen skall tullen endast vidta de åtgärder som den bedömer som väsentliga för att se till att tullagstiftningen efterlevs.

Särskilda förfaranden för godkända personer

3.32Övergångsnorm

För sådana godkända personer som uppfyller av tullen föreskrivna krav, inbegripet att personen i fråga i det förflutna har efterlevt lagar och författningar på tullområdet och att han har ett tillfredsställande system för affärsredovisning, skall tullen föreskriva

– frigörande av varor när den minimimängd upplysningar lämnats som krävs för varornas identifiering och som medger att den slutliga varudeklarationen fylls i i efterhand,

– klarering av varorna i deklarantens lokaler eller på en annan plats som tullen godkänt,

samt, i den utsträckning det är möjligt, andra särskilda förfaranden såsom följande:

– Att en enda varudeklaration får användas för all import och export under en viss period, i de fall en person ofta importerar eller exporterar varor.

– Att den godkända personen på grundval av sin affärsredovisning själv bedömer vilka tullar och skatter som skall betalas och, i tillämpliga fall, ser till att andra krav på tullområdet uppfylls.

– Att varudeklarationen inges genom en notering i den godkända personens bokföring som senare styrks med hjälp av en kompletterande deklaration.

Undersökning av varor

a) Tid som behövs för undersökning av varor

3.33Norm

I de fall tullen beslutar att de deklarerade varorna skall undersökas, skall detta ske snarast möjligt efter registreringen av varudeklarationen.

3.34Norm

Vid tidsplanering av undersökningar, skall undersökning av levande djur, lättförstörbara varor och andra varor vars undersökning godtas som brådskande av tullen prioriteras.

3.35Övergångsnorm

Om varorna måste granskas av andra behöriga myndigheter och tullen också planerar en undersökning, skall tullen se till att undersökningarna samordnas och om möjligt sker samtidigt.

b) Deklarantens närvaro vid undersökning av varor

3.36Norm

Tullen skall överväga en begäran från deklaranten om att få närvara eller representeras vid undersökningen av varorna. En sådan begäran skall beviljas såvida det inte föreligger exceptionella omständigheter.

3.37Norm

Om tullen anser det ändamålsenligt, skall den kräva att deklaranten är närvarande eller representeras vid undersökningen av varorna så att tullen kan få det bistånd som behövs för att underlätta undersökningen.

c) Stickprov

3.38Norm

Stickprov skall tas endast när tullen bedömer det som nödvändigt för klassificering enligt tulltaxan, för fastställande av de deklarerade varornas värde eller för att se till att andra bestämmelser i nationell lagstiftning tillämpas. Stickproven skall vara så små som möjligt.

Fel

3.39Norm

Tullen skall inte fastställa betydande påföljder för fel när den är övertygad om att felet är oavsiktligt och att det inte rör sig om bedrägliga avsikter eller grov vårdslöshet. I de fall tullen anser att det är nödvändigt att motverka att sådana fel upprepas, får en påföljd som inte är strängare än vad som är nödvändigt för detta syfte fastställas.

Frigörande av varor

3.40Norm

Deklarerade varor skall frigöras så snart som tullen har undersökt dem eller beslutat att inte undersöka dem, förutsatt att

– ingen överträdelse har upptäckts,

– import- eller exportlicens eller andra nödvändiga handlingar har erhållits,

– alla tillstånd som avser det berörda förfarandet har erhållits, och

– alla tullar och skatter har betalats eller åtgärder vidtagits för att garantera deras uttag.

3.41Norm

När tullen är övertygad om att deklaranten senare kommer att fullgöra alla formaliteter för klarering skall den frigöra varorna, förutsatt att deklaranten visar upp en handling av kommersiell eller officiell natur som innehåller de viktigaste uppgifterna om sändningen i fråga och som tullen kan godta samt att säkerhet i tillämpliga fall har ställts för att garantera uttag av eventuella tullar och skatter.

3.42Norm

I de fall tullen beslutar att stickprov måste analyseras i ett laboratorium eller att den behöver ingående teknisk dokumentation eller expertråd, skall den frigöra varorna innan den känner till resultatet av denna kontroll, förutsatt att nödvändig säkerhet har ställts och att den är övertygad om att varorna inte omfattas av förbud eller restriktioner.

3.43Norm

När en överträdelse har upptäckts skall tullen inte vänta tills administrativa eller rättsliga åtgärder har fullbordats innan den frigör varorna, förutsatt att varorna inte kan komma att bli föremål för förverkande eller kan komma att behövas som bevis i ett senare skede och att deklaranten betalar tullar och skatter samt ställer en säkerhet som garanterar uttag av eventuella ytterligare tullar och skatter och uttag av påföljder.

Överlåtelse eller förstöring av varor

3.44Norm

Om varor ännu inte har frigjorts för fri konsumtion eller om de har hänförts till ett annat tullförfarande och ingen överträdelse har upptäckts, skall den berörda personen inte krävas på betalning av tullar och skatter och skall ha rätt till återbetalning av dessa i följande fall:

– När, på hans begäran, dessa varor överlåts till staten, förstörs eller görs kommersiellt värdelösa under tullkontroll, i enlighet med tullens beslut. Eventuella kostnader för detta skall bäras av den berörda personen.

– När dessa varor förstörs eller oåterkalleligen förloras genom en olycka eller force majeure, förutsatt att denna förstöring eller förlust fastställs på ett för tullen godtagbart sätt.

– När det förekommer brist till följd av varornas beskaffenhet och denna brist fastställs på ett för tullen godtagbart sätt.

Allt avfall eller skrot som återstår efter förstöringen skall, om det övergår till fri konsumtion eller exporteras, omfattas av de tullar och skatter som vid import eller export tillämpas på avfall eller skrot i det tillståndet.

3.45Övergångsnorm

Om tullen säljer varor som inte har deklarerats inom den tillåtna tiden eller inte kunde frigöras även om ingen överträdelse har upptäckts, skall inkoms-

terna från försäljningen, efter avdrag för tullar och skatter och alla andra uppkomna pålagor och utgifter, överlämnas till de personer som har rätt till dem eller, när detta inte är möjligt, stå till dessa personers förfogande under en bestämd tid.

Kapitel 4

Tullar och skatter

A. Bestämning, uttag och betalning av tullar och skatter

4.1Norm

I den nationella lagstiftningen skall de omständigheter anges under vilka skyldighet att betala tullar och skatter uppstår.

4.2Norm

I den nationella lagstiftningen skall det anges inom vilken tid tillämpliga tullar och skatter skall bestämmas. Bestämningen skall ske snarast möjligt efter det att varudeklarationen inges eller skyldigheten att betala uppstår på annat sätt.

4.3Norm

I den nationella lagstiftningen skall det anges på vilka faktorer bestämningen av tullar och skatter baseras och på vilka villkor de fastställs.

4.4Norm

Tull- och skattesatserna skall anges i officiella publikationer.

4.5Norm

I den nationella lagstiftningen skall den tidpunkt anges som skall beaktas för bestämning av tull- och skattesatserna.

4.6Norm

I den nationella lagstiftningen skall det anges vilka metoder som får användas för att betala tullar och skatter.

4.7Norm

I den nationella lagstiftningen skall det anges vilka personer som ansvarar för betalningen av tullar och skatter.

4.8Norm

I den nationella lagstiftningen skall det anges förfallodag och den plats där betalningen skall ske.

4.9Norm

När det i den nationella lagstiftningen anges att förfallodagen kan infalla efter frigörandet av varorna, skall den dagen infalla åtminstone tio dagar efter frigörandet. Ingen ränta skall debiteras för perioden mellan dagen för frigörande och förfallodagen.

4.10Norm

I den nationella lagstiftningen skall det anges inom vilken period tullen får vidta rättsliga åtgärder för att ta ut de tullar och skatter som inte betalats i rätt tid.

4.11Norm

I den nationella lagstiftningen skall det anges vilken ränta som skall debiteras för de tull- och skattebelopp som inte betalats i rätt tid och på vilka villkor den räntan skall tillämpas.

4.12Norm

När tullar och skatter har betalats skall ett kvitto utställas till den betalande som bevis på betalningen, såvida det inte finns något annat bevis på betalningen.

4.13Övergångsnorm

I den nationella lagstiftningen skall det anges ett minsta värde eller ett minimibelopp som tullarna och skatterna måste uppgå till för att de skall tas ut.

4.14Norm

Om tullen finner att fel i varudeklarationen eller vid bestämningen av tullar och skatter kommer att medföra eller redan har medfört uttag eller uppbörd av ett tull- och skattebelopp som understiger det som rättsligen kan debiteras, skall tullen korrigera felet och ta ut icke betalda belopp. Om beloppet i fråga understiger det minimibelopp som anges i den nationella lagstiftningen, skall dock tullen inte ta ut eller uppbära beloppet.

