fixing the standard quantities of raw materials qualifying for the production refund on manufacture of maize groats and meal intended for the brewing industry

THE COMMISSION OF THE EUROPEAN COM­ legitimate interests, on the one hand, of the MUNITIES , processing industries of certain Member States which have planned on the basis of the higher rates ruling Having regard to the Treaty establishing the in their countries and, on the other, of the processing European Economic Community; industries of other Member States which are in competition with the former; whereas to this end it is Having regard to Council Regulation No advisable to select the date of 5 October 1970 ; 120/67/EEC1 of 13 June 1967 on the common organisation of the market in cereals, as last amended by Regulation (EEC) No 1253 /702 ; Whereas the measures laid down in this Regulation are in accordance with the Opinion of the Having regard to Council Regulation No Management Committee for Cereals ; 367/67/EEC3 of 25 July 1967 fixing production refunds on maize groats and meal and broken rice used in the brewing industry, and in particular Article HAS ADOPTED THIS REGULATION : 3 thereof; Whereas, with a view to uniform application in all Article 1 Member States of Community rules regarding production refunds on maize used for the manufacture of groats and meal used in the brewing For maize processed from 5 October 1970 the industry, a standard rate of yield should be fixed for production refund mentioned in Article 11 ( 1 ) (c) of the whole Community ; Regulation No 120/67/EEC shall be calculated on the basis of 180 kg of maize used by the maize industry Whereas for the products in question such a rate of for the manufacture of 100 kg of maize groats and yield is already applied for calculating the levies ; meal intended for the brewing industry. whereas, in order to maintain a balance between imported products and products manufactured in the Community, account should be taken of the flat rate Article 2 used to calculate the variable component of the levy for a product when granting the production refund ; This Regulation shall enter into force on the third Whereas the date for introducing this standard rate day following its • publication in the Official Journal of yield should be fixed so as to take account of the of the European Communities.
