REGULATION (EEC) No 1175 /72 OF THE COUNCIL

fixing the basic price and the buying-in price for lemons
THE COUNCIL OF THE EUROPEAN COMMUNITIES , — in October, November, December, January, February, March, April and May: Having regard to the Treaty establishing the the Italian production area of the province of European Economic Community ;, Catania ;
Having regard to Council Regulation (EEC) No Whereas the method for calculating the basic price 1035/721 of 18 May 1972 on the common set out in Article 16 (2) of Regulation (EEC) No organization of the market in fruit and vegetables, 1035 /72 gives, for virtually the whole marketing year, and in particular Articles 16 and 35 thereof; a price considerably higher than those fixed for the previous year ; whereas application of Article 16 (3 ) Having regard to the proposal from the Commission ; of that Regulation, which requires that the buying-in Whereas lemons are so produced that there is a price be fixed at not less than 60% of the basic price, summer harvest marketed from June to September would result in the buying-in price being fixed at and a winter harvest marketed from October to May levels excessively higher than those for the preceding of the following year; whereas for the application of marketing year, though this is not needed for market Regulation (EEC) No 1035 /72 the marketing year for support ; whereas Article 35 of the Regulation should lemons — to cover both summer and winter therefore be applied and the buying-in price fixed at production — must therefore be assumed to run levels lower than the abovementioned percentage; from 1 June to 31 May of the following year;
Whereas Class I lemons are sufficiently HAS ADOPTED THIS REGULATION : representative ; whereas for the intervention purposes this quality class should be chosen ; Article 1 Whereas to take account of seasonal variations in lemon prices the marketing year should be divided up 1 . 2. The prices specified in paragraph 1 relate to Article 3 packed Class I lemons of the 53 /62 mm size grade.
Notifications as provided for in Article 17 ( 1 ) of Article 2 Regulation (EEC) No 1035/72 shall relate to prices recorded excluding packing costs. The prices specified in Article 1 ( 1 ) do not include the cost of the packing in which the product is presented. Article 4 Where prices for a product on a representative market recorded in accordance with Article 17 of Regulation (EEC) No 1035 /72 include all or part of This Regulation shall enter into force on the day the cost of packing, such packing costs as are following its publication in the Official Journal of the included shall be deducted therefrom .
