fixing the production refund on olive oil used in the manufacture of certain preserved fish and vegetables

THE COMMISSION OF THE EUROPEAN period from the sixteenth day of the third month to COMMUNITIES, the fifteenth day of the last month preceding the month in which the refund began to apply ; Having regard to the Treaty establishing the Euro­ pean Economic Community ; Whereas Article 5 of Commission Regulation (EEC ) No 615 /71 ( 6 ) of 24 March 1971 on detailed rules Having regard to Council Regulation No 136/ for the application of the production refund on 66/EEC (*) of 22 September 1966 on the establish­ olive oil used in the manufacture of certain ment of a common organization of the market in preserved foods, as last amended by Regulation oils and fats, as last amended by the Act ( 2) (EEC) No 2503 /71 (7), provides that the refund pre­ annexed to the Treaty (3) concerning the Accession viously fixed is retained where the difference between of new Member States to the European Economic that refund and the average referred to above does Community and the European Atomic Energy not exceed 0-50 unit of account ; whereas , however Community, signed at Brussels on 22 January 1972 ; the refund must be fixed at 0 if the average is 0 ; Having regard to Council Regulation No 162/ Whereas the import levies applied from the 16 66/EEC ( 4 ) of 27 October 1966 on trade in oils and December 1972 to the 15 February 1973 to the olive fats between the Community and Greece ; oil referred to above were by Regulations (EEC ) No 2699/72, ( EEC ) No 2805 /72 , (EEC ) No 32/73 , Having regard to Council Regulation ( EEC ) No 155 / ( EEC) No 67/73 , (EEC) No 122/73 , ( EEC ) No 71 (5 ) of 26 January 1971 on the production refund on olive oil used in the manufacture of certain 192 /73 , ( EEC ) No 259 /73 , ( EEC) No 296/73 , ( EEC ) No 342/73 , ( EEC ) No 398 /73 ; preserved foods and in particular Article 3 ( 1 ) thereof ; HAS ADOPTED THIS REGULATION : Whereas Article 2 of Regulation ( EEC ) No 155 /71 provides that a production refund should be Article 1 granted in respect of olive oil used in the manufac­ ture of certain preserved fish and vegetables ; For the months of March and April 1973 the amount of the production refund referred to in Whereas Article 3 ( 1 ) of that Regulation provides Article 2 of Regulation (EEC) No 155/71 shall be 0 that the refund must be fixed every two months ; unit of account per 100 kilogrammes. whereas paragraph 2 of that Article provides that the amount of the refund is equal to the average of Article 2 the variable components of the levies on imports of olive oil falling within subheading No 15.07 A I This Regulation shall enter into force on 1 March a) of the Common Customs Tariff during the 1973 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .
