Regeringen beslutade den 3 maj 2007 om antagande av ändringarna. Underrättelse om svenskt antagande lämnades till Europeiska unionens generalsekreterare den 4 september 2007. Den ändrade konventionen har inte trätt i kraft.
Tillsammans med ändringsprotokollet publiceras här även den konsoliderade versionen av konventionen med ändringar.

ÄNDRINGAR TILL KONVENTIONEN FÖR UPPRÄTTAN- DET AV EUROPACENTRET FÖR MEDELLÅNGA VÄDER- PROGNOSER
Rådet för Europacentrum för väderprognoser på medellång sikt (ECMWF, centret) rekommenderar i enlighet med artikel 18(1) i ECMWF-konventionen att medlemsstaterna antar följande ändringar till konventionen för upprättandet av Europacentret för väderprognoser på medellång sikt:
Meningen ”Staterna som är parter till denna konvention” har lagts till framför inledningen.
Inledningen har ersatts av följande text:
TILLSTÅR att de väderrelaterade hoten mot liv och hälsa samt mot ekonomi och egendom är allt viktigare;
ÄR ÖVERTYGADE om att förbättring av medellånga väderprognoser bidrar till befolkningens skydd och trygghet;
ÄR DESSUTOM ÖVERTYGADE om att vetenskaplig och teknologisk forskning i detta syfte utgör värdefull uppmuntran för meteorologins utveckling i Europa;
BEAKTAR att resurser erfordras i större skala än vad som vanligen tilllämpas på nationell nivå för att uppnå dessa syften;
KONSTATERAR betydelsen av en avsevärd förbättring beträffande medellånga väderrapporter för Europas ekonomi;
BEKRÄFTAR åter att tillskapandet av ett självstyrande europeiskt centrum med internationell status utgör lämpligt medlet att uppnå detta syfte och dessa mål;
ÄR ÖVERTYGADE om att ett sådant centrum kan ge värdefulla bidrag till miljöövervakningens vetenskapliga grund;
KONSTATERAR att ett sådant centrum även kan vara till nytta vid utbildning av vetenskapsmän efter universitetsstudierna;
FÖRSÄKRAR att verksamheten vid ett sådant centrum dessutom kan utgöra ett nödvändigt bidrag till vissa av Meteorologiska världsorganisationens (WMO) program, samt till liknande organ;
BEAKTAR den betydelse upprättandet av ett sådant centrum kan ha för den europeiska industrins utveckling inom databehandlingsområdet;
ÄR MEDVETNA om viljan att utöka medlemskapet till ett sådant centrum till fler stater;
Stycket ”HAR BESLUTAT att upprätta ... [samt listan över de befullmäktigade] ...i god och riktig ordning” har tagits bort.
Artikel 1
Artikel 1 har fått en titel: ”Upprättandet, rådet, medlemsstaterna, huvudkontoret och språken”
Artikel 1(2): Ordet ”direktör” har ersatts av ”generaldirektör”.
Artikel 1(5) har fått en extra mening ”...om inte rådet beslutar annorlunda i enlighet med artikel 6(1)(g).”
Artikel 1(6) har ändrats enligt följande:
”6. Centrets officiella språk skall vara medlemsstaternas officiella
språk.
Dess arbetsspråk skall vara engelska, franska och tyska.

