REGULATION (EEC) No 2059/73 OF THE COMMISSION of 27 July 1973

re-establishing Common Customs Tariff duties on sacks and bags, of a kind used for the packing of goods, of cotton, falling within subheading No 62.03 B ex II, originating in South Korea, to which the preferential tariff arrangements set out in Council Regulation (EEC) No 2764/72 of 19 December 1972 apply

THE COMMISSION OF THE EUROPEAN above, should be 138*750 metric tons and therefore COMMUNITIES , the maximum amount 41-625 metric tons ; whereas on 23 July 1973 the amounts of imports into the Community of sacks and bags, of a kind used for the Having regard to the Treaty establishing the packing of goods, of cotton, of subheading 62.03 B European Economic Community; ex II originating in South Korea, a country covered by preferential tariff arrangements, reached that maximum amount; whereas, bearing in mind the Having regard to Council Regulation (EEC) No objectives of Council Regulation (EEC) N9 2764/72, 2764/72H of 19 December 1972 establishing which provides that maximum amounts should not preferential tariffs in respect of certain textile be exceeded, Common Customs Tariff duties should products originating in developing countries, and in be re-established in respect of the products in particular Article 4 (2) thereof; question in relation to South Korea ;

"Whereas Article 1 (3 ) and (4) of that Regulation provides that the Common Customs Tariff duties HAS ADOPTED THIS REGULATION : may, for each category of products, be suspended up to a Community ceiling equal to 75 % of the sum arrived at by adding together the value of the products in question, in metric tons, imported into Article 1 the Community in 1968 and coming from countries listed in Annex B to that Regulation, but not including products coming from countries already As from 31 July 1973 , Common Customs Tariff covered by various preferential tariff arrangements duties, suspended in pursuance of Council Regulation established by the Community, and 5% of the 1970 (EEC) No 2764/72 of 19 December 1972, shall be metric tonnage of such imports coming from other re-established in respect of the following products, countries and from countries already covered by such imported into the Community and originating in arrangements ; whereas, having regard to that ceiling, South Korea : the amounts for products originating in any one of the countries listed in Annex B to that Regulation should be within a maximum Community amount CCT representing 50% of the ceiling with the exception of heading Description of goods No certain products for which the maximum amount is to be reduced to the percentage indicated in Annex A to that Regulation ; whereas, for those products, this 62.03 Sacks and bags, of a kind used for the reduced percentage will be 30% ; whereas Article 2 packing of goods : (2) of that Regulation provides that Common B. Of other textile materials : Customs Tariff duties may be re-established at any time in respect of imports of the products in question ex II . Whereas, in respect of sacks and bags, of a kind used for the packing of goods, of cotton, of subheading Article 2 62.03 B ex II, the ceiling, calculated as indicated This Regulation shall enter into force on the third day following its publication in the Official Journal (l) OJ No L 296, 30. 12. 1972, p. 69. of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States .
