Nr 54 Samarbetsavtal om ett civilt globalt system för satellitnavigering (Global Navigation Satellite System – GNSS), Galileo, mellan Europeiska gemenskapen och dess medlemsstater och Folkrepubliken Kinas regering Peking den 30 oktober 2003

Regeringen beslutade den 23 oktober 2003 att underteckna avtalet. Den 15 september 2005 beslutade regeringen att underrätta övriga parter om att Sverige hade godkänt avtalet. Underrättelsen lämnades till Europeiska unionens generalsekreterare den 8 november 2005. Avtalet har inte trätt i kraft.

FOLKREPUBLIKEN KINA, nedan även kallad “Kina”,

å ena sidan, och

EUROPEISKA GEMENSKAPEN, nedan kallad “gemenskapen”,

och

parterna i Fördraget om upprättandet av Europeiska gemenskapen, nedan kallade “gemenskapens medlemsstater”,

å andra sidan

BEAKTAR det gemensamma intresset för utvecklingen av ett globalt system för satellitnavigering för civila ändamål,

ÄR MEDVETNA OM Galileos betydelse som bidrag till navigerings- och informationsinfrastrukturen i Europa och Kina,

ÄR MEDVETNA OM att Kinas satellitnavigeringsverksamhet befinner sig i ett långt framskridet skede (bland annat Beidou programmet),

BEAKTAR den allt snabbare utvecklingen av GNSS tillämpningar i Kina, Europa och andra delar av världen,

OCH VILL stärka samarbetet mellan Kina och gemenskapen. HÄRIGENOM AVTALAS FÖLJANDE.

Artikel 1

Avtalets syfte

Avtalet syftar till att främja, underlätta och utveckla samarbetet mellan parterna inom ramen för europeiska och kinesiska bidrag till ett civilt globalt system för satellitnavigering (Global Navigation Satellite System – GNSS), det s.k. Galileoprogrammet.

Artikel 2

Definitioner

I detta avtal avses med

a) stödsystem: regionala eller lokala mekanismer, såsom det europeiska systemet för navigering genom geostationär överlappning (European Geostationary Navigation Overlay System – EGNOS) eller Kinas “Wide Area Differential Satellite Navigation System” (CWADSNS). Dessa mekanismer ger användarna av satellitbaserade navigerings- och tidsmätningssignaler information som de kan använda utöver vad de får ut från gängse huvudkonstellationer, och extra avstånds-/pseudoavståndssignaler (pseudo-range) eller kor-

rigeringar och förstärkningar av befintliga pseudoavståndssignaler. Dessa mekanismer ger användarna möjlighet att förbättra sin prestanda.

b) Beidou: ett satellitnavigeringssystem med stödsystem som konstruerats, utvecklats och drivs av Folkrepubliken Kina,

c) Galileos lokala element: mekanismer som ger dem som använder satellitbaserade navigerings- och tidssignaler från Galileo information utöver vad de får ut från gängse huvudkonstellationer. Lokala element kan användas för ökad prestanda kring flygplatser och hamnar och i stadsmiljö eller liknande problematiska geografiska omgivningar. Galileo kommer att tillhandahålla generiska modeller för lokala element.

d) Galileo: ett självständigt europeiskt system för satellitnavigering och tidsbestämning i civila händer för tillhandahållandet av GNSS-tjänster, utvecklat av gemenskapen och dess medlemsstater. Driften av Galileo kan komma att privatiseras. Det planeras att Galileo skall omfatta en eller flera tjänster för öppna eller kommersiella ändamål eller för s.k. livskritiska syften (“safety-of-life”).

e) utrustning för global navigering, positionering och tidsmätning: all civil utrustning för slutanvändare som utformats för att överföra, ta emot eller omvandla satellitbaserade navigerings- eller tidsmätningssignaler i syfte att tillhandahålla en tjänst eller att drivas med ett regionalt stödsystem,

f) lagstiftningsåtgärd: lag, författning, regel, förfarande, beslut och administrativ eller annan åtgärd som vidtas av någon av parterna,

g) driftskompatibilitet: en situation på användarnivå där en mottagare för dubbla system kan använda signaler från två system samtidigt för likvärdiga eller bättre resultat än vad som kan uppnås med endast ett system,

h) immateriella tillgångar: innebörd enligt artikel 2 i den konvention om upprättande av Världsorganisationen för den intellektuella äganderätten som ingicks i Stockholm den 14 juli 1967,

i) ersättningsansvar: en juridisk eller fysisk persons rättsliga skyldighet att ersätta skada som förorsakats andra fysiska eller juridiska personer i enlighet med specifika rättsliga principer och regler. Denna skyldighet kan fastställas i ett avtal (avtalsrättsligt ansvar) eller i en rättsakt (icke-avtalsrättsligt ansvar).

