Nr 19 Avtal med Colombia om att göra det möjligt för familjemedlemmar som ingår i hushållet hos medlemmar av en diplomatisk beskickning, ett konsulat eller en delegation vid en internationell organisation att utöva förvärvsarbete Stockholm den 29 april 2004
Regeringen beslutade den 29 april 2004 att ingå avtalet. Avtalet trädde i kraft vid undertecknandet.

Agreement between the Government of the Kingdom of Sweden and the Government of the Republic of Colombia to Enable the Members of the Family Forming Part of the Household of a Member of a Diplomatic Mission or Consular Post or Mission to an International Organization to Engage in Gainful Occupation
1. Authorization to engage in gainful occupation
a) The members of the family forming part of the household of a member of a diplomatic mission or consular post or mission to an international organization of the Sending State shall be authorized, on a reciprocal basis, to engage in gainful occupation in the Receiving State in accordance with the provisions of the laws and regulations of the Receiving State.
b) For the purposes of this Agreement:
– ”a member of a diplomatic mission or consular post or mission to an international organization” means any employee of the Sending State who is not a national or a permanent resident of the Receiving State and who is assigned to and accepted for official duty in the Receiving State in a diplomatic mission, consular post or mission to an international organization;
– ”a member of the family” means the spouse or the de facto spouse (in accordance with the law of the Sending State) of a member of a diplomatic mission or consular post or mission to an international organization and
i) any unmarried child or step child under the age of 21, or unmarried dependent child or step child who is physically or mentally disabled, who forms part of the household of a member of a diplomatic mission or consular post or mission to an international organization, or
ii) any child under the age of 23 who is pursuing full-time studies at an institution of higher education in the Receiving State and who remains dependent of the employee for support.

c) Any authorization to engage in gainful occupation in the Receiving State shall, in principle, be terminated at the end of the assignment of the member of a diplomatic mission or consular post or mission to an international organization.
2. Procedures
a) A request for authorization to engage in gainful occupation shall be sent on behalf of the member of the family by the Embassy of the Sending State to the Ministry of Foreign Affairs of the Receiving State.
b) After determining that the Applicant fits in one of the definitions described in Point 1, b), the Ministry of Foreign Affaires will notify the Embassy about its Authorization allowing the Applicant to exert the wished gainful occupation, without prejudice of the compliance of established labour laws and regulations of the Receiving State concerning the exercise of specific professions or occupations.
3. Civil and administrative privileges and immunities
In the case of members of the family who enjoy immunity from the civil and administrative jurisdiction of the Receiving State in accordance with the Vienna Convention on Diplomatic Relations or under any other applicable international instrument, such immunity shall not apply in respect of any act or omission arising from the gainful occupation and falling within the civil or administrative law of the Receiving State.
4. Criminal immunity
In the case of members of family who enjoy immunity from the criminal jurisdiction of the Receiving State in accordance with the Vienna Convention on Diplomatic Relations or under any other applicable international instrument:
a) the provisions concerning immunity from the criminal jurisdiction of the Receiving State shall continue to apply in respect of any act carried out in the course of the gainful occupation. However, the Sending State shall give

serious consideration to waiving the immunity of the member of the family concerned from the criminal jurisdiction of the Receiving State.
b) the Sending State shall give serious consideration to waiving the immunity of the member of the family from the execution of a sentence.
5. Fiscal and social security regimes
In accordance with the Vienna Convention on Diplomatic Relations or under any other applicable international instrument, members of the family will be subject to the fiscal and social security regimes of the Receiving State for all matters connected with their gainful occupation in that State.
6. Entry into force, duration, amendment and termination
a) This Agreement shall enter into force on the day of signature by both Parties.
b) This Agreement shall remain in force for an indefinite period.
c) At the request of either Party, this Agreement may be amended by mutual consent at any time. Any such amendment may be effected by an exchange of notes and shall enter into force in accordance with the provisions stipulated in paragraph 1 of this article.
d) Either Party may terminate this Agreement at any time by giving written notice to the other Party. The Agreement will terminate six months after the day on which the other Party received the notice of termination.
