REGULATION (EEC) No 415/74 OF THE COMMISSION of 19 February 1974 repealing Regulation ( EEC) No 340/74 applying the duty in the Common Customs Tariff to certain varieties of sweet oranges originating in Spain

THE COMMISSION OF THE EUROPEAN Whereas, if the system is to operate normally, it COMMUNITIES, should be calculated on the following basis :

— in the case of currencies which are maintained in Having regard to the Treaty establishing the European relation to each other, at any given moment, Economic Community ; within a band of 2-25 % , a rate of exchange based on their effective parity ;

— for other currencies an exchange rate based on the Having regard to Council Regulation (EEC) No arithmetic mean of the spot market rates of each 2047/70 ( J ) of 13 October 1970 on imports of citrus of these currencies recorded for a given period, in fruit originating in Spain, and in particular Article 5 relation to the Community currencies referred to thereof : in the previous subparagraph ;

Having regard to the Opinion of the Monetary Committee ; Whereas application of these rules to quotations recorded for sweet oranges imported into the Commu­ nity and originating in Spain indicates that the condi­ tions set out in the second paragraph of Article 4 of Whereas Commission Regulation (EEC) No 340/74 (2) Regulation (EEC) No 2047/70 are fulfilled for varieties of 8 February 1974 applied the duty in the Common listed in Article 1 (3) (c) of Regulation (EEC) No Customs Tariff to certain varieties of sweet oranges 3303/73 (5) fixing reference prices for sweet oranges ; originating in Spain ; whereas Regulation (EEC) No 340/74 should therefore be repealed,

Whereas, pursuant to the second paragraph of Article 4 of Regulation (EEC) No 2047/70, this rule remains in force until the quotations referred to in Article 2 ( 1 ) of that Regulation, adjusted by the conversion factors HAS ADOPTED THIS REGULATION and following deduction of transport costs and import charges other than customs duties, remain equal to or higher than the price laid down in Article 3 of that Regulation for three consecutive market days on the representative markets of the Community with the lowest quotations ; Article 1

This Regulation shall be binding in its entirety and directly applicable in all Member States .