B. Anstånd med betalning av tullar och skatter

4.15Norm

När det i den nationella lagstiftningen anges bestämmelser om anstånd med betalning av tullar och skatter, skall de villkor på vilka denna lättnad får beviljas anges.

4.16Norm

Anstånd med betalningen skall, i den utsträckning det är möjligt, medges utan debitering av ränta.

4.17Norm

Perioden för anstånd med betalning av tullar och skatter skall uppgå till minst 14 dagar.

C. Återbetalning av tullar och skatter

4.18Norm

Återbetalning skall beviljas när det fastställs att tullar och skatter har debiterats med ett för högt belopp till följd av ett fel vid deras bestämning.

4.19Norm

Återbetalning skall beviljas i fråga om importerade eller exporterade varor

som vid import- eller exporttillfället befunnits vara defekta eller på annat sätt inte överensstämma med de överenskomna specifikationerna och som återlämnas antingen till leverantören eller till en annan av leverantören utsedd person, om följande villkor är uppfyllda:

– Varorna har inte bearbetats, reparerats eller använts i importlandet och återexporteras inom skälig tid.

– Varorna har inte bearbetats, reparerats eller använts i det land till vilket de exporterats och de återimporteras inom skälig tid.

Att varorna använts skall dock inte hindra återbetalning om denna användning var nödvändig för att upptäcka de defekter eller andra omständigheter som är orsaken till att varorna skall återexporteras eller återimporteras.

Som ett alternativ till återexport eller återimport får, enligt tullens beslut, varorna överlåtas till staten, förstöras eller göras kommersiellt värdelösa under tullkontroll. Denna överlåtelse eller förstöring skall dock inte medföra några kostnader för staten.

4.20Övergångsnorm

Om tullen tillåter att varor som ursprungligen deklarerats för ett visst förfarande hänförs till ett annat tullförfarande sedan tullar och skatter betalats, skall de debiterade tull- och skattebelopp som överstiger de som gäller för det nya förfarandet återbetalas.

4.21Norm

Beslut i fråga om ansökningar om återbetalning skall, utan oskäligt dröjsmål, fattas och skriftligt meddelas de berörda personerna, och överdebiterade belopp skall återbetalas snarast möjligt efter det att ansökningarna kontrollerats.

4.22Norm

Om tullen konstaterar att överdebiteringen beror på ett fel som begåtts av tullen vid bestämningen av tullar och skatter, skall återbetalningen ske med förtur.

4.23Norm

Om tidsgränser fastställs för mottagande av ansökningar om återbetalning, skall vid fastställandet av längden på fristen hänsyn tas till de olika omständigheter som kan råda i varje enskilt fall där återbetalning kan beviljas.

4.24Norm

Återbetalning skall inte beviljas om beloppet i fråga understiger det minimibelopp som anges i den nationella lagstiftningen.

Kapitel 5

Säkerhet

5.1Norm

I den nationella lagstiftningen skall det anges i vilka fall säkerhet skall krävas och i vilka former den skall ställas.

5.2Norm

Tullen skall fastställa säkerhetens belopp.

5.3Norm

En person som ställer säkerhet skall få välja i vilken form den ställs, förutsatt att formen är godtagbar för tullen.

5.4Norm

I enlighet med den nationella lagstiftningen skall tullen inte kräva säkerhet när den är övertygad om att en skyldighet mot tullen kommer att fullgöras.

5.5Norm

Om säkerhet skall ställas för att garantera att skyldigheterna till följd av ett tullförfarande fullgörs, skall tullen godta en gemensam säkerhet i synnerhet från deklaranter som regelbundet deklarerar varor vid olika kontor inom tullområdet.

5.6Norm

I de fall säkerhet skall ställas skall säkerhetens belopp sättas så lågt som möjligt och skall i fråga om betalning av tullar och skatter inte överstiga det belopp som kan komma att debiteras.

5.7Norm

I de fall säkerhet har ställts, skall den återlämnas snarast möjligt efter det att tullen har övertygats om att de skyldigheter för vilka säkerheten krävdes har fullgjorts.

Kapitel 6

Tullkontroll

6.1Norm

Alla varor, inklusive transportmedel, som förs in i eller ut ur tullområdet, oberoende av om tullar och skatter skall betalas för dem, skall omfattas av tullkontroll.

6.2Norm

Tullkontroll skall begränsas till det som är nödvändigt för att se till att tulllagstiftningen efterlevs.

6.3Norm

Tullen skall vid genomförandet av tullkontroll använda metoder för riskhantering.

6.4Norm

Tullen skall använda riskanalys vid bedömningen av vilka personer och varor, inklusive transportmedel, som bör undersökas och vilken omfattning undersökningen bör ha.

6.5Norm

Tullen skall till stöd för riskhanteringen införa en strategi för att mäta i hur hög grad tullagstiftningen efterlevs.

6.6Norm

System för tullkontroll skall inbegripa bokföringsbaserade kontroller.

Tullen skall sträva efter att samarbeta med andra tullförvaltningar och att ingå avtal om ömsesidigt administrativt bistånd för att förbättra tullkontrollen.

6.8Norm

Tullen skall sträva efter att samarbeta med handeln och att ingå samförståndsavtal för att förbättra tullkontrollen.

6.9Övergångsnorm

Tullen skall i största möjliga utsträckning använda informationsteknik och elektronisk handel för att förbättra tullkontrollen.

6.10Norm

Tullen skall, i syfte att säkra efterlevnad av lagar och författningar på tullområdet, utvärdera handlares affärssystem när dessa system inverkar på tullens verksamhet.

Kapitel 7

Användning av informationsteknik

7.1Norm

I de fall det är kostnadseffektivt och ändamålsenligt för tullen och handeln, skall tullen använda informationsteknik till stöd för sin verksamhet. Tullen skall ange villkoren för denna användning.

7.2Norm

Vid införande av datortillämpningar skall tullen använda relevanta, internationellt godkända standarder.

7.3Norm

Införandet av informationsteknik skall i största möjliga utsträckning ske i samråd med alla direkt berörda och relevanta parter.

7.4Norm

I ny eller ändrad nationell lagstiftning skall det införas bestämmelser om

– metoder inom ramen för den elektroniska handeln som ett alternativ till tillhandahållande av föreskrivna handlingar i pappersform,

– elektroniska och pappersbaserade metoder för bestyrkande,

– tullens rätt att behålla information för egen användning och att vid behov, genom teknik för elektronisk handel, utbyta denna information med andra tullförvaltningar samt alla andra rättsligt godtagna parter.

Kapitel 8

Förbindelser mellan tullen och tredje part

8.1Norm

Berörda personer skall kunna sköta sina affärsförbindelser med tullen antingen direkt eller genom att utse en tredje part att agera på deras vägnar.

8.2Norm

Den nationella lagstiftningen skall innehålla bestämmelser om på vilka villkor en person får agera för eller på någon annan persons vägnar vid förbindelser med tullen, och om tredje parts skyldighet gentemot tullen när det gäller tullar och skatter samt eventuella oegentligheter.

8.3Norm

De tulltransaktioner för vilka den berörda personen väljer att sköta affärerna för egen räkning skall inte behandlas mindre gynnsamt eller omfattas av strängare krav än de tulltransaktioner som för den berörda personens räkning sköts av en tredje part.

8.4Norm

En person som utsetts som tredje part skall, vid affärsförbindelser med tullen, ha samma rättigheter som den person som utsett honom.

8.5Norm

Tullen skall fastställa bestämmelser om tredje parts deltagande i dess formella samråd med handeln.

8.6Norm

Tullen skall ange de omständigheter under vilka den inte är beredd att ha affärsförbindelser med tredje part.

8.7Norm

Ett beslut av tullen om att inte ha affärsförbindelser med tredje part skall meddelas den tredje parten skriftligt.

Kapitel 9

Information från tullen och tullens beslut och utslag

A. Allmänt tillämplig information

9.1Norm

Tullen skall se till att all relevant och allmänt tillämplig information som avser tullagstiftning är lätt tillgänglig för alla berörda parter.

9.2Norm

I de fall information som gjorts tillgänglig måste ändras till följd av ändringar i tullagstiftningen eller av administrativa bestämmelser och krav, skall tullen göra den ändrade informationen lätt tillgänglig tillräckligt lång tid före

ändringens ikraftträdande för att berörda parter skall kunna beakta den, såvida inte information i förväg är utesluten.

9.3Övergångsnorm

Tullen skall använda informationsteknik för att förbättra tillhandahållandet av information.

B. Information i särskilda frågor

9.4Norm

På begäran av den berörda personen skall tullen så snabbt som möjligt tillhandahålla så exakt information som möjligt i särskilda frågor som väckts av den berörda personen och som avser tullagstiftning.

