Regeringen beslutade den 6 september 2007 att ingå avtalet. Avtalet trädde i kraft den 6 april 2009 efter notväxling.

MEMORANDO DE ENTENDIMENTO ENTRE O GOVERNO DO REINO DA SUÉCIA E O GOVERNO DA REPÚBLICA FE- DERATIVA DO BRASIL SOBRE COOPERAÇÃO NA ÁREA DE BIOENERGIA, INCLUINDO BIOCOMBUSTÍVEIS
O Governo do Reino da Suécia e O Governo da República Federativa do Brasil (doravante denominados “Participantes”),
Compartilhando o objetivo de promover o crescimento da participação das energias renováveis na matriz energética global;
Reconhecendo o interesse comum da Suécia e do Brasil no desenvolvimento de fontes de energia de baixo custo, limpas e sustentáveis;
Considerando o papel estratégico das energias renováveis, incluindo a bioenergia, no enfrentamento dos atuais desafios globais, como a mudança do clima e a necessidade de desenvolvimento sustentável;
Conscientes da importância de um mercado mundial para bioenergia, incluindo biocombustíveis, que funcione de forma adequada, bem como da necessidade de eliminar distorções de mercado;
Reconhecendo a importância da pesquisa e desenvolvimento em bioenergia e tecnologia de biocombustíveis a fim de aumentar a eficiência em termos de custos e contribuir para o desenvolvimento sustentável;
Considerando que este Memorando de Entendimento expressa a intenção dos Participantes de cooperar na área de bioenergia,
Alcançaram o seguinte entendimento:
Seção 1
Diálogo sobre Políticas
Os Participantes pretendem estabelecer um diálogo sobre política energética como forma de estreitar vínculos e tratar de questões de interesse mútuo tais como:
a) intercâmbio de informações sobre produção e uso sustentáveis de energia a partir de fontes renováveis, incluindo biomassa, e outras áreas de interesse relacionadas;
b) cooperação para promover a utilização de tecnologias na área de bioenergia, incluindo biocombustíveis;
c) cooperação com vistas ao estabelecimento de um mercado mundial para biocombustíveis e tecnologias relacionadas;
d) promoção de padrões e normas globais harmonizados para biocombustíveis em foros pertinentes;
e) facilitação e promoção de cooperação com a indústria automotiva e com produtores de outras tecnologias de uso final pertinentes para promover o uso eficiente de energias renováveis e biocombustíveis, em particular o uso do álcool combustível em veículos automotivos equipados com motores de ciclo diesel.

Seção 2
Pesquisa e Desenvolvimento
Os Participantes pretendem encorajar a cooperação entre as respectivas organizações e instituições, públicas e privadas, envolvidas na pesquisa e no desenvolvimento da bioenergia, incluindo os biocombustíveis, a fim de melhorar o desempenho técnico, aumentar a eficiência em termos de custos e promover o desenvolvimento sustentável.
Os Participantes definirão áreas prioritárias para cooperação e incentivarão as respectivas instituições de pesquisa a desenvolver programas e projetos conjuntos.
De acordo com a legislação nacional e com os acordos internacionais vigentes em ambos os países, os Participantes deverão adotar as medidas apropriadas para proteger os direitos de propriedade intelectual que surjam da implementação deste Memorando de Entendimento.
As condições para aquisição, manutenção e exploração comercial dos direitos de propriedade intelectual sobre possíveis produtos e/ou processos que possam ser obtidos no âmbito deste Memorando de Entendimento serão definidas nos programas, contratos ou planos de trabalho específicos.
Os programas, contratos ou planos de trabalho específicos deverão também expor as condições relacionadas à confidencialidade de informações cuja publicação e/ou divulgação possa ameaçar a aquisição, manutenção e exploração comercial de direitos de propriedade intelectual obtidos no âmbito deste Memorando de Entendimento.
Os programas, contratos ou planos de trabalho específicos estabelecerão, quando aplicáveis, as regras e os procedimentos relativos à solução de controvérsias sobre temas de propriedade intelectual no âmbito deste Memorando de Entendimento.
Seção 3
Cooperação em Terceiros Países
Com vistas a promover a utilização de energias renováveis internacionalmente, os Participantes pretendem:
a) identificar oportunidades para auxiliar países em desenvolvimento, a pedido dos mesmos, no estabelecimento de arcabouço regulatório para a promoção de energias renováveis, incluindo produção e uso de biocombustíveis;
b) cooperar com organizações multilaterais pertinentes e bancos de desenvolvimento para canalizar recursos novos e adicionais para a promoção de opções de energias renováveis em países em desenvolvimento.
Seção 4
Comércio e promoção de investimento
Os Participantes procurarão estimular a promoção de atividades com vistas a expandir o comércio bilateral na área de bioenergia, incluindo biocombustíveis.