Artikel 3

Samarbetets principer

Parterna har kommit överens om att tillämpa följande principer på den samarbetsverksamhet som omfattas av detta avtal:

a) Ömsesidiga fördelar utgående från en övergripande jämvikt mellan rättigheter och skyldigheter, inbegripet bidrag.

b) Partnerskap i Galileoprogrammet i enlighet med de förfaranden och regler som tillämpas för förvaltningen av Galileo.

c) Ömsesidiga möjligheter att delta i samarbetsverksamhet i europeiska och kinesiska GNSS-projekt.

d) Snabbt och punktligt informationsutbyte som kan påverka samarbetsverksamheten.

e) Lämpligt skydd av immateriella tillgångar.

Artikel 4

Samarbetets omfattning

1. Samarbetet i fråga om satellitnavigering och -tidsmätning kommer att äga rum inom följande sektorer: vetenskaplig forskning, industriell tillverkning, utbildning, tillämpningar, tjänster och marknadsutveckling, handel, radiospektrumsfrågor, integritetsfrågor, standardisering och certifiering samt säkerhet. Parterna kan anpassa förteckningen i punkt 1 genom beslut i den gemensamma ledningskommitté som inrättas genom artikel 14 i detta avtal.

2. En utvidgning av samarbetet, på begäran av parterna, till Galileos offentliga tjänst (Public Regulated Service eller PRS), systemsäkerhetsaspekter (definition, förvaltning, användning) och kritiska kontrollfunktioner i Galileos globala segment samt utbyte av sekretessbelagd information om Galileo förutsätter att Europeiska unionen och Kina ingår ett lämpligt separat avtal.

3. Ett sådant avtal skall inte påverka tillämpningen av rådets förordning 876/2002/EG av den 21 maj 2002 om bildande av det gemensamma företaget Galileo eller den institutionella struktur som inrättats genom den förordningen, och inte heller någon annan förordning eller bestämmelse om upprättandet av ett efterträdarorgan till det gemensamma företaget Galileo. Ett sådant avtal skall inte heller påverka gällande lagar eller andra författningar som genomför icke-spridningsavtal och regler för exportkontroll för produkter med dubbla användningsområden eller nationella, inhemska åtgärder avseende säkerhet och kontroll av s.k. immateriella tekniköverföringar (intangible technology transfers).

Artikel 5

Samarbetets former

1. Inom ramen för sina gällande lagar och andra författningar skall parterna efter bästa förmåga främja samarbetsverksamheten inom ramen för detta avtal i syfte att tillhandahålla jämförbara möjligheter till deltagande i sina respektive verksamheter i de sektorer som förtecknas i artikel 4.

2. Parterna är överens om att genomföra den samarbetsverksamhet som avses i artiklarna 613.

Artikel 6

Vetenskaplig forskning

Parterna skall främja gemensam forskningsverksamhet som berör GNSS genom europeiska och kinesiska forskningsprogram, inbegripet Europeiska gemenskapens ramprogram för forskning och teknisk utveckling och de forskningsprogram som bedrivs av Europeiska rymdorganisationen och Kinas ministerium för forskning och teknik.

Den gemensamma forskningsverksamheten skall bidra till planeringen av den framtida utvecklingen av ett civilt globalt system för satellitnavigering.

Utbildningsverksamheten skall samordnas genom det utbildnings och samarbetscentrum (China-Europe GNSS Technical Training and Co-operation Centre) som upprättats i Beijing.

Artikel 7

Radiospektrum

1. Utgående från tidigare framgångar inom ramen för Internationella teleunionen kommer parterna överens om att fortsätta samarbetet och det ömsesidiga stödet kring radiospektrumsfrågor.