9.5Norm

Tullen skall tillhandahålla inte bara den information som särskilt begärts utan även annan relevant information som den anser att den berörda personen bör göras uppmärksam på.

9.6Norm

Vid tillhandahållande av information skall tullen sörja för att den inte avslöjar uppgifter av privat eller konfidentiell karaktär som rör tullen eller tredje part, såvida inte ett sådant utlämnande av uppgifter föreskrivs eller tillåts i den nationella lagstiftningen.

9.7Norm

När tullen inte kan tillhandahålla information gratis, skall avgifterna inte vara högre än den ungefärliga kostnaden för de utförda tjänsterna.

C. Beslut och utslag

9.8Norm

På skriftlig begäran av den berörda personen skall tullen meddela sitt beslut skriftligt inom den period som föreskrivs i den nationella lagstiftningen. Om beslutet är negativt för personen i fråga, skall skälen för beslutet anges och information ges om rätten till överklagande.

9.9Norm

Tullen skall på begäran av den berörda personen avkunna ett bindande utslag, förutsatt att tullen har all information som den bedömer som nödvändig.

Kapitel 10

Överklaganden i tullärenden

A. Rätt till överklagande

10.1Norm

Den nationella lagstiftningen skall innehålla bestämmelser om rätt till överklagande i tullärenden.

10.2Norm

Varje person som direkt berörs av ett beslut eller en försummelse av tullen skall ha rätt att överklaga.

10.3Norm

Den person som direkt berörs av ett beslut eller en försummelse av tullen skall, efter att ha lämnat en begäran till tullen, meddelas skälen för detta beslut eller anledningen till denna försummelse inom den period som föreskrivs i den nationella lagstiftningen. I vissa fall finns möjlighet till överklagande.

10.4Norm

Den nationella lagstiftningen skall innehålla bestämmelser om rätt till ett första överklagande hos tullen.

10.5Norm

I de fall ett överklagande hos tullen ogillas, skall den överklagande ha rätt att inge ett ytterligare överklagande hos en myndighet som är oberoende av tullförvaltningen.

10.6Norm

I sista instans skall den överklagande ha rätt att överklaga hos en rättslig myndighet.

B. Överklagandets form och dess grunder

10.7Norm

Ett överklagande skall inges skriftligt och skall innehålla grunderna för dess ingivande.

10.8Norm

En tidsgräns skall fastställas för ingivande av ett överklagande av ett beslut av tullen, och denna tidsgräns skall ge den överklagande tillräckligt lång tid att granska beslutet och utforma ett överklagande.

10.9Norm

Vid ingivande av ett överklagande hos tullen skall tullen inte som en självklar sak kräva att eventuella styrkande handlingar inges samtidigt som överklagandet, utan den skall när det är lämpligt medge en skälig frist för ingivande av dessa handlingar.

C. Behandling av överklaganden

10.10Norm

Tullen skall så snart som möjligt avkunna ett utslag om ett överklagande och skriftligt meddela den överklagande detta.

10.11Norm

I de fall ett överklagande hos tullen ogillas, skall tullen ange skälen därtill skriftligt och informera den överklagande om hans rätt att inge ett ytterligare

överklagande hos en administrativ eller oberoende myndighet samt om tidsgränsen för ingivande av detta överklagande.

10.12Norm

I de fall ett överklagande gillas, skall tullen så snart som möjligt verkställa sitt beslut eller den oberoende eller rättsliga myndighetens utslag, utom i de fall tullen överklagar utslaget.

The Contracting Parties to the International Convention on the simplification

th and harmonization of Customs procedures (done at Kyoto on 18 May 1973

th and entered into force on 25 September 1974), hereinafter ”the Convention”, established under the auspices of the Customs Co-operation Council, hereinafter ”the Council”,

considering that to achieve the aims of:

– eliminating divergence between the Customs procedures and practices of Contracting Parties that can hamper international trade and other international exchanges;

– meeting the needs of international trade and the Customs for facilitation, simplification and harmonization of Customs procedures and practices;

– ensuring appropriate standards of Customs control; and

– enabling the Customs to respond to major changes in business and administrative methods and techniques,

the Convention must be amended, considering also that the amended Convention:

– must provide that the core principles for such simplification and harmonization are made obligatory on Contracting Parties to the amended Convention;

– must provide the Customs with efficient procedures supported by appropriate and effective control methods; and

– will enable the achievement of a high degree of simplification and harmonization of Customs procedures and practices which is an essential aim of the Council, and thus make a major contribution to facilitation of international trade,

Have agreed as follows:

Article 1

The Preamble and the Articles of the Convention are amended as set out in the text contained in Appendix I hereto.

Article 2

The Annexes of the Convention are replaced by the General Annex contained in Appendix II and by the Specific Annexes contained in Appendix III hereto.

Article 3

Any Contracting Party to the Convention may express its consent to be bound by this Protocol, including Appendices I and II, by:

(a) signing it without reservation of ratification;

(b) depositing an instrument of ratification after signing it subject to ratification; or

(c) acceding to it.

This Protocol shall be open until 30 June 2000 for signature at the Headquarters of the Council in Brussels by the Contracting Parties to the Convention. Thereafter, it shall be open for accession.

This Protocol, including Appendices I and II, shall enter into force three months after forty Contracting Parties have signed this Protocol without reservation of ratification or have deposited their instrument of ratification or accession.

4. After forty Contracting Parties have expressed their consent to be bound by this Protocol in accordance with paragraph 1, a Contracting Party to the Convention shall accept the amendments to the Convention only by becoming a party to this Protocol. For such a Contracting Party, this Protocol shall come into force three months after it signs this Protocol without reservation of ratification or deposits an instrument of ratification or accession.

Article 4

Any Contracting Party to the Convention may, when it expresses its consent to be bound by this Protocol, accept any of the Specific Annexes or Chapters therein contained in Appendix III hereto and shall notify the Secretary General of the Council of such acceptance and of the Recommended Practices in respect of which it enters reservations.

Article 5

After the entry into force of this Protocol, the Secretary General of the Council shall not accept any instrument of ratification or accession to the Convention.

Article 6

In relations between the Parties hereto, this Protocol with its Appendices shall supersede the Convention.

Article 7

The Secretary General of the Council shall be the depositary of this Protocol and shall perform the functions as provided for in Article 19 contained in Appendix I to this Protocol.

Article 8

This Protocol shall be open for signature by the Contracting Parties to the

th Convention at the Headquarters of the Council in Brussels from 26 June 1999.

Article 9

In accordance with Article 102 of the Charter of the United Nations, this Protocol and its Appendices shall be registered with the Secretariat of the United Nations at the request of the Secretary General of the Council.

Appendix I

International convention on the simplification and harmoniation of customs procedures

Preamble

The Contracting Parties to the present Convention established under the auspices of the Customs Co-operation Council,

Eneeavouring to eliminate divergence between the Customs procedures and practices of Contracting Parties that can hamper international trade and other international exchanges,

Desiring to contribute effectively to the development of such trade and exchanges by simplifying and harmonizing Customs procedures and practices and by fostering international co-operation,

Noting that the significant benefits of facilitation of international trade may be achieved without compromising appropriate standards of Customs control,

Recognizing that such simplification and harmonization can be accomplished by applying, in particular, the following principles:

• the implementation of programmes aimed at continuously modernizing Customs procedures and practices and thus enhancing efficiency and effectiveness,

• the application of Customs procedures and practices in a predictable, consistent and transparent manner,

• the provision to interested parties of all the necessary information regarding Customs laws, regulations, administrative guidelines, procedures and practices,

• the adoption of modern techniques such as risk management and auditbased controls, and the maximum practicable use of information technology,

• co-operation wherever appropriate with other national authorities, other Customs administrations and the trading communities,

• the implementation of relevant international standards,

• the provision to affected parties of easily accessible processes of administrative and judicial review,

Convinced that an international instrument incorporating the above objectives and principles that Contracting Parties undertake to apply would lead to the high degree of simplification and harmonization of Customs procedures and practices which is an essential aim of the Customs Co-operation Council, and so make a major contribution to facilitation of international trade,

Have agreed as follows:

Chapter I

Definitions

Article 1

For the purposes of this Convention:

(a) “Standard” means a provision the implementation of which is recog-

nized as necessary for the achievement of harmonization and simplification of Customs procedures and practices;

(b) “Transitional Standard” means a Standard in the General Annex for which a longer period for implementation is permitted;

(c) “Recommended Practice” means a provision in a Specific Annex which is recognized as constituting progress towards the harmonization and the simplification of Customs procedures and practices, the widest possible application of which is considered to be desirable;

(d) “National legislation” means laws, regulations and other measures imposed by a competent authority of a Contracting Party and applicable throughout the territory of the Contracting Party concerned, or treaties in force by which that Party is bound;

(e) “General Annex” means the set of provisions applicable to all the Customs procedures and practices referred to in this Convention;

(f) “Specific Annex” means a set of provisions applicable to one or more Customs procedures and practices referred to in this Convention;

(g) “Guidelines” means a set of explanations of the provisions of the General Annex, Specific Annexes and Chapters therein which indicate some of the possible courses of action to be followed in applying the Standards, Transitional Standards and Recommended Practices, and in particular describing best practices and recommending examples of greater facilities;

(h) “Permanent Technical Committee” means the Permanent Technical Committee of the Council;

(ij) “Council” means the Organization set up by the Convention establishing a Customs Co-operation Council, done at Brussels on 15 December 1950;

(k) “Customs or Economic Union” means a Union constituted by, and composed of, States which has competence to adopt its own regulations that are binding on those States in respect of matters governed by this Convention, and has competence to decide, in accordance with its internal procedures, to sign, ratify or accede to this Convention.