Rådet skall fastställa den omfattning i vilken de officiella, respektive arbetsspråken, skall användas i enlighet med artikel 6(2)(1).”.
Artikel 2
Artikel 2 har fått en titel: ”Syften, mål och verksamhet” En ny artikel 2(1) har tillkommit:
”1. De främsta syftena med centret är att utveckla en förmåga att ställa väderprognoser på medellång sikt, och att förse medlemsstaterna med väderprognoser på medellång sikt.” Artikel 2(1)(a) har ersatts av 2(2)(a):
”a) att utveckla och regelbundet sköta globala modeller och dataassimilationssystem för dynamik, termodynamik och komposition av jordens atmosfär och hydrosfär och samverkande delar i jordsystemet, i avsikt att:
i. förbereda prognoser med hjälp av numeriska metoder, ii. tillhandahålla grundförutsättningar för prognoserna och iii. bidra till övervakning av relevanta delar av jordsystemet,”.
Artikel 2(1)(b) har strukits. Artikel 2(1)(d) har ersatts av 2(2)(c):
”c) att insamla och lagra vederbörliga data,” Artikel 2(1)(e) har ersatts av 2(2)(d):
”d) ställa resultaten av studier och forskning som avses i a) och b) och data som avses i c) till förfogande för medlemsstaterna i lämpligaste form; Artikel 2(1)(f) har ersatts av 2(1)(e):
”e) ställa tillräcklig del, som fastställes av rådet, av sin beräkningskapacitet till förfogande för medlemsstaternas forskning; företräde ges för numeriska väderprognoser;” Artikel 2(1)(g) har ersatts av 2(1)(f):
”f) bistå med att fullgöra Meteorologiska världsorganisationens program;” Artikel 2(1)(h) har ersatts av artikel 2(2)(g):
” bistå vid vidareutbildning av medlemsstaternas vetenskapliga personal beträffande numeriska väderprognoser.”. Artikel 2(2) har ersatts av artikel 2(3):
”3. Centret skall inrätta och driva de anläggningar som erfordras för att uppnå de syften som definieras i punkt 1 och de mål som definieras i punkt 2.” Artikel 2(3) har omnumrerats 2(4). En ny artikel 2(5) har tillkommit:
”5. Centret kan bedriva verksamhet på begäran av tredje part om verksamheten är förenlig med centrets syften och mål, samt har godkänts av rådet i enlighet med artikel 6(2)(g). Kostnaden för en sådan verksamhet skall bäras av den tredje parten i fråga.” En ny artikel 2(6) har tillkommit:
”6. Centret kan genomföra tillvalsprogram i enlighet med artikel 11(3).”
Artikel 3
Artikel 3 har fått en titel: ”Samarbete med andra enheter”.

Artikel 3(2): Den inledande meningen har ändrats enligt följande: ”Centret kan ingå samarbetsöverenskommelser med:”. Artikel 3(2)(a): Hänvisningen till artikel 6(1)(e) har ändrats till ”artikel 6(1)(e) eller 6(3)(j)”. Artikel 3(2)(b): Hänvisningen till artikel 6(3)(k) har ändrats till artikel 6(3)(j). En ny artikel 3(2)(c) har tillkommit:

Artikel 4

Artikel 5 har fått en titel: ”Omröstning i rådet”. Hänvisningen till artikel 6(3)(m) har ändrats till artikel 6(3)(l).

Artikel 6 har fått en titel: ”Majoriteter vid omröstning”. Artikel 6(1)(b): Meningen ”godkännande av stater” har ersatts av ”anslutning av stater” och ordet ”godkännande” har ersatts av ”anslutning”. Artikel 6(1)(e) har ändrats enligt följande:
”e) bemyndiga generaldirektören att förhandla om samarbetsöverenskommelser med icke medlemsstater och med deras nationella vetenskapliga och tekniska organ; det kan bemyndiga generaldirektören att sluta sådana överenskommelser;”. En ny artikel 6(1)(g) har tillkommit:
”g) besluta om flytt av ECMWF:s högkvarter, i enlighet med artikel 1(5).” Artikel 6(2)(b): Ordet ”godkänna” har ersatts av ”bekräfta”. Ordet ”direktör” har ersatts av ”generaldirektör”. En ny artikel 6(2)(c) har tillkommit:
”c) i enlighet med punkt 1 (a) antaga centrets verksamhetsprogram i enlighet med artikel 11(1);”, och efterföljande punkter har omnumrerats. Artikel 6(2)(d): Ordet ”direktör” har ersatts av ”generaldirektör”. Nya artiklar 6(2)(e), (f), (g) och (h) har tillkommit:
” e) antaga förfaringssättet för tillvalsprogram i enlighet med artikel 11(3);
f) antaga individuella tillvalsprogram i enlighet med artikel 11(3;)
g) godkänna verksamhet som efterfrågas av tredje part i enlighet med artikel 2(5);
h) besluta om policy för fördelning av centrets produkter och andra resultat av dess arbete;, och efterföljande punkter har omnumrerats. En ny artikel 6(2)(l) har tillkommit:

”l) fastställa, i enlighet med artikel 1(6), i vilken utsträckning de offici-
ella språken respektive arbetsspråken skall användas.”
Artikel 6(3)(d): Ordet ”direktör” har ersatts av ”generaldirektör”.

Den ursprungliga artikeln 6(3)(i) har strukits och de efterföljande punkterna har omnumrerats.

