REGULATION (EEC) No 1422/72 OF THE COMMISSION

of 4 July 1972

amending Regulation (EEC) No 1492/71 fixing the procedure and conditions for the taking over of cereals by intervention agencies

THE COMMISSION OF THE EUROPEAN COM­ HAS ADOPTED THIS REGULATION : MUNITIES,

Article 1 Having regard to the Treaty establishing the European Economic Community; The second sentence of the second indent of Article 2 (2) of Regulation (EEC) No 1492/71 shall be deleted. Having regard to Council Regulation No 120/67/EEC1 of 13 June 1967 on the common organization of the market in cereals, as last amended by Regulation (EEC) No 796/722 and in particular Article 7 (5 ) thereof; Article 2

Whereas Commission Regulation (EEC) No 1492/71 3 The following shall be substituted for the eleventh of 13 July 1971 fixing the procedure and conditions indent of Article 2 (2) of Regulation (EEC) No for the taking over of cereals by intervention 1492/ 71 : agencies, as amended by Regulation (EEC) No 1737/71,4 lays down for the 1971 /72 marketing year '— the percentage of shrivelled barley grains does a moisture content for cereals of 14 to 18% instead not exceed 15% .' of 14 to 16% and a percentage of shrivelled barley grains of 25% instead of 15% ; whereas the original percentages should be reintroduced for the 1972/73 marketing year as regards both the moisture content Article 3 and the shrivelled grains ;

Whereas Regulation (EEC) No 1492/71 , although The following paragraph shall be added to Article 3 relevant to the 1971 /72 marketing year, covers cereals of' Regulation (EEC) No 1492/71 : harvested in 1971 but not those harvested in 1972 in very different climatic conditions ; '5. This Regulation shall be binding in its entirety and directly applicable in all Member States .