Chapter II

Scope and structure

Scope of the Convention

Article 2

Each Contracting Party undertakes to promote the simplification and harmonization of Customs procedures and, to that end, to conform, in accordance with the provisions of this Convention, to the Standards, Transitional Standards and Recommended Practices in the Annexes to this Convention. However, nothing shall prevent a Contracting Party from granting facilities greater than those provided for therein, and each Contracting Party is recommended to grant such greater facilities as extensively as possible.

Article 3

The provisions of this Convention shall not preclude the application of national legislation with regard to either prohibitions or restrictions on goods which are subject to Customs control.

Structure of the Convention

Article 4

1. The Convention comprises a Body, a General Annex and Specific Annexes.

2. The General Annex and each Specific Annex to this Convention consist, in principle, of Chapters which subdivide an Annex and comprise:

(a) definitions; and

(b) Standards, some of which in the General Annex are Transitional Standards.

3. Each Specific Annex also contains Recommended Practices.

4. Each Annex is accompanied by Guidelines, the texts of which are not binding upon Contracting Parties.

Article 5

For the purposes of this Convention, any Specific Annex(es) or Chapter(s) therein to which a Contracting Party is bound shall be construed to be an integral part of the Convention, and in relation to that Contracting Party any reference to the Convention shall be deemed to include a reference to such Annex(es) or Chapter(s).

Chapter III

Management of the Convention

Management Committee

Article 6

1. There shall be established a Management Committee to consider the implementation of this Convention, any measures to secure uniformity in the interpretation and application thereof, and any amendments proposed thereto.

2. The Contracting Parties shall be members of the Management Committee.

3. The competent administration of any entity qualified to become a Contracting Party to this Convention under the provisions of Article 8 or of any Member of the World Trade Organization shall be entitled to attend the sessions of the Management Committee as an observer. The status and rights of such Observers shall be determined by a Council Decision. The aforementioned rights cannot be exercised before the entry into force of the Decision.

4. The Management Committee may invite the representatives of international governmental and non-governmental organizations to attend the sessions of the Management Committee as observers.

5. The Management Committee: (a) shall recommend to the Contracting Parties: (i) amendments to the Body of this Convention;

(ii) amendments to the General Annex, the Specific Annexes and Chapters therein and the incorporation of new Chapters to the General Annex; and

(iii) the incorporation of new Specific Annexes and new Chapters to Specific Annexes;

(b) may decide to amend Recommended Practices or to incorporate new

Recommended Practices to Specific Annexes or Chapters therein in accordance with Article 16;

(c) shall consider implementation of the provisions of this Convention in accordance with Article 13, paragraph 4;

(d) shall review and update the Guidelines; (e) shall consider any other issues of relevance to this Convention that may

be referred to it;

(f) shall inform the Permanent Technical Committee and the Council of its decisions.

6. The competent administrations of the Contracting Parties shall communicate to the Secretary General of the Council proposals under paragraph 5 (a), (b), (c) or (d) of this Article and the reasons therefor, together with any requests for the inclusion of items on the Agenda of the sessions of the Management Committee. The Secretary General of the Council shall bring proposals to the attention of the competent administrations of the Contracting Parties and of the observers referred to in paragraphs 2, 3 and 4 of this Article.

7. The Management Committee shall meet at least once each year. It shall annually elect a Chairman and Vice-Chairman. The Secretary General of the Council shall circulate the invitation and the draft Agenda to the competent administrations of the Contracting Parties and to the observers referred to in paragraphs 2, 3 and 4 of this Article at least six weeks before the Management Committee meets.

8. Where a decision cannot be arrived at by consensus, matters before the Management Committee shall be decided by voting of the Contracting Parties present. Proposals under paragraph 5 (a), (b) or (c) of this Article shall be approved by a two-thirds majority of the votes cast. All other matters shall be decided by the Management Committee by a majority of the votes cast.

9. Where Article 8, paragraph 5 of this Convention applies, the Customs or Economic Unions which are Contracting Parties shall have, in case of voting, only a number of votes equal to the total votes allotted to their Members which are Contracting Parties.

10. Before the closure of its session, the Management Committee shall adopt a report. This report shall be transmitted to the Council and to the Contracting Parties and observers mentioned in paragraphs 2, 3 and 4.

11. In the absence of relevant provisions in this Article, the Rules of Procedure of the Council shall be applicable, unless the Management Committee decides otherwise.

Article 7

For the purpose of voting in the Management Committee, there shall be separate voting on each Specific Annex and each Chapter of a Specific Annex.

(a) Each Contracting Party shall be entitled to vote on matters relating to the interpretation, application or amendment of the Body and General Annex of the Convention.

(b) As regards matters concerning a Specific Annex or Chapter of a Specific Annex that is already in force, only those Contracting Parties that have accepted that Specific Annex or Chapter therein shall have the right to vote.

(c) Each Contracting Party shall be entitled to vote on drafts of new Specific Annexes or new Chapters of a Specific Annex.

Chapter IV

Contracting Party

Ratification of the Convention

Article 8

1. Any Member of the Council and any Member of the United Nations or its specialized agencies may become a Contracting Party to this Convention:

(a) by signing it without reservation of ratification;

(b) by depositing an instrument of ratification after signing it subject to ratification; or

(c) by acceding to it.

2. This Convention shall be open until 30th June 1974 for signature at the Headquarters of the Council in Brussels by the Members referred to in paragraph 1 of this Article. Thereafter, it shall be open for accession by such Members.

3. Any Contracting Party shall, at the time of signing, ratifying or acceding to this Convention, specify which if any of the Specific Annexes or Chapters therein it accepts. It may subsequently notify the depositary that it accepts one or more Specific Annexes or Chapters therein.

4. Contracting Parties accepting any new Specific Annex or any new Chapter of a Specific Annex shall notify the depositary in accordance with paragraph 3 of this Article.

5. (a) Any Customs or Economic Union may become, in accordance with paragraphs 1, 2 and 3 of this Article, a Contracting Party to this Convention. Such Customs or Economic Union shall inform the depositary of its competence with respect to the matters governed by this Convention. Such Customs or Economic Union shall also inform the depositary of any substantial modification in the extent of its competence.

(b) A Customs or Economic Union which is a Contracting Party to this Convention shall, for the matters within its competence, exercise in its own name the rights, and fulfil the responsibilities, which the Convention confers on the Members of such a Union which are Contracting Parties to this Convention. In such a case, the Members of such a Union shall not be entitled to individually exercise these rights, including the right to vote.

Article 9

1. Any Contracting Party which ratifies this Convention or accedes thereto shall be bound by any amendments to this Convention, including the General Annex, which have entered into force at the date of deposit of its instrument of ratification or accession.

2. Any Contracting Party which accepts a Specific Annex or Chapter therein shall be bound by any amendments to the Standards contained in that Specific Annex or Chapter which have entered into force at the date on which it notifies its acceptance to the depositary. Any Contracting Party which accepts a Specific Annex or Chapter therein shall be bound by any amendments to the Recommended Practices contained therein, which have entered into force at the date on which it notifies its acceptance to the depositary, unless it enters reservations against one or more of those Recommended Practices in accordance with Article 12 of this Convention.

Application of the Convention

Article 10

1. Any Contracting Party may, at the time of signing this Convention without reservation of ratification or of depositing its instrument of ratification or accession, or at any time thereafter, declare by notification given to the depositary that this Convention shall extend to all or any of the territories for whose international relations it is responsible. Such notification shall take effect three months after the date of the receipt thereof by the depositary. However, this Convention shall not apply to the territories named in the notification before this Convention has entered into force for the Contracting Party concerned.

2. Any Contracting Party which has made a notification under paragraph 1 of this Article extending this Convention to any territory for whose international relations it is responsible may notify the depositary, under the procedure of Article 19 of this Convention, that the territory in question will no longer apply this Convention.