2. I detta sammanhang skall parterna utbyta information om frekvensansökningar och främja lämplig frekvenstilldelning för Galileo och Beidou i syfte att se till att dessa systems tjänster blir tillgängliga och kan utnyttjas av användare över hela världen och särskilt i Kina och i gemenskapen.

3. Dessutom erkänner parterna vikten av att skydda radionavigeringsspektrumet mot avbrott och interferens. För detta ändamål skall de identifiera interferenskällor och försöka hitta lösningar som motverkar sådan interferens på ett sätt som båda parter kan acceptera.

4. Parterna är överens om att uppmana den ledningskommitté som upprättas genom artikel 14 att fastställa lämpliga mekanismer för effektiva kontakter och samarbete inom denna sektor.

Artikel 8

Industriellt samarbete

1. Parterna främjar samarbetet mellan sina respektive industrier, bland annat genom samriskföretag i syfte att införa Galileosystemet och att främja användningen och utvecklingen av Galileotillämpningar och -tjänster.

2. Parterna skall upprätta en gemensam rådgivande grupp för industriellt samarbete under den ledningskommitté som inrättas genom artikel 14, i syfte att granska och vägleda samarbetet i fråga om satellitbyggande, starttjänster, byggandet av markstationer samt tillämpningsprodukter.

3. I syfte att underlätta det industriella samarbetet skall parterna skydda immateriella tillgångar i enlighet med gällande internationella standarder.

4. För export från Kina till tredje land av känsliga produkter som har med Galileoprogrammet att göra krävs förhandsgodkännande från den behöriga säkerhetsmyndigheten för Galileo, om myndigheten har rekommenderat EU:s medlemsstater att belägga sådana produkter med krav på exporttillstånd.

5. Parterna skall främja närmare kontakter mellan Kinas ministerium för forskning och teknik, Kinas nationella rymdförvaltning och Europeiska rymdorganisationen i syfte att bidra till målen för avtalet.

Artikel 9

Handel och marknadsutveckling

1. Parterna skall främja handel och investeringar i europeisk och kinesisk infrastruktur för satellitnavigering samt i utrustning för detta och i lokala element och tillämpningar för Galileo.

2. I detta syfte skall parterna bidra till att öka allmänhetens medvetenhet och kunskap om Galileos satellitnavigeringsteknik, identifiera potentiella hinder för tillväxten av tillämpningar av det globala systemet för satellitnavigering och vidta lämpliga åtgärder för att underlätta denna tillväxt.

3. I syfte att effektivt kunna reagera på användarnas behov skall gemenskapen och Kina överväga upprättandet av ett gemensamt användarforum för det globala systemet för satellitnavigering.

4. Detta avtal skall inte påverka parternas rättigheter och skyldigheter inom ramen för Världshandelsorganisationen (WTO), relevanta exportkontrollregler, EU-förordningen 1334/2000 och dess senare ändringar, rådets gemensamma åtgärd 2000/401/GUSP samt andra relevanta internationella instrument, såsom den internationella uppförandekoden mot spridning av ballistiska missiler som undertecknats i Haag eller annan relevant lagstiftning i EU:s medlemsstater eller Kina.

Artikel 10

Standarder, certifiering och reglering

1. Parterna erkänner vikten av att samordna sina insatser beträffande globala satellitnavigeringstjänster i internationella standardiserings- och certifieringsfora. I synnerhet skall parterna tillsammans främja utvecklingen av Galileostandarder och deras tillämpning över hela världen.

Samordningen syftar bland annat till att främja omfattande och nyskapande användningar av Galileotjänster för öppna, kommersiella och livskritiska (safety-of-life) ändamål som en världsomfattande standard för navigering och tidsmätning. Parterna är överens om att skapa gynnsamma förhållanden för utvecklingen av Galileotillämpningar.

2. Följaktligen skall parterna för att främja och genomföra målsättningarna i detta avtal där så är lämpligt samarbeta om alla frågor som berör satellitnavigering och som kommer upp i Internationella civila luftfartsorganisationen, Internationella sjöfartsorganisationen och Internationella teleunionen.