Seção 5
Grupo de Trabalho
Os Participantes concordam em estabelecer um Grupo de Trabalho, integrado por representantes de alto nível de cada Governo, para conduzir a implementação das atividades realizadas no âmbito deste Memorando de Entendimento.
As instituições designadas para participar do Grupo de Trabalho serão:
a) pelo lado brasileiro: o Ministério das Minas e Energia, o Ministério das Relações Exteriores, o Ministério da Ciência e Tecnologia, o Ministério da Agricultura, Pecuária e Abastecimento e o Ministério do Desenvolvimento, Indústria e Comércio Exterior;
b) pelo lado sueco: o Ministério da Agricultura, o Ministério da Educação e Pesquisa, o Ministério do Meio Ambiente, o Ministério da Indústria, Energia e Comunicações e o Ministério das Relações Exteriores, bem como as agências vinculadas.
O Grupo de Trabalho poderá convidar representantes do setor privado, acadêmico e de organizações não-governamentais, conforme apropriado.
Reuniões do Grupo de Trabalho deverão ser realizadas, em princípio anualmente, alternadamente na Suécia e no Brasil, conforme mutuamente acordado.
Seção 6
Custos de Implementação
Custos relacionados às atividades no âmbito deste Memorando de Entendimento estão sujeitos à disponibilidade de fundos apropriados, em conformidade com as disposições orçamentárias e a legislação pertinente de cada Participante.
A implementação de cada atividade particular no âmbito deste Memorando de Entendimento requererá que os Participantes definam por escrito os termos e as condições para as necessidades de financiamento, de acordo com a legislação nacional pertinente.
Todos os custos derivados da cooperação estabelecida por este Memorando de Entendimento serão pagos pelo Participante que neles incorra, salvo acordo mútuo em contrário.
Por ocasião de reunião do Grupo de Trabalho, cada Participante arcará com os custos correspondentes ao transporte e ao alojamento dos respectivos delegados. Custos relacionados ao planejamento, à organização e ao espaço da reunião serão de responsabilidade do Participante anfitrião.
Seção 7
Emendas
Este Memorando de Entendimento poderá, a qualquer momento, ser objeto de emendas por meio do consentimento escrito mútuo dos Participantes.

Seção 8
Controvérsias
Qualquer controvérsia relacionada à interpretação ou à implementação deste Memorando de Entendimento será resolvida mediante consultas entre os Participantes.
Seção 9
Entrada em Vigor, Vigência e Denúncia
Este Memorando de Entendimento entrará em vigor mediante notificação pelos Participantes, por via diplomática, de que foram cumpridos os respectivos requisitos legais internos. Este Memorando de Entendimento terá vigência de dois (2) anos, renovada automaticamente por um período adicional de dois (2) anos.
Qualquer dos Participantes poderá denunciar este Memorando de Entendimento mediante notificação escrita ao outro Participante, por via diplomática. A denúncia surtirá efeito dois (2) meses após a data da notificação e não afetará atividades em implementação.
Feito em Estocolmo, em 11 de setembro de 2007, em dois originais, nos idiomas sueco, português e inglês, sendo todos os textos igualmente autênticos. Em caso de divergência de interpretação, prevalecerá o texto em inglês.