Article 11

For the application of this Convention, a Customs or Economic Union that is a Contracting Party shall notify to the Secretary General of the Council the territories which form the Customs or Economic Union, and these territories are to be taken as a single territory.

Acceptance of the provisions and reservations

Article 12

1. All Contracting Parties are hereby bound by the General Annex. 2. A Contracting Party may accept one or more of the Specific Annexes or

one or more of the Chapters therein. A Contracting Party which accepts a Specific Annex or Chapter(s) therein shall be bound by all the Standards therein. A Contracting Party which accepts a Specific Annex or Chapter(s) therein shall be bound by all the Recommended Practices therein unless, at the time of acceptance or at any time thereafter, it notifies the depositary of the Recommended Practice(s) in respect of which it enters reservations, stating the differences existing between the provisions of its national legislation and those of the Recommended Practice(s) concerned. Any Contracting Party which has entered reservations may withdraw them, in whole or in part, at any time by notification to the depositary specifying the date on which such withdrawal takes effect.

3. Each Contracting Party bound by a Specific Annex or Chapter(s) therein shall examine the possibility of withdrawing any reservations to the Recommended Practices entered under the terms of paragraph 2 and notify the Secretary General of the Council of the results of that review at the end of every three-year period commencing from the date of the entry into force of this Convention for that Contracting Party, specifying the provisions of its national legislation which, in its opinion, are contrary to the withdrawal of the reservations.

Implementation of the provisions

Article 13

1. Each Contracting Party shall implement the Standards in the General Annex and in the Specific Annex(es) or Chapter(s) therein that it has accepted within 36 months after such Annex(es) or Chapter(s) have entered into force for that Contracting Party.

2. Each Contracting Party shall implement the Transitional Standards in the General Annex within 60 months of the date that the General Annex has entered into force for that Contracting Party.

3. Each Contracting Party shall implement the Recommended Practices in the Specific Annex(es) or Chapter(s) therein that it has accepted within 36 months after such Specific Annex(es) or Chapter(s) have entered into force for that Contracting Party, unless reservations have been entered as to one or more of those Recommended Practices.

4. (a) Where the periods provided for in paragraph 1 or 2 of this Article would, in practice, be insufficient for any Contracting Party to implement the provisions of the General Annex, that Contracting Party may request the Management Committee, before the end of the period referred to in paragraph 1 or 2 of this Article, to provide an extension of that period. In making the request, the Contracting Party shall state the provision(s) of the General Annex with regard to which an extension of the period is required and the reasons for such request.

(b) In exceptional circumstances, the Management Committee may decide to grant such an extension. Any decision by the Management Committee granting such an extension shall state the exceptional circumstances justifying the decision and the extension shall in no case be more than one year. At the expiry of the period of extension, the Contracting Party shall notify the depositary of the implementation of the provisions with regard to which the extension was granted.

Settlement of disputes

Article 14

1. Any dispute between two or more Contracting Parties concerning the interpretation or application of this Convention shall so far as possible be settled by negotiation between them.

2. Any dispute which is not settled by negotiation shall be referred by the Contracting Parties in dispute to the Management Committee which shall thereupon consider the dispute and make recommendations for its settlement.

3. The Contracting Parties in dispute may agree in advance to accept the recommendations of the Management Committee as binding.

Amendments to the Convention

Article 15

1. The text of any amendment recommended to the Contracting Parties by the Management Committee in accordance with Article 6, paragraph 5 (a) (i) and (ii) shall be communicated by the Secretary General of the Council to all Contracting Parties and to those Members of the Council that are not Contracting Parties.

2. Amendments to the Body of the Convention shall enter into force for all Contracting Parties twelve months after deposit of the instruments of acceptance by those Contracting Parties present at the session of the Management Committee during which the amendments were recommended, provided that no objection is lodged by any of the Contracting Parties within a period of twelve months from the date of communication of such amendments.

3. Any recommended amendment to the General Annex or the Specific Annexes or Chapters therein shall be deemed to have been accepted six months after the date the recommended amendment was communicated to Contracting Parties, unless:

(a) there has been an objection by a Contracting Party or, in the case of a Specific Annex or Chapter, by a Contracting Party bound by that Specific Annex or Chapter; or

(b) a Contracting Party informs the Secretary General of the Council that, although it intends to accept the recommended amendment, the conditions necessary for such acceptance are not yet fulfilled.

4. If a Contracting Party sends the Secretary General of the Council a communication as provided for in paragraph 3 (b) of this Article, it may, so long as it has not notified the Secretary General of the Council of its acceptance of the recommended amendment, submit an objection to that amendment within a period of eighteen months following the expiry of the six-month period referred to in paragraph 3 of this Article.

5. If an objection to the recommended amendment is notified in accordance with the terms of paragraph 3 (a) or 4 of this Article, the amendment shall be deemed not to have been accepted and shall be of no effect.

6. If any Contracting Party has sent a communication in accordance with paragraph 3 (b) of this Article, the amendment shall be deemed to have been accepted on the earlier of the following two dates:

(a) the date by which all the Contracting Parties which sent such communications have notified the Secretary General of the Council of their acceptance of the recommended amendment, provided that, if all the acceptances were notified before the expiry of the period of six months referred to in paragraph 3 of this Article, that date shall be taken to be the date of expiry of the said six-month period;

(b) the date of expiry of the eighteen-month period referred to in paragraph 4 of this Article.

7. Any amendment to the General Annex or the Specific Annexes or Chapters therein deemed to be accepted shall enter into force either six months after the date on which it was deemed to be accepted or, if a different period is specified in the recommended amendment, on the expiry of that period after the date on which the amendment was deemed to be accepted.

8. The Secretary General of the Council shall, as soon as possible, notify the Contracting Parties to this Convention of any objection to the recommended amendment made in accordance with paragraph 3 (a), and of any communication received in accordance with paragraph 3 (b), of this Article. The Secretary General of the Council shall subsequently inform the Contracting Parties whether the Contracting Party or Parties which have sent such a communication raise an objection to the recommended amendment or accept it.

Article 16

1. Notwithstanding the amendment procedure laid down in Article 15 of this Convention, the Management Committee in accordance with Article 6 may decide to amend any Recommended Practice or to incorporate new Recommended Practices to any Specific Annex or Chapter therein. Each Contracting Party shall be invited by the Secretary General of the Council to participate in the deliberations of the Management Committee. The text of any such amendment or new Recommended Practice so decided upon shall be communicated by the Secretary General of the Council to the Contracting Parties and those Members of the Council that are not Contracting Parties to this Convention.

2. Any amendment or incorporation of new Recommended Practices decided upon under paragraph 1 of this Article shall enter into force six months after their communication by the Secretary General of the Council. Each Contracting Party bound by a Specific Annex or Chapter therein forming the subject of such amendments or incorporation of new Recommended Practices shall be deemed to have accepted those amendments or new Recommended Practices unless it enters a reservation under the procedure of Article 12 of this Convention.

Duration of accession

Article 17

1. This Convention is of unlimited duration but any Contracting Party may denounce it at any time after the date of its entry into force under Article 18 thereof.

2. The denunciation shall be notified by an instrument in writing, deposited with the depositary.

3. The denunciation shall take effect six months after the receipt of the instrument of denunciation by the depositary.

4. The provisions of paragraphs 2 and 3 of this Article shall also apply in respect of the Specific Annexes or Chapters therein, for which any Contracting Party may withdraw its acceptance at any time after the date of the entry into force.

5. Any Contracting Party which withdraws its acceptance of the General Annex shall be deemed to have denounced the Convention. In this case, the provisions of paragraphs 2 and 3 also apply.

Chapter V

Final provisions

Entry into force of the Convention

Article 18

1. This Convention shall enter into force three months after five of the entities referred to in paragraphs 1 and 5 of Article 8 thereof have signed the Convention without reservation of ratification or have deposited their instruments of ratification or accession.

2. This Convention shall enter into force for any Contracting Party three

months after it has become a Contracting Party in accordance with the provisions of Article 8.

3. Any Specific Annex or Chapter therein to this Convention shall enter into force three months after five Contracting Parties have accepted that Specific Annex or that Chapter.

4. After any Specific Annex or Chapter therein has entered into force in accordance with paragraph 3 of this Article, that Specific Annex or Chapter therein shall enter into force for any Contracting Party three months after it has notified its acceptance. No Specific Annex or Chapter therein shall, however, enter into force for a Contracting Party before this Convention has entered into force for that Contracting Party.

Depositary of the Convention

Article 19

1. This Convention, all signatures with or without reservation of ratification and all instruments of ratification or accession shall be deposited with the Secretary General of the Council.