3. På bilateral nivå skall parterna se till att åtgärder avseende tekniska standarder, certifiering och tillståndskrav och -förfaranden inte utgör onödiga handelshinder. Nationella krav skall grundas på objektiva, icke-diskriminerande och på förhand fastställda öppna kriterier.

4. På expertnivå har parterna för avsikt att organisera samarbete och utbyte om standarder för koder, navigering, markmottagarutrustning och säkerhet för navigeringstillämpningar. Dessutom skall parterna främja kinesiska representanters deltagande i europeiska standardiseringsorganisationer.

Artikel 11

Utveckling av globala och regionala GNSS system

1. Driftskompatibilitet för globala och regionala satellitnavigeringssystem ökar kvaliteten på de tjänster som finns tillgängliga för användarna. Parterna skall samarbeta för att definiera och införa systemarkitektur som gör det möjligt att på bästa sätt garantera Galileos integritet och Galileotjänsternas fortbestånd.

2. På regional nivå skall parterna samarbeta för att i Kina bygga ett regionalt stödsystem grundat på Galileosystemet. Detta regionala system skall tillhandahålla regionala integritetstjänster utöver vad som Galileosystemet tillhandahåller globalt.

På lokal nivå skall parterna underlätta utvecklingen av Galileos lokala element.

Artikel 12

Säkerhet

1. Parterna är övertygade om att globala satellitbaserade navigeringssystem behöver skyddas mot missbruk, interferens, avbrott och fientliga handlingar.

2. Parterna skall vidta alla rimliga åtgärder för att se till att satellitnavigeringstjänsterna och den därtill hörande infrastrukturen inom respektive område är kontinuerliga och säkra.

3. Parterna erkänner att samarbete för att garantera Galileosystemets och -tjänsternas säkerhet är ett viktigt gemensamt mål.

4. Därför skall parterna inrätta en lämplig samrådskanal för att behandla säkerhetsfrågor i samband med det globala systemet för satellitnavigering. Denna handel skall användas för att säkerställa kontinuiteten i GNSS-tjänsterna.

De båda parternas behöriga säkerhetsmyndigheter skall sinsemellan fastställa de praktiska arrangemangen och förfarandena för detta.

Artikel 13

Ansvar och kostnadstäckning

Parterna skall där så är lämpligt samarbeta för att definiera och genomföra ett system för ansvarsskyldighet och metoder för kostnadstäckning i syfte att underlätta tillhandahållandet av civila tjänster för global satellitnavigering.

Artikel 14

Samarbetsmekanismer

1. Samordningen och underlättandet av samarbete inom ramen för detta avtal skall på Kinas vägnar genomföras av ministeriet för forskning och teknik, och på gemenskapens vägnar av Europeiska kommissionen.

2. I enlighet med målen i artikel 1 skall dessa båda organ upprätta en ledningskommitté för det globala systemet för satellitnavigering (nedan kallad “kommittén”), som skall förvalta detta avtal. Denna kommitté skall utgöras av båda parters officiella företrädare och skall anta sin egen arbetsordning.

Kommittén skall bland annat ha följande uppgifter:

a) Främja och övervaka det samarbete som avses i artiklarna 412 och lägga fram rekommendationer om detta.

b) Ge parterna råd om hur samarbetet kan utvecklas och förbättras i enlighet med de principer som fastställs i detta avtal.

c) Se till att detta avtal fungerar och genomförs effektivt.

3. Som allmän regel skall kommittén sammanträda varje år. Mötena skall hållas omväxlande i gemenskapen och i Kina. Extramöten kan sammankallas på begäran av endera parten.

Kommitténs utgifter, eller utgifter som görs i dess namn, skall bäras av den part till vilken de berörda medlemmarna hör. Andra kostnader än för resor och uppehälle som direkt har att göra med kommitténs möten skall bäras av värdparten. Kommittén kan inrätta en gemensam teknisk arbetsgrupp om särskilda frågor om parterna anser att detta är lämpligt.

4. Parterna välkomnar deltagandet av ett behörigt kinesiskt organ i det gemensamma företaget i enlighet med förfarandet i rådets förordning (EG) nr 876/2002 av den 21 maj 2002.

Artikel 15

Informationsutbyte

1. Parterna skall införa administrativa arrangemang och informationspunkter för att möjliggöra detta samråd och ett effektivt genomförande av bestämmelserna i detta avtal.

