REGULATION ( EEC) No 1456/74 OF THE COMMISSION

of 11 June 1974

on the sale at flat-rate prices fixed in advance of certain beef held by the German intervention agency and intended for export

By derogation from Article 5 ( 1 ), second in by the intervention agencies provides that the sentence of Regulation (EEC) No 216/ 69 the purchase selling price of frozen beef and veal bought in by request is only valuable if it is accompanied by a intervention agencies can be fixed at a flat-rate in written promise by the purchaser to remove and to advance ; whereas this selling system allows interested export the meat within eight weeks from the day on exporters to ascertain the possibilities for export ; which he is informed that his request has been accepted . The sale price is equal to 159-00 u.a . per 100 kg. fixed in advance, while laying down certain deroga­ tions necessary for export of the products, particularly 2. By derogation from Article 5 ( 1 ) of Regulation as regards deposits as well as removal of the goods (EEC) No 216/ 69 the price is paid prorata on the from storage and payment for the goods ; quantities removed as the goods leave the warehouse and at the latest on the day preceding each removal . Whereas the measures provided for in this Regulation are in accordance with the Opinion of the Manage­ 3 . By derogation from Article '2 ( 2) of Regulation ment Committee for Beef and Veal , ( EEC) No 216/ 69 the minimum selling quantity is 60 metric tons .

HAS ADOPTED THIS REGULATION : 4. The delivery points and the sale quantities are listed in the Annexes .

2. Proof of importation into a third country shall Article 4 be provided in the same way as for the purposes of export refunds. Demands may not be submitted before 19 June 1974.

3 . In case of force majeure the intervention agen­ cies shall adopt such measures as appear to be warranted by the circumstances invoked . Article 5

The intervention agencies shall inform the Commis­ sion of each case of force majeure and of the measures This Regulation shall enter into force on 12 June taken in respect of it. 1974 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .
