REGULATION (EEC) No 3259/73 OF THE COMMISSION

altering the monetary compensatory amounts for milk and milk products

THE COMMISSION OF THE EUROPEAN increase in the difference between the respective

COMMUNITIES, values of currencies, there is a danger that this

blanket treatment might interfere with trade ; whereas

Having regard to the Treaty establishing the compensatory amounts should therefore be fixed on

European Economic Community ; a more individual basis so that they can be better

adapted to the different groups of cheese with

comparable characteristics ; Having regard to Council Regulation (EEC) No

974/71 (*) of 12 May 1972 on certain measures of Whereas this measure is in accordance with the conjunctural policy to be taken in agriculture following the temporary widening of the margins of Opinion of the Management Committee for Milk

fluctuation for the currencies of certain Member and Milk Products ,

States, as last amended by Regulation ( EEC ) No

1225 /73 (2), and in particular Article 3 and Article 6

thereof; HAS ADOPTED THIS REGULATION :

Whereas the monetary compensatory amounts Article 1 introduced by Regulation ( EEC ) No 974/ 71 were

fixed by Commission Regulation (EEC ) No 2102/73 (3 ) of 31 July 1973 as last amended by Part 5 of Annex I of Regulation (EEC) No 2102/73

Regulation No 3110/73 (4); is replaced by that shown in the Annex to this

Regulation .

Whereas a single compensatory amount is fixed for Article 2 cheeses other than Grano padano , Parmigiano Reg

giano and cheeses falling within subheadings Nos

04.04 A I, 04.04 B and 04.04 D I of the Common This Regulation shall enter into force on 3 December

Customs Tariff; whereas, as a result of the gradual 1973 .

This Regulation shall be binding in its entirety and directly applicable in all Member

States .

Notes

(*) For products under subheading 04.01 A II a), the basic amount as well as the additional amount are replaced by the single amount of 0,874.

(*) When a product is denaturalized, according to Article 2 of Regulation (EEC) No 990/72, the amount is reduced as follows :

— 17-59 DM per 100 kg for Germany ,

— 54-0 Bfrs/Lfrs per 100 kg for Belgium and Luxembourg,

— 3-72 Fl per 100 kg for the Netherlands ,

— 2-547 £ per 100 kg for the United Kingdom and Ireland,

— 3 455 Lit per 100 kg for Italy.

2) The basic amount for 100 kg of product under this subheading is equal to the sum of the following elements :

( a) the amount per kg indicated multiplied by the weight of milk and cream contained in 100 kg of the product ;

(b) an additional amount for each percentage of saccharose content in 100 kg net of the product, equal to :

— 0-1038 DM for Germany,

— 0-318 Bfrs/Lfrs for Belgium and Luxembourg,

— 0-0219 Fl for the Netherlands ,

— 0-0126 £ for the United Kingdom,

— 0-0138 / for Ireland,

— 26-37 Lit for Italy .

3) The basic amount for 100 kg of product under this subheading is equal to the sum of the following elements :

( a) the amount per 100 kg indicated ;

(b) an additional amount for each percentage of saccharose content in 100 kg net of the pro duct, equal to :

— 0-1038 DM for Germany,

— 0-318 Bfrs/Lfrs for Belgium and Luxembourg

— 0-0219 Fl for the Netherlands,

— 0-0126 £ for the United Kingdom,

— 0-0138 £ for Ireland,

— 26-37 Lit for Italy.

4) However, for butter for which measures are taken :

— according to Regulation (EEC) No 1519/72 ( OJ No L 162, 18 . 7 . 1972) this amount is affected by the coefficient 0-2,

— according to Regulation (EEC) No 1259/72 ( OJ No L 139, 17. 6. 1972) this amount is affected by the coefficient 0-3, however, for the United Kingdom this coefficient is 0-6,

— according to Regulation (EEC) No 349/73 ( OJ No L 40, 13 . 2 . 1973) this amount is affected by the coefficient 0-4,

— according to Regulations (EEC) No 1282/72 ( OJ No L 142, 22. 6. 1972), (EEC) No 1717/ 72 ( OJ No L 181 , 9 . 8 . 1972), No 2537/72 ( OJ No L 272, 5 . 12. 1972) and No 1412/73 ( OJ No L 142, 29. 5 . 1973), this amount is affected by the coefficient 0.

5) In the trade with third countries this amount is affected by the coefficient 1-6517.

(B) For importations from New Zealand in accordance with the provisions of Protocol No 18 this compensatory amount is fixed at 4-907 and the special levy is not affected by the coeffi cient .

(7 ) For importations from New Zealand in accordance with the provisions of Protocol No 18 this compensatory amount is fixed at 4-237 and the special levy is not affected by the coefficient.

8) This amount is reduced in accordance with the provisions of Regulation (EEC) No 1267/73 , should the case after applying notes (*) or (5 ).

For the calculation of the fat content, only milk fat is taken into consideration.