2. Det GNSS utbildnings och tekniska samarbetscentrum för Kina och Europa som skall inrättas i Beijing (China-Europe GNSS Training and Technical Co-operation Centre) skall bidra till att sammanställa och sprida information om europeisk och kinesisk satellitnavigeringsverksamhet till företrädare för näringslivet, forskare, journalister och allmänheten i Kina och i gemenskapen.

3. Parterna skall främja ytterligare ömsesidigt informationsutbyte om satellitnavigering mellan sina institutioner och företag.

Artikel 16

Finansiering

1. Kina skall tillhandahålla ett ekonomiskt bidrag till Galileoprogrammet genom det gemensamma företaget Galileo. Bidragets storlek och reglerna kring detta skall fastställas i ett särskilt avtal i enlighet med de institutionella bestämmelserna i rådets förordning (EG) nr 876/2002 eller eventuella senare förordningar.

2. Om någondera parts särskilda samarbetssystem omfattar ekonomiskt stöd till deltagare från den andra parten skall sådana bidrag, både ekonomiska och av annan art, från en part till den andra partens deltagare i syfte att främja samarbetsverksamheten undantas från skatt och tullar i enlighet med de lagar och andra författningar som gäller på respektive parts territorium.

Artikel 17

Samråd och förlikning

1. Parterna skall på begäran av endera parten omgående samråda om frågor som uppstår i samband med tolkning och tillämpning av detta avtal. Eventuella tvister om tolkning eller tillämpning av avtalet skall lösas genom samråd i godo mellan parterna.

2. Punkt 1 skall inte hindra parterna från att söka förlikning inom ramen för WTO-avtalet.

Artikel 18

Ikraftträdande och uppsägning

1. Detta avtal skall, efter att ha undertecknats av parterna, träda i kraft den dag då parterna meddelar varandra att deras respektive interna förfaranden för avtalets ikraftträdande har slutförts.

2. Uppsägning av detta avtal skall inte påverka giltigheten eller varaktigheten för något arrangemang som gjorts inom ramen för avtalet eller någon särskild rättighet eller skyldighet som uppkommit i fråga om immateriella tillgångar.

3. Detta avtal kan ändras efter ömsesidig skriftlig överenskommelse mellan parterna. Eventuella ändringar skall träda i kraft den dag då parterna utbyter diplomatiska noter för att informera varandra om att deras respektive interna

förfaranden för ändringens ikraftträdande har slutförts.

4. Detta avtal skall gälla under en femårsperiod från och med datumet för dess ikraftträdande. Därefter skall det automatiskt förlängas med ytterligare perioder på fem år. Båda parter kan säga upp avtalet genom att skriftligen varsla den andra parten om detta minst tre månader i förväg.

Detta avtal har upprättats i två exemplar i på danska, engelska, finska, franska, grekiska, italienska, nederländska, portugisiska, spanska, svenska, tyska och kinesiska.

Endast den engelska och den kinesiska språkversionen är giltiga.

Cooperation Agreement on a Civil Global Navigation Satellite System (GNSS) – Galileo between the European Community and its Member States and the People’s Republic of China

THE PEOPLE'S REPUBLIC OF CHINA hereinafter also referred to as “China”,

of the one part, and

THE EUROPEAN COMMUNITY hereinafter referred to as the “Community”,

and

Parties to the Treaty establishing the European Community, hereinafter referred to as “Member States of the Community”,

of the other part,

CONSIDERING the common interests in the development of a global navigation satellite system for civil use,

RECOGNISING the importance of GALILEO as a contribution to navigation and information infrastructure in Europe and China,

RECOGNISING the advanced state of China's satellite navigation activities, notably the Beidou programme,

CONSIDERING the increasing development of GNSS applications in China, Europe and other areas in the world,

DESIRING to strengthen the cooperation between China and the Com-munity,

HAVE AGREED AS FOLLOWS:

Article 1

Objective of the Agreement

The objective of the Agreement is to encourage, facilitate and enhance cooperation between the Parties within European and Chinese contributions to a civil global navigation satellite system (GNSS) – GALILEO programme.

