REGULATION ( EEC) No 1109/ 74 OF THE COMMISSION of 3 May 1974 altering the import levies on products processed from cereals and rice

THE COMMISSION OF THE EUROPEAN Whereas the levy on the basic product as last fixed COMMUNITIES , differs from the average levy by more than 0-25 unit of account per 100 kilogrammes of basic product ; Having regard to the Treaty establishing the European whereas, pursuant to Article 1 of Regulation (EEC) No Economic Community ; 1080 /68 (8), as last amended by Regulation (EEC) No Having regard to Council Regulation No 120 / 1 047/73 (9), the levies at present in force must there­ fore be altered as shown in the Table annexed to this 67/ EEC (') of 13 June 1967 on the common organiza­ tion of the market in cereals , as last amended by Regu­ Regulation , lation ( EEC) No 1 346/73 (2 ), and in particular Article 14 (4) thereof ; HAS ADOPTED THIS REGULATION :

Having regard to Council Regulation No 359/ Article 1 67/ EEC (3 ) of 25 July 1967 on the common organiza­ tion of the market in rice , as last amended by the The import levies to be charged on products Act (4 ) annexed to the Treaty (5 ) on the Accession of processed from cereals and rice covered by Regulation new Member States to the European Economic (EEC) No 1052/68 ( 10), as last amended by Regulation Community and the European Atomic Energy (EEC) No 881 /73 ( u ), as fixed in the Annex to Community , signed at Brussels on 22 January 1972, amended Regulation (EEC) No 1041 /74 are hereby and in particular Article 12 (4) thereof ; altered as shown in the Table annexed to this Regula­ tion . Whereas the import levies on products processed from cereals and rice were fixed by Regulation (EEC) Article 2 No 1041 / 74 (6), as last amended by Regulation ( EEC) No 1064/ 74 7 ; This Regulation shall enter into force on 4 May 1974.

This Regulation shall be binding in its entirety and directly applicable in all Member States .

(') For the purpose of distinguishing between products falling within headings Nos 11.01 and 11.02 and those falling within subheading 23.02 A , products falling within heading Nos 11.01 and 11.02 shall be those meeting the following specifications : — a starch content (determined by the modified Ewers polarimetric method ), referred to dry matter , exceeding 45 °/o by weight — an ash content , by weight , referred to dry matter (after deduction of any added minerals ), not exceeding 1-6 »/o for rice , 2'5 % for wheat , 3 % for barley , 4 °/o for buckwheat , 5 '/o for oats and 2 */o for other cereals . Germ of cereals , whole , rolled , flaked or ground , falls in all cases within heading No 11.02 .