2. The depositary shall: (a) receive and keep custody of the original texts of this Convention; (b) prepare certified copies of the original texts of this Convention and

transmit them to the Contracting Parties and those Members of the Council that are not Contracting Parties and the Secretary General of the United Nations;

(c) receive any signature with or without reservation of ratification, ratification or accession to this Convention and receive and keep custody of any instruments, notifications and communications relating to it;

(d) examine whether the signature or any instrument, notification or communication relating to this Convention is in due and proper form and, if need be, bring the matter to the attention of the Contracting Party in question;

(e) notify the Contracting Parties, those Members of the Council that are not Contracting Parties, and the Secretary General of the United Nations of:

– signatures, ratifications, accessions and acceptances of Annexes and Chapters under Article 8 of this Convention;

– new Chapters of the General Annex and new Specific Annexes or Chapters therein which the Management Committee decides to recommend to incorporate in this Convention;

– the date of entry into force of this Convention, of the General Annex and of each Specific Annex or Chapter therein in accordance with Article 18 of this Convention;

– notifications received in accordance with Articles 8, 10, 11,12 and 13 of this Convention;

– withdrawals of acceptances of Annexes/Chapters by Contracting Parties; – denunciations under Article 17 of this Convention; and – any amendment accepted in accordance with Article 15 of this Con-

vention and the date of its entry into force.

3. In the event of any difference appearing between a Contracting Party and the depositary as to the performance of the latter’s functions, the depositary or that Contracting Party shall bring the question to the attention of the

other Contracting Parties and the signatories or, as the case may be, the Management Committee or the Council.

Registration and authentic texts

Article 20

In accordance with Article 102 of the Charter of the United Nations, this Convention shall be registered with the Secretariat of the United Nations at the request of the Secretary General of the Council.

In witness whereof the undersigned, being duly authorized thereto, have signed this Convention.

Done at Kyoto, this eighteenth day of May nineteen hundred and seventythree in the English and French languages, both texts being equally authentic, in a single original which shall be deposited with the Secretary General of the Council who shall transmit certified copies to all the entities referred to in paragraph 1 of Article 8 of this Convention.

Chapter 1

General principles

1.1Standard

The Definitions, Standards and Transitional Standards in this Annex shall apply to Customs procedures and practices specified in this Annex and, insofar as applicable, to procedures and practices in the Specific Annexes.

1.2Standard

The conditions to be fulfilled and Customs formalities to be accomplished for procedures and practices in this Annex and in the Specific Annexes shall be specified in national legislation and shall be as simple as possible.

1.3Standard

The Customs shall institute and maintain formal consultative relationships with the trade to increase co-operation and facilitate participation in establishing the most effective methods of working commensurate with national provisions and international agreements.

Chapter 2

Definitions

For the purposes of the Annexes to this Convention: E1./ “appeal” means the act by which a person who is directly affected by F23. a decision or omission of the Customs and who considers himself to be

aggrieved thereby seeks redress before a competent authority; E2./ “assessment of duties and taxes” means the determination of the F19. amount of duties and taxes payable; E3./ “audit-based control” means measures by which the Customs satisfy F4. themselves as to the accuracy and authenticity of declarations through

the examination of the relevant books, records, business systems and

commercial data held by persons concerned; E4./ “checking the Goods declaration” means the action taken by the Cus- F15. toms to satisfy themselves that the Goods declaration is correctly made

out and that the supporting documents required fulfil the prescribed

conditions; E5./ “clearance” means the accomplishment of the Customs formalities F9. necessary to allow goods to enter home use, to be exported or to be

placed under another Customs procedure; E6./ “Customs” means the Government Service which is responsible for F10. the administration of Customs law and the collection of duties and

taxes and which also has the responsibility for the application of other

laws and regulations relating to the importation, exportation, move-

ment or storage of goods; E7./ “Customs control” means measures applied by the Customs to ensure F3. compliance with Customs law; E8./ “Customs duties” means the duties laid down in the Customs tariff to F11. which goods are liable on entering or leaving the Customs territory;

portation of goods, but not including any charges which are limited in amount to the approximate cost of services rendered or collected by the Customs on behalf of another national authority;

E19./ “Goods declaration” means a statement made in the manner pre- F8. scribed by the Customs, by which the persons concerned indicate the

Customs procedure to be applied to the goods and furnish the particulars which the Customs require for its application;

E20./ “import duties and taxes” means Customs duties and all other duties, F14. taxes or charges which are collected on or in connection with the im-

portation of goods, but not including any charges which are limited in amount to the approximate cost of services rendered or collected by the Customs on behalf of another national authority;

E21./ “mutual administrative assistance” means actions of a Customs F1. administration on behalf of or in collaboration with another Customs

administration for the proper application of Customs law and for the prevention, investigation and repression of Customs offences;

E22./ “omission” means the failure to act or give a decision required of the F21. Customs by Customs law within a reasonable time on a matter duly

submitted to them; E23./ “person” means both natural and legal persons, unless the context F22. otherwise requires; E24./ “release of goods” means the action by the Customs to permit goods F20. undergoing clearance to be placed at the disposal of the persons

concerned;

E25./ “repayment” means the refund, in whole or in part, of duties and F24. taxes paid on goods and the remission, in whole or in part, of duties

and taxes where payment has not been made; E26./ “security” means that which ensures to the satisfaction of the Customs F17. that an obligation to the Customs will be fulfilled. Security is described

as “general” when it ensures that the obligations arising from several operations will be fulfilled;

E27./ “third party” means any person who deals directly with the Customs, F26. for and on behalf of another person, relating to the importation, ex-

portation, movement or storage of goods.

Chapter 3

Clearance and other customs formalities

Competent Customs offices

3.1Standard

The Customs shall designate the Customs offices at which goods may be produced or cleared. In determining the competence and location of these offices and their hours of business, the factors to be taken into account shall include in particular the requirements of the trade.

3.2Standard

At the request of the person concerned and for reasons deemed valid by the Customs, the latter shall, subject to the availability of resources, perform the functions laid down for the purposes of a Customs procedure and practice outside the designated hours of business or away from Customs offices. Any expenses chargeable by the Customs shall be limited to the approximate cost of the services rendered.

3.3Standard

Where Customs offices are located at a common border crossing, the Customs administrations concerned shall correlate the business hours and the competence of those offices.

3.4Transitional Standard

At common border crossings, the Customs administrations concerned shall, whenever possible, operate joint controls.

3.5Transitional Standard

Where the Customs intend to establish a new Customs office or to convert an existing one at a common border crossing, they shall, wherever possible, co-operate with the neighbouring Customs to establish a juxtaposed Customs office to facilitate joint controls.

The declarant

a) Persons entitled to act as declarant 3.6. Standard

National legislation shall specify the conditions under which a person is entitled to act as declarant.

3.7Standard

Any person having the right to dispose of the goods shall be entitled to act as declarant.

b) Responsibilities of the declarant 3.8. Standard

The declarant shall be held responsible to the Customs for the accuracy of the particulars given in the Goods declaration and the payment of the duties and taxes.

c) Rights of the declarant 3.9. Standard

Before lodging the Goods declaration the declarant shall be allowed, under such conditions as may be laid down by the Customs:

(a) to inspect the goods; and

(b) to draw samples.

3.10Standard

The Customs shall not require a separate Goods declaration in respect of samples allowed to be drawn under Customs supervision, provided that such samples are included in the Goods declaration concerning the relevant consignment.

The Goods declaration

a) Goods declaration format and contents 3.11. Standard

The contents of the Goods declaration shall be prescribed by the Customs. The paper format of the Goods declaration shall conform to the UN-layout key.

For automated Customs clearance processes, the format of the electronically lodged Goods declaration shall be based on international standards for electronic information exchange as prescribed in the Customs Co-operation Council Recommendations on information technology.

3.12Standard

The Customs shall limit the data required in the Goods declaration to only such particulars as are deemed necessary for the assessment and collection of duties and taxes, the compilation of statistics and the application of Customs law.

3.13Standard

Where, for reasons deemed valid by the Customs, the declarant does not

have all the information required to make the Goods declaration, a provisional or incomplete Goods declaration shall be allowed to be lodged, provided that it contains the particulars deemed necessary by the Customs and that the declarant undertakes to complete it within a specified period.

3.14Standard

If the Customs register a provisional or incomplete Goods declaration, the tariff treatment to be accorded to the goods shall not be different from that which would have been accorded had a complete and correct Goods declaration been lodged in the first instance.

The release of the goods shall not be delayed provided that any security required has been furnished to ensure collection of any applicable duties and taxes.

3.15Standard

The Customs shall require the lodgement of the original Goods declaration and only the minimum number of copies necessary.

b) Documents supporting the Goods declaration 3.16. Standard

In support of the Goods declaration the Customs shall require only those documents necessary to permit control of the operation and to ensure that all requirements relating to the application of Customs law have been complied with.