Artikel 2

Definitions

For the purposes of this Agreement: (a) “Augmentation” means regional or local mechanisms such as the Euro-

pean Geostationary Navigation Overlay System (EGNOS), or China's wide Area Differential Satellite Navigation System (CWADSNS). They provide the users of satellite-based navigation and timing signals with input information, extra to that derived from the main constellation(s) in use, and additional range/pseudo-range inputs or corrections to, or enhancements of, existing pseudo-range inputs. These mechanisms enable users to obtain enhanced performance;

(b) “Beidou” means a satellite navigation system including an augmentation system that is designed, developed and operated by the People's Republic of China;

(c) GALILEO local elements are local mechanisms that provide the users of GALILEO satellite-based navigation and timing signals with input information, extra to that derived from the main constellation in use. Local elements may be deployed for additional performance around airports, seaports and in urban or other geographically challenging environments. GALILEO will provide generic models for local elements;

(d) “GALILEO” means an autonomous civil European global satellite navigation and timing system under civil control, for the provision of GNSS services designed and developed by the Community and its Member States. The operation of GALILEO may be transferred to a private party. GALILEO envisages one or more services for open, commercial and safety of life purposes;

(e) “Global navigation, positioning and timing equipment” means any civil end user equipment designed to transmit, receive, or process satellite-based navigation or timing signals to provide a service, or to operate with a regional augmentation;

(f) “Regulatory measure” means any law, regulation, rule, procedure, decision, administrative action or similar action by a Party;

(g) “Interoperability” means at user level a situation where a dual-system receiver can use signals from two systems together for equal or better performance than by using only one system;

(h) “Intellectual property” shall have the meaning given in Article 2 of the Convention Establishing the World Intellectual Property Organisation, done at Stockholm, 14 July 1967;

(i) “Liability” means the legal accountability of a person or legal entity to compensate for damage caused to another person or legal entity in accordance with specific legal principles and rules. This obligation may be prescribed in an agreement (contractual liability) or in a legal norm (noncontractual liability);

Article 3

Principles of the cooperation

The Parties agreed to apply the following principles to cooperation activities covered by this Agreement:

(a) mutual benefit based on an overall balance of rights and obligations including contributions;

(b) partnership in the GALILEO Programme in accordance with the procedures and rules governing the management of GALILEO;

(c) reciprocal opportunities to engage in cooperative activities in European and Chinese GNSS projects;

(d) timely exchange of information that may affect cooperative activities;

(e) appropriate protection of intellectual property rights.

Article 4

Scope of cooperation activities

1. The sectors for cooperative activities in satellite navigation and timing are: scientific research, industrial manufacturing, training, application, service and market development, trade, radio-spectrum issues, integrity issues, standardisation and certification and security. The Parties may adapt the list in paragraph 1 by decision by the Joint Steering Committee established under Article 14.

2. Extending cooperation, if requested by the Parties, to GALILEO Public Regulated Service, system security features (definition, management, use) and critical control features of the GALILEO global segment as well as exchange of classified GALILEO-information, would be subject to an appropriate separate agreement to be concluded between European Union and China.

3. This Agreement shall not affect the application of the Council Regulation (EC) No 876/2002 of 21 May 2002 setting up the GALILEO Joint Undertaking and the institutional structure established by it or any other Regulation or rule establishing a successor entity to the GALILEO Joint Undertaking. Nor does this Agreement affect the applicable laws, regulations and policies implementing non-proliferation commitments and export control for dual-use items and national domestic measures regarding security and controls of intangible transfers of technology.

Article 5

Forms of cooperation activities

1. Subject to their applicable laws and regulations, the Parties shall foster, to the fullest extent practicable, the cooperative activities under this Agreement with a view to providing comparable opportunities for participation in their activities in the sectors listed under Article 4.

2. The Parties agree to conduct the cooperative activities as referred to in Articles 6 to 13.

Article 6

Scientific research

The Parties shall promote joint research activities in the field of GNSS through European and Chinese research programmes including the European Community Framework Programme for Research and Development, and the research programmes of European Space Agency, and the Ministry of Science and Technology of China.

The joint research activities should contribute to planning the future developments of a GNSS for civil use.

Training activities shall be coordinated through the China-Europe GNSS Technical Training and Cooperation Centre established in Beijing.

Article 7

Radio spectrum

1. Building on past successes in the framework of the International Telecommunication Union, the Parties agree to continue cooperation and mutual support in radio-spectrum issues.

