REGULATION ( EEC) No 3482 / 73 OF THE COMMISSION of 27 December 1973 completing Regulation ( EEC) No 1463/ 73 as regards the measures to be taken in respect of the abandonment of the application by a Member State of Article 2 (a) of Regulation ( EEC) No 974/ 71

THE COMMISSION OF THE EUROPEAN COMMUNITIES ,

Having regard to the Treaty establishing the European Economic Community ;

Having regard to Council Regulation ( EEC) No 974/71 (') of 12 May 1971 on certain measures of conjunctural policy to be taken in agriculture following the temporary wide­ ning of the margins of fluctuation for the currencies of certain Member States, as last amended by Regulation ( EEC) No 3450 / 73 (2 ), and in particular Article 6 thereof ;

Whereas Commission Regulation ( EEC) No 1 463/73 (3 ) of 30 May 1973 laying down detailed rules for the application of monetary compensatory amounts, as last amended by Regulation ( EEC) No 3257/ 73 (4 ) makes certain provisions enabling a Member State to exercise the option mentioned in Article 2 (a) of Regulation ( EEC) No 974/71 ; whereas it appears necessary to adopt additional measures to govern the case of a Member State aban­ doning the exercise of the said option ;

Whereas the measures provided for this Regulation are in accordance with the Opinions of all the Management Committees for the common organization of agricultural markets,

HAS ADOPTED THIS REGULATION :

Article1¶

The following shall be added to Article 10 (4) of Regulation ( EEC) No 1463 / 73 : ' In such case, products in respect of which the export customs formalities had been completed before the date on which such abandonment takes effect , shall remain subject to the provisions of the said Article .'

This Regulation shall be binding in its entirety and directly applicable in all Member States .