3.17Standard

Where certain supporting documents cannot be lodged with the Goods declaration for reasons deemed valid by the Customs, they shall allow production of those documents within a specified period.

3.18Transitional Standard

The Customs shall permit the lodgement of supporting documents by electronic means.

3.19Standard

The Customs shall not require a translation of the particulars of supporting documents except when necessary to permit processing of the Goods declaration.

Lodgement, registration and checking of the Goods declaration

3.20Standard

The Customs shall permit the lodging of the Goods declaration at any designated Customs office.

3.21Transitional Standard

The Customs shall permit the lodging of the Goods declaration by electronic means.

3.22Standard

The Goods declaration shall be lodged during the hours designated by the Customs.

3.23Standard

Where national legislation lays down a time limit for lodging the Goods declaration, the time allowed shall be sufficient to enable the declarant to complete the Goods declaration and to obtain the supporting documents required.

3.24Standard

At the request of the declarant and for reasons deemed valid by the Customs, the latter shall extend the time limit prescribed for lodging the Goods declaration.

3.25Standard

National legislation shall make provision for the lodging and registering or checking of the Goods declaration and supporting documents prior to the arrival of the goods.

3.26Standard

When the Customs cannot register the Goods declaration, they shall state the reasons to the declarant.

3.27Standard

The Customs shall permit the declarant to amend the Goods declaration that has already been lodged, provided that when the request is received they have not begun to check the Goods declaration or to examine the goods.

3.28Transitional Standard

The Customs shall permit the declarant to amend the Goods declaration if a request is received after checking of the Goods declaration has commenced, if the reasons given by the declarant are deemed valid by the Customs.

3.29Transitional Standard

The declarant shall be allowed to withdraw the Goods declaration and apply for another Customs procedure, provided that the request to do so is made to the Customs before the goods have been released and that the reasons are deemed valid by the Customs.

3.30Standard

Checking the Goods declaration shall be effected at the same time or as soon as possible after the Goods declaration is registered.

3.31Standard

For the purpose of checking the Goods declaration, the Customs shall take only such action as they deem essential to ensure compliance with Customs law.

Special procedures for authorized persons

3.32Transitional Standard

For authorized persons who meet criteria specified by the Customs, including having an appropriate record of compliance with Customs require-

ments and a satisfactory system for managing their commercial records, the Customs shall provide for:

– release of the goods on the provision of the minimum information necessary to identify the goods and permit the subsequent completion of the final Goods declaration;

– clearance of the goods at the declarant’s premises or another place authorized by the Customs;

and, in addition, to the extent possible, other special procedures such as: – allowing a single Goods declaration for all imports or exports in a given

period where goods are imported or exported frequently by the same person;

– use of the authorized persons’ commercial records to self-assess their duty and tax liability and, where appropriate, to ensure compliance with other Customs requirements;

– allowing the lodgement of the Goods declaration by means of an entry in the records of the authorized person to be supported subsequently by a supplementary Goods declaration.

Examination of the goods

a) Time required for examination of goods 3.33. Standard

When the Customs decide that goods declared shall be examined, this examination shall take place as soon as possible after the Goods declaration has been registered.

3.34Standard

When scheduling examinations, priority shall be given to the examination of live animals and perishable goods and to other goods which the Customs accept are urgently required.

3.35Transitional Standard

If the goods must be inspected by other competent authorities and the Customs also schedules an examination, the Customs shall ensure that the inspections are co-ordinated and, if possible, carried out at the same time.

b) Presence of the declarant at examination of goods 3.36. Standard

The Customs shall consider requests by the declarant to be present or to be represented at the examination of the goods. Such requests shall be granted unless exceptional circumstances exist.

3.37Standard

If the Customs deem it useful, they shall require the declarant to be present or to be represented at the examination of the goods to give them any assistance necessary to facilitate the examination.

c) Sampling by the Customs 3.38. Standard

Samples shall be taken only where deemed necessary by the Customs to

establish the tariff description and/or value of goods declared or to ensure the application of other provisions of national legislation. Samples drawn shall be as small as possible.

Errors

3.39Standard

The Customs shall not impose substantial penalties for errors where they are satisfied that such errors are inadvertent and that there has been no fraudulent intent or gross negligence. Where they consider it necessary to discourage a repetition of such errors, a penalty may be imposed but shall be no greater than is necessary for this purpose.

Release of goods

3.40Standard

Goods declared shall be released as soon as the Customs have examined them or decided not to examine them, provided that:

– no offence has been found; – the import or export licence or any other documents required have been

acquired;

– all permits relating to the procedure concerned have been acquired; and – any duties and taxes have been paid or that appropriate action has been

taken to ensure their collection.

3.41Standard

If the Customs are satisfied that the declarant will subsequently accomplish all the formalities in respect of clearance they shall release the goods, provided that the declarant produces a commercial or official document giving the main particulars of the consignment concerned and acceptable to the Customs, and that security, where required, has been furnished to ensure collection of any applicable duties and taxes.

3.42Standard

When the Customs decide that they require laboratory analysis of samples, detailed technical documents or expert advice, they shall release the goods before the results of such examination are known, provided that any security required has been furnished and provided they are satisfied that the goods are not subject to prohibitions or restrictions.

3.43Standard

When an offence has been detected, the Customs shall not wait for the completion of administrative or legal action before they release the goods, provided that the goods are not liable to confiscation or forfeiture or to be needed as evidence at some later stage and that the declarant pays the duties and taxes and furnishes security to ensure collection of any additional duties and taxes and of any penalties which may be imposed.

Abandonment or destruction of goods

3.44Standard

When goods have not yet been released for home use or when they have been placed under another Customs procedure, and provided that no offence has been detected, the person concerned shall not be required to pay the duties and taxes or shall be entitled to repayment thereof:

– when, at his request, such goods are abandoned to the Revenue or destroyed or

– rendered commercially valueless under Customs control, as the Customs may decide. Any costs involved shall be borne by the person concerned;

– when such goods are destroyed or irrecoverably lost by accident or force majeure, provided that such destruction or loss is duly established to the satisfaction of the Customs;

– on shortages due to the nature of the goods when such shortages are duly established to the satisfaction of the Customs.

Any waste or scrap remaining after destruction shall be liable, if taken into home use or exported, to the duties and taxes that would be applicable to such waste or scrap imported or exported in that state.

3.45Transitional Standard

When the Customs sell goods which have not been declared within the time allowed or could not be released although no offence has been discovered, the proceeds of the sale, after deduction of any duties and taxes and all other charges and expenses incurred, shall be made over to those persons entitled to receive them or, when this is not possible, held at their disposal for a specified period.

Chapter 4

Duties and taxes

A. Assessment, collection and payment of duties and taxes

4.1Standard

National legislation shall define the circumstances when liability to duties and taxes is incurred.

4.2Standard

The time period within which the applicable duties and taxes are assessed shall be stipulated in national legislation. The assessment shall follow as soon as possible after the Goods declaration is lodged or the liability is otherwise incurred.

4.3Standard

The factors on which the assessment of duties and taxes is based and the conditions under which they are determined shall be specified in national legislation.

4.4Standard

The rates of duties and taxes shall be set out in official publications.

4.5Standard

National legislation shall specify the point in time to be taken into consideration for the purpose of determining the rates of duties and taxes.

4.6Standard

National legislation shall specify the methods that may be used to pay the duties and taxes.

4.7Standard

National legislation shall specify the person(s) responsible for the payment of duties and taxes.

4.8Standard

National legislation shall determine the due date and the place where payment is to be made.

4.9Standard

When national legislation specifies that the due date may be after the release of the goods, that date shall be at least ten days after the release. No interest shall be charged for the period between the date of release and the due date.

4.10Standard

National legislation shall specify the period within which the Customs may take legal action to collect duties and taxes not paid by the due date.

4.11Standard

National legislation shall determine the rate of interest chargeable on amounts of duties and taxes that have not been paid by the due date and the conditions of application of such interest.

4.12Standard

When the duties and taxes have been paid, a receipt constituting proof of payment shall be issued to the payer, unless there is other evidence constituting proof of payment.

4.13Transitional Standard

National legislation shall specify a minimum value and/or a minimum amount of duties and taxes below which no duties and taxes will be collected.

4.14Standard

If the Customs find that errors in the Goods declaration or in the assessment of the duties and taxes will cause or have caused the collection or recovery of an amount of duties and taxes less than that legally chargeable, they shall correct the errors and collect the amount underpaid. However, if the amount involved is less than the minimum amount specified in national legislation, the Customs shall not collect or recover that amount.

B. Deferred payment of duties and taxes

4.15Standard

Where national legislation provides for the deferred payment of duties and taxes, it shall specify the conditions under which such facility is allowed.

4.16Standard

Deferred payment shall be allowed without interest charges to the extent possible.

4.17Standard

The period for deferred payment of duties and taxes shall be at least fourteen days.

