REGULATION ( EEC ) No 444/74 OF THE COMMISSION

of 22 February 1974

on the monetary compensatory amounts applicable in Italy and France

THE COMMISSION OF THE EUROPEAN fixed at the level, expressed in lira, resulting from the COMMUNITIES , application of provisions in force on 31 December 1973 ; Having regard to the Treaty establishing the European Economic Community ; Whereas, however, by Council Regulation (EEC) No 411 /74 (7) laying down certain agricultural measures to be taken in respect of Italy following the fixing Having regard to Council Regulation ( EEC) No with effect from 28 January 1974 of a new 974/71 (*) of 12 May 1971 on certain measures of representative rate for the Italian lira, the intervention conjunctural policy to be taken in agriculture and buying-in prices which apply in Italy to the following the temporary widening of the margins of various agricultural products, except for wine and fluctuation for the currencies of certain Member sugar, are increased by 5 % from 25 February 1974, States, as last amended by Regulation ( EEC) No whereas Regulation (EEC) No 197/74 had already 3450/73 (2), and in particular Articles 3 and 6 increased the intervention price applicable to beef thereof; and veal by the same percentage from 28 January 1974 ; Whereas the monetary compensatory amounts introduced by Regulation (EEC) No 974/71 were Whereas for products to which monetary fixed by Commission Regulation (EEC) No compensatory amounts apply, the incidence of the 218 /74 (3 ) of 25 January 1974, as last amended by said measures must be taken into account when such Regulation (EEC ) No 396/74 (4); amounts are being fixed ;

Whereas Council Regulation (EEC ) No 2958 /73 (5) of Whereas this may be done by applying to prices 31 October 1973 , as last amended ■ by Regulation resulting from the new conversion rate a percentage ( EEC) No 197/74 (6), fixed a representative representing on the one hand the difference between conversion rate for the Italian lira to be applied in spot market rates and the new representative rate for agriculture with effect from 28 January 1974 ; the lira and, on the other hand , the difference whereas, however, the new Article 4b of Regulation between the prices actually applied in Italy and those (EEC) No 974/71 stipulates that for products for resulting from the exchange rate applicable on 28 which a marketing year is fixed the economic effects January 1974 ; of this measure must, as a general rule, be deferred to the beginning of the 1974/75 marketing year ; whereas to this end, under the terms of that Article, Whereas Article 3 of Regulation (EEC) No 974/71 the intervention and buving-in prices valid in Italy provides that monetary compensatory amounts are to are, until the end of the 1973 /74 marketing year, be altered if the difference set out in Article 2 ( 1 ) of that Regulation changes by at least 1 point from the percentage taken as a basis for the preceding determination ; whereas the compensatory amounts (!) Whereas Commission Regulation (EEC) No HAS ADOPTED THIS REGULATION : 1463 / 73 (*) of 30 May 1973 , as last amended by Regulation (EEC) No 350/74 (2 ) laid down detailed Article 1 rules implementing Regulation (EEC) No 974/71 ; whereas calculations based on the spot market rates 1 . Columns ' France' and ' Italia' of Annex I to recorded in accordance with Regulation (EEC ) No Regulation (EEC) No 218/74 are replaced by those 1463 /73 over the period 13 to 19 February 1974 for shown in Annex I to this Regulation. the French franc show a change of difference of more 2 . Annexes II and III to Regulation (EEC ) No than 1 point as compared with the percentage taken 218/74 are replaced by Annexes II and III to this as a basis for the preceding determination of monetary compensatory amounts , Regulation.

Article 2 Whereas the Note appearing at the beginning of Part 8 of Annex I to Regulation (EEC ) No 218/74 should The Note appearing at the beginning of Part 8 of be deleted since it is now superfluous ; Annex I to that Regulation is deleted .

Whereas the measures provided for in this Regulation which concern Italy, and the deletion provided for in Article 3 Article 2, are in accordance with the Opinions of the Managements Committees for Wine, for Cereals, for This Regulation shall enter into force on the day of Pigmeat, for Poultrymeat and Eggs, for Sugar, for its publication in the Official Journal of the Milk and Milk Products and for Beef and Veal, European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States .
