REGULATION (EEC) No 3560 /73 OF THE COMMISSION of 21 December 1973 fixing reference prices for fishery products for 1974
THE COMMISSION OF THE EUROPEAN Whereas the reference prices for the products listed in COMMUNITIES, Annex II to Regulation (EEC) No 2142/70 must be derived from the guide prices therefor and fixed by reference to the price level at which intervention Having regard to the Treaty establishing the European measures in respect of these products become appli Economic Community ; cable ; whereas the reference prices for these products should therefore be fixed at 85 % of the guide prices Having regard to Council Regulation (EEC) No fixed for the 1974 fishing year by Council Regulation 2142/70 (') of 20 October 1970 on the common organ (EEC) No 3398 /73 (4) of 11 December 1 973 ; ization of the market in fishery products, as last amended by Regulation (EEC) No 31 59/73 (2), and in Whereas, for the products listed in Annex IV ( B) to particular the first subparagraph of Article 18 (6) Regulation (EEC) No 2142/70, reference prices are thereof ; determined on the basis of the reference price for the fresh product ; Whereas Article 18 ( 1 ) of Regulation (EEC) No 2142/70 provides, inter alia, for the fixing each year Whereas the situation on the Community import of reference prices valid in the Community for the market for frozen mackerel as mentioned in Annex IV products listed in Annexes I (A) and ( C), II and IV ( B) (B) to Regulation (EEC) No 2142/70, and in particular to that Regulation ; the fact that frozen mackerel may be used in place of fresh mackerel may make it necessary to take Whereas Article 18 (2) of the Regulation aforesaid measures to protect Community producers ; whereas provides that for the products listed in Annex I (A) or the reference price for that product should therefore be the same as that for fresh mackerel . (C) thereto such prize is to be equal to not less than 60 % and not more than 90 % of the guide price ; Whereas the measures provided for in this Regulation Whereas the guide prices for the fishery products are in accordance with the Opinion of the Manage listed in Annex I (A) and (C) to Regulation (EEC) No ment Committee for Fishery Products, 2142/70 were fixed for the 1974 fishing year by Council Regulation ( EEC) No 3395/ 73 (3 ) of 1 1 December 1 973 ;
HAS ADOPTED THIS REGULATION : Whereas it is essential to fix reference prices if appro priate measures are to be applied to protect Commu nity production ; whereas the implementation of such measures is closely linked with those taken within the Art icic 1 Community to stabilize markets, in particular by the application of the system of withdrawal prices, that is prices below which producers' organizations will not The reference prices applicable until 31 December put up for sale the produce of their members ; 1974 for the products listed in Annexes I (A) and (C) whereas the reference price must be fixed by applying and II to Regulation (EEC) No 2142/70, and for to the guide price a percentage lying within the limits frozen mackerel as mentioned in Annex IV (B) to that used in applying the withdrawal price ; whereas this Regulation , shall be as shown in the Annex to this percentage must be based in particular on the supply Regulation . and demand situation on the market ;
Whereas for these reasons, the withdrawal prices, to the extent that these lie within the limits set for this Article 2 purpose, and otherwise the lower of those limits, should be used in determining reference prices ; This Regulation shall enter into force on 1 January 1 974. This Regulation shall be binding in its entirety and directly applicable in all Member States .
