REGULATION (EEC) No 1031 /70 OF THE COMMISSION

of 1 June 1970 amending Commission Regulation (EEC) No 2311/69 of 19 November 1969 on the procedure for operating the flat-rate guarantee system provided for in Article 32 of Regulation (EEC) No 542/69 on Community transit

THE COMMISSION OF THE EUROPEAN COM­ HAS ADOPTED THIS REGULATION : MUNITIES, Article 1 Having regard to the Treaty , establishing the European Economic Community ; The quantities of products falling within Chapter 24 Having regard to Council Regulation (EEC) No of the Common Customs Tariff and included in the 542/691 of 18 March 1969 on Community transit, list of goods in Annex III to Regulation (EEC) No and in particular Article 32 thereof; 2311 /692 shall be amended to read as follows :

Whereas the tax chargeable in Italy on manufactured tobacco has been altered ; whereas the maximum CCT Quantity covered by quantities of such products which may be transported heading Description of goods the flat-rate guarantee No of 5000 u.a . under a flat-rate guarantee of 5000 units of account should consequently be amended ; 24.02 . Cigarettes 125 000 pieces Whereas in respect of goods the transport of which ex 24.02 B Cigarillos 125 000 pieces may give rise to an increase in the amount of the flat-rate guarantee it has been found appropriate to ex 24.02 B Cigars 50 000 pieces establish a single list, applicable in all Member States, 24.02 C Smoking tobacco 1 000 kg . so as to avoid additional controls at the frontiers;

Whereas it does not ^appear appropriate to alter these criteria by amending the existing provisions solely in Article 2 respect of transport in Italy;

Whereas the provisions of this Regulation are in This Regulation shall enter into force on the third accordance with the Opinion of the Committee on day following its publication in the Official Journal Community Transit; of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States .