C. Repayment of duties and taxes

4.18Standard

Repayment shall be granted where it is established that duties and taxes have been overcharged as a result of an error in their assessment.

4.19Standard

Repayment shall be granted in respect of imported or exported goods which are found to have been defective or otherwise not in accordance with the agreed specifications at the time of importation or exportation and are returned either to the supplier or to another person designated by the supplier, subject to the following conditions:

– the goods have not been worked, repaired or used in the country of importation, and are re-exported within a reasonable time;

– the goods have not been worked, repaired or used in the country to which they were exported, and are re-imported within a reasonable time.

Use of the goods shall, however, not hinder the repayment if such use was indispensable to discover the defects or other circumstances which caused the reexportation or re-importation of the goods.

As an alternative to re-exportation or re-importation, the goods may be abandoned to the Revenue or destroyed or rendered commercially valueless under Customs control, as the Customs may decide. Such abandonment or destruction shall not entail any cost to the Revenue.

4.20Transitional Standard

Where permission is given by the Customs for goods originally declared for a Customs procedure with payment of duties and taxes to be placed under another Customs procedure, repayment shall be made of any duties and taxes charged in excess of the amount due under the new procedure.

4.21Standard

Decisions on claims for repayment shall be reached, and notified in writing to the persons concerned, without undue delay, and repayment of amounts overcharged shall be made as soon as possible after the verification of claims.

4.22Standard

Where it is established by the Customs that the overcharge is a result of an error on the part of the Customs in assessing the duties and taxes, repayment shall be made as a matter of priority.

4.23Standard

Where time limits are fixed beyond which claims for repayment will not be accepted, such limits shall be of sufficient duration to take account of the differing circumstances pertaining to each type of case in which repayment may be granted.

4.24Standard

Repayment shall not be granted if the amount involved is less than the minimum amount specified in national legislation.

Chapter 5

Security

5.1Standard

National legislation shall enumerate the cases in which security is required and shall specify the forms in which security is to be provided.

5.2Standard

The Customs shall determine the amount of security.

5.3Standard

Any person required to provide security shall be allowed to choose any form of security provided that it is acceptable to the Customs.

5.4Standard

Where national legislation provides, the Customs shall not require security when they are satisfied that an obligation to the Customs will be fulfilled.

5.5Standard

When security is required to ensure that the obligations arising from a Customs procedure will be fulfilled, the Customs shall accept a general security, in particular from declarants who regularly declare goods at different offices in the Customs territory.

5.6Standard

Where security is required, the amount of security to be provided shall be as low as possible and, in respect of the payment of duties and taxes, shall not exceed the amount potentially chargeable.

5.7Standard

Where security has been furnished, it shall be discharged as soon as possible after the Customs are satisfied that the obligations under which the security was required have been duly fulfilled.

Chapter 6

Customs control

6.1Standard

All goods, including means of transport, which enter or leave the Customs territory, regardless of whether they are liable to duties and taxes, shall be subject to Customs control.

6.2Standard

Customs control shall be limited to that necessary to ensure compliance with the Customs law.

6.3Standard

In the application of Customs control, the Customs shall use risk management.

6.4Standard

The Customs shall use risk analysis to determine which persons and which goods, including means of transport, should be examined and the extent of the examination.

6.5Standard

The Customs shall adopt a compliance measurement strategy to support risk management.

6.6Standard

Customs control systems shall include audit-based controls.

6.7Standard

The Customs shall seek to co-operate with other Customs administrations and seek to conclude mutual administrative assistance agreements to enhance Customs control.

6.8Standard

The Customs shall seek to co-operate with the trade and seek to conclude Memoranda of Understanding to enhance Customs control.

6.9Transitional Standard

The Customs shall use information technology and electronic commerce to the greatest possible extent to enhance Customs control.

6.10Standard

The Customs shall evaluate traders’ commercial systems where those systems have an impact on Customs operations to ensure compliance with Customs requirements.

Chapter 7

Application of information technology

7.1Standard

The Customs shall apply information technology to support Customs operations, where it is cost-effective and efficient for the Customs and for the trade. The Customs shall specify the conditions for its application.

7.2Standard

When introducing computer applications, the Customs shall use relevant internationally accepted standards.

7.3Standard

The introduction of information technology shall be carried out in consultation with all relevant parties directly affected, to the greatest extent possible.

7.4Standard

New or revised national legislation shall provide for: – electronic commerce methods as an alternative to paper-based docu-

mentary requirements;

– electronic as well as paper-based authentication methods; – the right of the Customs to retain information for their own use and, as

appropriate, to exchange such information with other Customs administrations and all other legally approved parties by means of electronic commerce techniques.

Chapter 8

Relationship between the customs and third parties

8.1Standard

Persons concerned shall have the choice of transacting business with the Customs either directly or by designating a third party to act on their behalf.

8.2Standard

National legislation shall set out the conditions under which a person may act for and on behalf of another person in dealing with the Customs and shall lay down the liability of third parties to the Customs for duties and taxes and for any irregularities.

8.3Standard

The Customs transactions where the person concerned elects to do business on his own account shall not be treated less favourably or be subject to more stringent requirements than those Customs transactions which are handled for the person concerned by a third party.

8.4Standard

A person designated as a third party shall have the same rights as the

person who designated him in those matters related to transacting business with the Customs.

8.5Standard

The Customs shall provide for third parties to participate in their formal consultations with the trade.

8.6Standard

The Customs shall specify the circumstances under which they are not prepared to transact business with a third party.

8.7Standard

The Customs shall give written notification to the third party of a decision not to transact business.

Chapter 9

Information, decisions and rulings supplied by the customs

A. Information of general application

9.1Standard

The Customs shall ensure that all relevant information of general application pertaining to Customs law is readily available to any interested person.

9.2Standard

When information that has been made available must be amended due to changes in Customs law, administrative arrangements or requirements, the Customs shall make the revised information readily available sufficiently in advance of the entry into force of the changes to enable interested persons to take account of them, unless advance notice is precluded.

9.3Transitional Standard

The Customs shall use information technology to enhance the provision of information.

B. Information of a specific nature

9.4Standard

At the request of the interested person, the Customs shall provide, as quickly and as accurately as possible, information relating to the specific matters raised by the interested person and pertaining to Customs law.

9.5Standard

The Customs shall supply not only the information specifically requested but also any other pertinent information which they consider the interested person should be made aware of.

9.6Standard

When the Customs supply information, they shall ensure that they do not divulge details of a private or confidential nature affecting the Customs or third parties unless such disclosure is required or authorized by national legislation.

9.7Standard

When the Customs cannot supply information free of charge, any charge shall be limited to the approximate cost of the services rendered.

C. Decisions and rulings

9.8Standard

At the written request of the person concerned, the Customs shall notify their decision in writing within a period specified in national legislation. Where the decision is adverse to the person concerned, the reasons shall be given and the right of appeal advised.

9.9Standard

The Customs shall issue binding rulings at the request of the interested person, provided that the Customs have all the information they deem necessary.

Chapter 10

Appeals in customs matters

A. Right of appeal

10.1Standard

National legislation shall provide for a right of appeal in Customs matters.

10.2Standard

Any person who is directly affected by a decision or omission of the Customs shall have a right of appeal.

10.3Standard

The person directly affected by a decision or omission of the Customs shall be given, after having made a request to the Customs, the reasons for such decision or omission within a period specified in national legislation. This may or may not result in an appeal.

10.4Standard

National legislation shall provide for the right of an initial appeal to the Customs.

10.5Standard

Where an appeal to the Customs is dismissed, the appellant shall have the right of a further appeal to an authority independent of the Customs administration.

10.6Standard

In the final instance, the appellant shall have the right of appeal to a judicial authority.

B. Form and grounds of appeal

10.7Standard

An appeal shall be lodged in writing and shall state the grounds on which it is being made.

10.8Standard

A time limit shall be fixed for the lodgement of an appeal against a decision of the Customs and it shall be such as to allow the appellant sufficient time to study the contested decision and to prepare an appeal.

10.9Standard

Where an appeal is to the Customs they shall not, as a matter of course, require that any supporting evidence be lodged together with the appeal but shall, in appropriate circumstances, allow a reasonable time for the lodgement of such evidence.

C. Consideration of appeal

10.10Standard

The Customs shall give its ruling upon an appeal and written notice thereof to the appellant as soon as possible.

10.11Standard

Where an appeal to the Customs is dismissed, the Customs shall set out the reasons therefor in writing and shall advise the appellant of his right to lodge any further appeal with an administrative or independent authority and of any time limit for the lodgement of such appeal.

10.12Standard

Where an appeal is allowed, the Customs shall put their decision or the ruling of the independent or judicial authority into effect as soon as possible, except in cases where the Customs appeal against the ruling.