2. In this context the Parties shall exchange information on frequency filings and promote adequate frequency allocations for GALILEO and Beidou in order to ensure the availability of their services for the benefit of users world-wide and notably in China and in the Community.

3. Moreover, the Parties recognise the importance to protect radionavigation spectrum from disruption and interference. To this end they shall identify sources of interference and seek mutually acceptable solutions to combat such interference.

4. The Parties agree to task the Committee under Article 14 to define the appropriate mechanism in order to ensure effective contacts and collaboration in this sector.

Article 8

Industrial cooperation

1. The Parties encourage and support the cooperation between the industries of the two sides, including by the means of joint ventures with the objective of setting up of the GALILEO system as well as promoting the use and development of GALILEO applications and services.

2. The Parties will establish a joint advisory group on industrial cooperation under the Steering Committee set up under Article 14 in order to investigate and guide the cooperation on satellite manufacturing, launch services, ground station building, and application products.

3. To facilitate industrial cooperation the Parties shall protect intellectual property in accordance with the relevant international standards.

4. Exports by China to third countries of sensitive items related to the GALILEO programme will have to be submitted for prior authorisation by the competent GALILEO security authority, if the authority has recommended to the EU Member States that these items be subject to export authorisation.

5. The Parties encourage reinforced links between Ministry of Science and Technology of China, the Chinese National Space Administration, and the European Space Agency to contribute to the objectives of this Agreement.

Article 9

Trade and market development

1. The Parties encourage trade and investment in European and Chinese satellite navigation infrastructure, equipment, GALILEO local elements and applications.

2. To this end the Parties shall raise awareness of the public on GALILEO satellite navigation technology, identify potential barriers to growth in GNSS applications and take appropriate measures to facilitate this growth.

3. To identify and respond effectively to user needs the Community and China shall consider establishing a joint GNSS user forum.

4. This Agreement will not affect the rights and obligations of the Parties under the World Trade Organisation, relevant export control rules, Council Regulation (EC) No 1334/2000 and its subsequent amendments, Council Joint Action 2000/401/CFSP and other relevant international instruments such as the Hague International Code Of Conduct on Ballistic Missiles and other relevant EU Member States and Chinese legislation.

Article 10

Standards, Certification and Regulatory Measures

1. The Parties recognise the value of coordinating approaches in international standardisation and certification fora concerning global satellite navigation services. In particular the Parties will jointly support the development of GALILEO standards and promote their application world-wide.

One objective of the coordination is to promote broad and innovative use of the GALILEO services for open, commercial and safety of life purposes as a world-wide navigation and timing standard. The Parties agree to create favourable conditions for developing GALILEO applications.

2. Consequently, to promote and implement the objectives of this Agreement, the Parties shall, as appropriate, cooperate on all satellite navigation related matters that arise in the International Civil Aviation Organisation, the International Maritime Organisation and the International Telecommunications Union.

3. At bilateral level the Parties shall ensure that measures relating to technical standards, certification and licensing requirements and procedures do not constitute unnecessary barriers to trade. Domestic requirements shall be based on objective, non-discriminatory, pre-established transparent criteria.

4. At expert level the Parties intend to organise cooperation and exchanges through the Committee under Article 14 on standards covering codes, navigation, ground receiver equipment and navigation application security. Moreover, the Parties shall promote the participation of Chinese representatives in European standardisation organisations.

Article 11

Development of global and regional GNSS systems

1. Interoperability of global and regional satellite navigation systems enhances the quality of services available to users. The Parties shall collaborate to define and implement system architectures allowing an optimal guarantee of GALILEO integrity and continuity of GALILEO services.

2. At the regional level the Parties shall cooperate on building a regional augmentation system based on the GALILEO system in China. Such a regional system is foreseen to provide regional integrity services additional to those provided by the GALILEO system globally.

At local level the Parties shall facilitate the development of GALILEO local elements.

Article 12

Security

1. The Parties are convinced of the need to protect Global Navigation Satellite Systems against misuse, interference, disruption and hostile acts.

2. The Parties shall take all practicable steps to ensure the continuity and safety of the satellite navigation services and the related infrastructure in their territories.

