REGULATION ( EEC) No 3171 / 74 OF THE COMMISSION of 16 December 1974 fixing a special export levy on sugar beet and sugar cane

THE COMMISSION OF THE EUROPEAN Whereas the list of products to which the special levy COMMUNITIES , is to apply was fixed by Regulation ( EEC) No 3170 /74 ; Having regard to the Treaty establishing the European Economic Community ; Whereas, if the levy system is to operate normally, levies should be calculated on the following basis : Having regard to Council Regulation No 1009 / — in the case of currencies which are maintained in 67/ EEC (') of 18 December 1967 on the common relation to each other, at any given moment, organization of the market in sugar, as last amended within a band of 2*25 % , a rate of exchange on by Regulation ( EEC) No 2476/ 74 (2), and in particular their effective parity ; Article 16 (5) thereof ; — for other currencies an exchange rate based on the Having regard to the Opinion of the Monetary arithmetic mean of the spot market rates of each Committee ; of these currencies recorded for a given period , in relation to the Community currencies referred to Whereas, under Article 16 of Regulation No 1009 / in the previous subparagraph ; 67/ EEC, where the Community or any region thereof cannot be supplied with sugar at prices within the Whereas the introduction of the special export levy is limits of the threshold price, provision may be made in accordance with the Opinion of the Management for charging a special export levy on sugar ; whereas a Committee for Sugar, special export levy on sugar has been introduced since November 1973 ; HAS ADOPTED THIS REGULATION : Whereas by Regulation ( EEC) No 3170/74 (3) of 16 December 1974 the Commission laid down detailed Article 1 rules for the application of the special export levy on A special export levy is introduced on the products sugar beet and sugar cane ; specified in Article 1 ( 1 ) (b) of Regulation No 1009 / Whereas, in view of the present situation on the sugar 67/ EEC, the amount of which shall be as shown in market, both within the Community and outside , it the Annex to this Regulation . has become necessary to apply a special export levy for the products specified in the Annex and to fix the Article 2 amount ; This Regulation shall enter into force on the third day Whereas the basic amount of the levy must be fixed following its publication in the Official Journal of per metric ton of product ; the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States .
