REGULATION (EEC) No 2058/73 OF THE COMMISSION of 27 July 1973
re-establishing Common Customs Tariff duties on woven fabrics of silk or of waste silk other than noil falling within heading No 50.09, originating in India, to which the preferential tariff arrangements „ set out in Council Regulation (EEC) No 2766/72 of 19 December 1972 apply
THE COMMISSION OF THE EUROPEAN indicated above, should be 110 metric tons, and COMMUNITIES, therefore the maximum amount 55 metric tons ; whereas on 23 July 1973 the amounts of imports into Having regard to the Treaty establishing the the Community of woven fabrics of silk or of waste European Economic Community; silk other than noil, originating in India, a country covered by preferential tariff arrangements, reached Having regard to Council Regulation (EEC) No that maximum amount; whereas, bearing in mind the 2766/72 (*) of 19 December 1972 establishing objectives of Council Regulation (EEC) No 2766/72, preferential tariffs in respect of certain textile which provides that maximum amounts should not products and footwear originating in developing be exceeded, Common Customs Tariff duties should countries, and in particular Article 4 (2) thereof; be re-established in respect of the products in Whereas Article 1 (3 ) and (4) of that Regulation question in relation to India ; provides that the Common Customs Tariff duties may, for each category of textile products, be HAS ADOPTED THIS REGULATION : suspended up to a Community ceiling equal to the sum arrived at by adding together the metric tonnage Article 1 of the products in question, imported into the Community in 1968 and coming from countries listed As from 31 July 1973 , Common Customs Tariff in Annex B to that Regulation, but not including duties, suspended in pursuance of Council Regulation products coming from countries already covered by ( EEC) No 2766/72 of 19 December 1972, shall be various preferential tariff arrangements established by re-established in respect of the following products the Community, and 5 % of the 1970 metric tonnage imported into the Community and originating in of such imports coming from other countries and India; from countries already covered by such arrangements; whereas, having regard to that ceiling, the amounts for products originating in any one of CCT heading Description of goods the countries listed in Annex B to that Regulation No should be within a maximum Community amount representing 50 % of that ceiling; whereas Article 2 (2) of that Regulation provides that Common 50.09 Woven fabrics of silk or of waste silk other than noil Customs Tariff duties may be re-established at any time in respect of imports of the products in question originating in any of the said countries once the relevant Community maximum amount has been Article 2 reached; This Regulation shall enter into force on the third Whereas, in respect of woven fabrics of silk or of day following its publication in the Official Journal waste silk other than noil, the ceiling, calculated as of the European Communities.
