REGULATION ( EEC) No 2143 / 74 OF THE COMMISSION of 13 August 1974 re-establishing the levying of customs duties on handkerchiefs , of fabrics other than cotton , falling within subheading ex 61.05 , originating in India, to which the preferential tariff arrangements set out in Council Regulation ( EEC) No 3503/73 of 18 December 1973 apply
THE COMMISSION OF THE EUROPEAN Whereas, in respect of handkerchiefs, of fabrics other COMMUNITIES, than cotton , the ceiling, calculated as indicated above, should be 16 metric tons , and therefore the maximum Having regard to the Treaty establishing the European amount 8 metric tons ; whereas on 8 August 1974 the Economic Community ; amounts of imports into the Community of handker Having regard to Council Regulation ( EEC) No chiefs, of fabrics other than cotton , originating in 3503/73 (') of 18 December 1973 establishing prefer India, a country covered by preferential tariff arrange ential tariffs in respect of certain textile products origi ments, reached that maximum amount ; whereas, nating in developing countries, and in particular bearing in mind the objectives of Regulation (EEC) Article 4 (2) thereof ; No 3503 /73 , which provides that maximum amounts should not be exceeded , customs duties should be Whereas Article 1 (3) and (4) of that Regulation re-established in respect of the products in question provides that customs duties may, for each category of in relation to India , products, be suspended up to a Community ceiling equal to 150 % of the sum arrived at by adding HAS ADOPTED THIS REGULATION : together the value of the products in question , in metric tons, imported into the Community in 1968 and coming from countries listed in Annex B to that Article / Regulation , but not including products coming from As from 17 August 1974, the levying of customs countries already covered by various preferential tariff duties, suspended in pursuance of Council Regulation arrangements established by the Community, and ( EEC) No 3503 / 73 of 18 December 1973 , shall be 5% of the 1970 metric tonnage of such imports re-established in respect of the following products, coming from other countries and from countries imported into the Community and originating in already covered by such arrangements ; whereas, India : having regard to that ceiling, the amounts for products originating in any one of the countries listed CCT in Annex B to that Regulation should be within a heading Description of goods maximum Community amount representing 50 % of No that ceiling, with the exception of certain products for which the maximum amount is to be reduced to the ex 61.05 Handkerchiefs : — of fabrics other than cotton percentage indicated in Annex A to that Regulation ; Whereas Article 2 (2) of that Regulation provides that the levying of customs duties may be re-established at Article 2 any time in respect of imports of the products in ques tion originating in any of the said countries or territo This Regulation shall enter into force on the third day ries once the relevant Community maximum amount following its publication in the Official Journal of has been reached ; the European Communities.