3. The Parties recognise that cooperation to ensure security of the GALI- LEO system and services are important common objectives.

4. Hence the Parties shall establish an appropriate consultation channel to address GNSS security issues. This channel shall be used to ensure the continuity of the GNSS services.

The practical arrangements and procedures are to be defined between the competent security authorities of both Parties.

Article 13

Liability and cost recovery

The Parties will cooperate, as appropriate, to define and implement a liability regime and cost recovery arrangements in order to facilitate the provision of civil GNSS services.

Article 14

Cooperative mechanism

1. The coordination and facilitation of cooperative activities under this Agreement shall be accomplished on behalf of China, by the Ministry of Science and Technology and, on behalf of the Community, by the European Commission.

2. In accordance with the objective in Article 1 these two entities shall establish a GNSS Steering Committee hereinafter referred to as the “Committee” for the management of this Agreement. This Committee shall consist of official representatives of each Party and it shall establish its own rules of procedure.

The functions of the Steering Committee shall include:

(a) promoting, making recommendations to and overseeing the different cooperative activities as mentioned in Articles 4 to 12;

(b) advising the Parties on ways to enhance and improve cooperation consistent with the principles set out in this Agreement;

(c) reviewing the efficient functioning and implementation of this Agreement.

3. The Committee shall, as a general rule, meet annually. The meetings should be held alternatively in the Community and in China. Extraordinary meetings may be organised at the request of either Party.

The costs incurred by the Committee or in its name shall be borne by the Party to whom members relate. The costs other than those for travel and accommodation which are directly associated with meetings of the Committee shall be borne by the host Party. The Committee may set up Joint Technical Working Groups on specific subjects where the Parties consider it appropriate.

4. The Parties welcome the participation of a relevant Chinese entity in the Joint Undertaking (JU) in accordance with the procedure laid out in Council Regulation (EC) No 876/2002 of 21 May 2002.

Article 15

Exchange of information

1. The Parties shall establish administrative arrangements and enquiry points in order to provide for these consultations and the effective implementation of the provisions of this Agreement.

2. The China-Europe GNSS Training and Technical Cooperation Centre established in Beijing shall contribute to preparing and distributing information on satellite navigation activities to industry representatives, scientists, journalists and the public in China and the Community.

3. The Parties shall encourage further information exchanges concerning satellite navigation among the institutions and enterprises of the two sides.

Article 16

Funding

1. China shall provide a financial contribution to the GALILEO Programme through the GALILEO Joint Undertaking. The amount and arrangements of the contribution will be subject to a separate agreement and in accordance with the institutional arrangements of Council Regulation (EC) No 876/2002 or any subsequent regulation.

2. When specific cooperative schemes of one Party provide for financial support to participants from the other Party, any such grants, financial or other contributions from one Party to the participants of the other Party in support of those activities shall be granted tax and customs exemption in accordance with the laws and regulations applicable in the territories of each Party.

Article 17

Consultation and dispute resolution

1. The Parties shall promptly consult, at the request of any of them, on any question arising out of the interpretation or application of this Agreement. Any disputes concerning the interpretation or application of this Agreement shall be settled by friendly consultations between the Parties.

2. Paragraph 1 shall not prevent the Parties from having recourse to dispute settlement under the WTO Agreement.

Article 18

Entry into force and termination

1. This Agreement shall, after its signature by the Parties, enter into force upon the date on which the Parties have notified each other that their respective internal procedures necessary for its entry into force have been completed.

2. The termination of this Agreement shall not affect the validity or duration of any arrangements made under it or any specific rights and obligations

that have accrued in the field of intellectual property rights.

3. This Agreement may be amended by mutual agreement of the Parties in writing. Any amendment shall enter into force on the date on which the Parties exchange diplomatic notes informing each other that their respective internal procedures necessary for its entry into force have been completed.

4. This Agreement shall remain in force for a period of five years from the date of its entry into force. Thereafter, it shall be extended automatically for further periods of five years each. Either Party may, by giving three months' notice to the other in writing, terminate this Agreement.

This Agreement is drawn up in duplicate in the Danish, Dutch, English, Finnish, French, German, Greek, Italian, Portuguese, Spanish, Swedish and Chinese languages.

English and Chinese shall be the authentic languages.
