REGULATION (EEC) No 1898/72 OF THE COMMISSION of 1 September 1972 on a derogation from Regulation (EEC) No 1492/71 as regards the quality of cereals of the 1972 crop accepted for intervention

THE COMMISSION OF THE EUROPEAN COM­ (a) the total percentage of constituents which are MUNITIES, basic cereals of unimpaired quality is not less than 85 % ; Having regard to the Treaty establishing the (b) the moisture content of which does not exceed European Economic Community ; a percentage fixed by the intervention agencies at between 14 and 18% according to region ; Having regard to Council Regulation No 120/67/EEC1 of 13 June 1967 on the common 2. Common wheat and barley of the 1972 crop of organization of the market in cereals, as last amended which the percentage of sprouted grains does not by Regulation (EEC) No 796/72,2 and in particular exceed : Article 7 (5) thereof; (a) 8% for common wheat; Whereas unfavourable weather conditions during the (b) 13% for barley. summer of 1972 have led to a high moisture content in the common wheat, rye and barley crop and whereas this must be taken into account when these Article 2 cereals are accepted for intervention under Article 2 (3 ) of Commission Regulation (EEC) No 1492/713 of Where intervention agencies accept cereals under the 13 July 1971 fixing the procedure and conditions for conditions laid down in Article 1 , the price the taking over of cereals by intervention agencies ; reductions : (a) for moisture content shall be those set out in Whereas the Management Committee for Cereals has Table I of the Annex to Commission Regulation not delivered an Opinion within the time limit set by (EEC) No 1493 /714 of 13 July 1971 on price its Chairman ; increases and reductions applicable to intervention in cereals ; HAS ADOPTED THIS REGULATION: (b) for sprouted common wheat grains shall be those laid down in Article 4 (2) of Regulation (EEC) Article 1 No 1493 /71 ; (c) for sprouted barley grains, exceeding 10% but By way of derogation from Article 2 (2) of not exceeding 13% , shall be those laid down for Regulation (EEC) No 1492/71 and without prejudice common wheat in Article 4 (2) of Regulation to the other quality requirements set out in that (EEC) No 1493 /71 . paragraph, the following shall be considered to be of sound and fair marketable quality in order to be Article 3 accepted for intervention :

1 . This Regulation shall be binding in its entirety and directly applicable dn all Member States.
