REGULATION (EEC) No 2096/72 OF THE COMMISSION of 29 September 1972

amending Regulation (EEC) No 1738/71 on the non-application of the system of import licences for imports of tomato concentrates from third countries

THE COMMISSION OF THE EUROPEAN COM­ measures applicable to imports of tomato MUNITIES , concentrates, as amended by Regulation ( EEC ) No 1759 /72 7 :

Having 1 regard to the Treaty establishing the European Economic Community ; Whereas the competent authorities of the Socialist Republic of Romania have declared themselves willing to give the same guarantee for exports of Having regard to Council Regulation ( EEC ) No tomato concentrates to the Community from 1 865 /68 1 of 28 June 1968 on the common October 1972 and to take the necessary measures to organization of the market in processed fruit and that effect ; whereas, consequently, Article 1 (4) of vegetables, as last amended by Regulation (EEC) No Regulation ( EEC ) No 1558 /71 should be extended to 1425 /71 2 ; apply to imports from that country from that date ;

% Having regard to Council Regulation (EEC ) No HAS ADOPTED THIS REGULATION : 1427/713 of 2 July 1971 introducing protective measures for products processed from fruit and Article 1 vegetables, and in particular Article 1 ( 2 ) thereof ;

The following list shall be substituted for the list appearing in Article 1 of Regulation (EEC) No Whereas certain third countries have declared 1738 / 71 : themselves willing and in a position to guarantee that on importation into the Community of tomato 1 . Spain concentrates coming from their territory the price will not be below a certain minimum level and that 2. Portugal all deflection of trade will be prevented ; whereas, 3 . Morocco consequently, Commission Regulation ( EEC ) No 1738/714 of 6 August 1971 , as amended by 4 . Tunisia Regulation (EEC) No 1786/715 ; provided for the non-application to imports from these third countries 5 . Switzerland (with regard to tomato concentrates of the system of import licences provided for in with a dry matter content of at least 95% ) Article 1 ( 1 ) of Commission Regulation (EEC) No 1558 /71 6 of 20 July 1971 laying down protective 6 . Romania .

This Regulation shall be binding in its entirety and directly applicable in all Member States .