Artikel 6(3)(j) har ändrats enligt följande:
”j) bemyndiga generaldirektören att förhandla om samarbetsöverens-
kommelser med medlemsstater, deras nationella vetenskapliga och teknis-
ka organ, och med statliga och icke-statliga internationella vetenskapliga
och tekniska organisationer vilkas verksamhet har samband med centrets
målsättning; centret kan bemyndiga generaldirektören sluta sådana över-
enskommelser;”.
Artikel 6(3)(k): 15(1) och (2) har ändrats enligt följande 15(2) och (3).
En ny artikel 6(3)(o) har tillkommit:
”o) skall antaga centrets långtidsstrategi i enlighet med artikel 11 (2).”

Artikel 7 har fått en titel: ”Den vetenskapliga rådgivande kommittén”.
Artikel 7(1): Ordet ”Organisation” har ersatts av ”Organization” och ”direktör” har ersatts av ”generaldirektör”.
Artikel 7(2): Ordet ”direktör” har ersatts av ”generaldirektör”.
Artikel 8
Artikel 8 har fått en titel: ”Finanskommittén”.
Artikel 8(1)(b) har ändrats enligt följande:
”b) representanter från de övriga medlemsstaterna, utnämnda av dem för
en period av ett år, var och en av dessa stater får inte vara representerad i
kommittén mer än två gånger i rad. Dessa representanters antal skall vara
en femtedel av de övriga medlemsstaternas antal.”.
Artikel 9
Artikel 9 har fått en titel: ”Generaldirektören”.
Artikel 9(1): Ordet ”direktör” har ersatts av ”generaldirektör” på två ställen.

”2. En långtidsstrategi för centret skall utformas vid tidpunkter och för
tidsperioder som bestäms av rådet. Utformningen skall granskas av rådet
minst vart femte år. Långtidsstrategin skall innehålla en översikt över
centrets strategiska mål och peka ut riktningen för centrets arbete under
strategins giltighetstid.
Strategin skall antagas av rådet efter förslag från generaldirektören i
enlighet med artikel 6(3)(o).
3. Ett tillvalsprogram är ett program som föreslås av en medlemsstat el-
ler grupp av medlemsstater och som alla medlemsstater deltar i, utom de
som formellt förklarar att de inte är deltagande stater, och som bidrar till
centrets syften och mål i enlighet med artiklarna 2(1) och 2(2).
a) Arbetsordningen för tillvalsprogram skall antagas av rådet i enlighet
med artikel 6(2)(e).
b) Individuella tillvalsprogram skall antagas av rådet i enlighet med
artikel 6(2)(f).”

Artikel 12 har fått en titel: ”Budgeten”.
Artikel 12(3): Ordet ”godkänna” har ändrats till ”godkänna.”
Artikel 12(4)(b): ”Direktör” har ersatts av ”generaldirektör”.

2. Anslutningsinstrument skall deponeras i generalsekretariatets arkiv hos Europeiska unionens råd. För varje anslutande stat skall denna konvention träda i kraft första dagen i andra månaden efter deposition av dess anslutningsinstrument.”

PROTOKOLL OM PRIVILEGIER OCH IMMUNITETER FÖR EUROPACENTRET FÖR MEDELLÅNGA VÄDER- PROGNOSER
Protokollet har ändrats så att ordet ”direktör” har ersatts av ”generaldirektör” i hela protokollet.

AMENDMENTS TO THE CONVENTION ESTABLISHING THE EUROPEAN CENTRE FOR MEDIUM-RANGE WEATHER FORECASTS
The Council of the European Centre for Medium-Range Weather Forecasts (ECMWF, the Centre) in accordance with Article 18(1) of the ECMWF Convention recommends the Member States to accept the following amendments to the Convention establishing the European Centre for Medium-Range Weather Forecasts:
The phrase “The States Parties to this Convention” is added before the Considerata.
The Considerata are replaced by the following:
“ACKNOWLEDGING that weather-related threats to life and health, and to economy and property, are increasingly important;
CONVINCED that the improvement of medium-range weather forecasts contributes to the protection and safety of the population;
CONVINCED FURTHER that the scientific and technical research carried out for this purpose provides a valuable stimulus to the development of meteorology in Europe;
CONSIDERING that, to achieve this purpose and these objectives, resources on a scale exceeding those normally practicable at national level are needed;
NOTING the importance for the European economy of a considerable improvement in medium- range weather forecasts;
REAFFIRMING that the establishment of an autonomous European centre with international status is the appropriate means to attain this purpose and these objectives;
CONVINCED that the Centre can make valuable contributions to developing the scientific basis for environmental monitoring;
NOTING that such a centre can also assist in the post-university training of scientists;
ASSURING that the activities of such a centre will, moreover, make a necessary contribution to certain programmes of the World Meteorological Organization (WMO) and to other relevant agencies;
CONSIDERING the importance that the establishment of such a centre can have for the development of European industry in the field of data processing;
REALIZING the will to widen the membership of the Centre to more States;”.
The paragraph: “HAVE DECIDED to establish . . . [together with the list of plenipotentiaries] . . . found in good and true form” is removed.
Article 1
Article 1 is given a title: “Establishment, Council, Member States, Headquarters, Languages”.
Article 1(2): The word “Director” is replaced by “Director-General”.
Article 1(5) is given an additional phrase “… unless otherwise decided by the Council in accordance with Article 6(1)(g).”
Article 1(6) is amended to read:

“6. The official languages of the Centre shall be the official languages of the Member States.
Its working languages shall be English, French and German.
The Council shall determine the extent to which the official and working languages shall respectively be used in accordance with Article 6(2)(l).”
Article 2
Article 2 is given a title: “The purposes, objectives and activities”. A new Article 2(1) is inserted:
“1. The primary purposes of the Centre are the development of a capability for medium-range weather forecasting and the provision of mediumrange weather forecasts to the Member States”. The re-numbered Article 2(2) is introduced by the sentence “The objectives of the Centre shall be”. Article 2(1)(a) is replaced by 2(2)(a):
“a) to develop, and operate on a regular basis, global models and dataassimilation systems for the dynamics, thermodynamics and composition of the Earth’s fluid envelope and interacting parts of the Earth-system, with a view to:
i) preparing forecasts by means of numerical methods; ii) providing initial conditions for the forecasts; and iii) contributing to monitoring the relevant parts of the Earth-system;”
Article 2(1)(b) is deleted. Article 2(1)(c) is re-numbered 2(2)(b). Article 2(1)(d) is replaced by 2(2)(c): “c) to collect and store appropriate data;”. Article 2(1)(e) is replaced by 2(2)(d):
“d) to make available to the Member States, in the most appropriate form, the results provided for in (a) and (b) and the data referred to in (c);”. Article 2(1)(f) is replaced by 2(2)(e):
“e) to make available to the Member States for their research, priority being given to the field of numerical weather forecasting, a sufficient proportion of its computing capacity, such proportion being determined by the Council;”. Article 2(1)(g) is re-numbered 2(2)(f). In the English version, the word “Organisation” is replaced by the word “Organization”. Article 2(1)(h) is replaced by Article 2(2)(g):
“g) to assist in advanced training for the scientific staff of the Member States in the field of numerical weather forecasting.” Article 2(2) is replaced by Article 2(3):
“3. The Centre shall establish and operate the installations necessary for the achievement of the purposes defined in paragraph 1 and the objectives defined in paragraph 2.” Article 2(3) is re-numbered 2(4). A new Article 2(5) is inserted:
“5. The Centre may carry out activities requested by third parties that are in line with the purposes and objectives of the Centre and that are approved by the Council in accordance with Article 6(2)(g). The cost of such activi-

ties shall be borne by the third party concerned.” A new Article 2(6) is inserted:
“6. The Centre may carry out Optional Programmes in accordance with
Article 11(3).”
Article 3
Article 3 is given a title: “Co-operation with other entities”.
Article 3(2): The introductory phrase is amended to read “The Centre may conclude co-operation agreements to that end”.
Article 3(2)(a): The reference to Article 6(1)(e) is amended to “Article 6(1)(e) or 6(3)(j)”.
Article 3(2)(b): The reference to Article 6(3)(k) is amended to Article 6(3)(j).
A new Article 3(2)(c) is added:
“c) with national scientific and technical agencies of non-Member States
under the conditions laid down in Article 6(1)(e).”
Article 4
Article 4 is given a title: “The Council”.
Article 4(2): In the English version, the word “Organisation” is replaced by the word “Organization”.
Article 4(5): The word “Director” is replaced by “Director-General”.
Article 5
Article 5 is given a title: “Voting at Council”.
Article 5(2): The reference to Article 6(3)(m) is replaced by Article 6(3)(l).

“g) decide on any transfer of the ECMWF headquarters, in accordance
with Article 1(5).”
Article 6(2)(b): The word “approve” is replaced by “endorse”. The word “Director” is replaced by “Director-General”.
A new Article 6(2)(c) is inserted:
“c) adopt, subject to paragraph 1(a), the programme of the activities of
the Centre, in accordance with Article 11(1)”. Remaining sub-articles are re-numbered.
