REGULATION (EEC ) No 680/75 OF THE COUNCIL of 4 March 1975

amending Regulation (EEC) No 1876/74 concerning the addition of alcohol to products in the wine sector

THE COUNCIL OF THE EUROPEAN COMMUNITIES HAS ADOPTED THIS REGULATION :

Having regard to the Treaty establishing the Article 1 European Economic Community ;

Article 1 (3 ) of Regulation (EEC) No 1876/74 is Having regard to Council Regulation (EEC) No replaced by the following: 816/70 (*) of 28 April 1970 laying down additional provisions for the common organization of the market in wine, as last amended by Regulation '(a) grape musts produced in the Community, derived exclusively from vine varieties (EEC) No 678/75 (2), and in particular Article 25 (2) thereof ; referred to in Article 16 of Regulation (EEC) No 816/70 and having a natural alcoholic strength of not less than 8-5° , Having regard to the proposal from the Commission ;

(b ) grape musts in fermentation produced in the Whereas, pursuant to Article 25 ( 1 ) of Regulation Community, derived exclusively from vine (EEC ) No 816/70 the addition of alcohol to the varieties referred to in Article 16 of products listed in Article 1 (2) of that Regulation is Regulation (EEC) No 816/70 and having at prohibited, with the exception of wines fortified for least the minimum natural alcoholic strength distillation and liqueur wines ; whereas Article 25 fixed for the wine-growing zone where the (2), however, permits derogations from this grapes were harvested, prohibition ;

( c) imported grape musts having a natural Whereas Council Regulation (EEC) No 1876/74 (3) alcoholic strength of not less than 8-5° , of 15 July 1974 concerning the addition of alcohol to products in the wine sector, provides for such derogation in respect of certain products ; ( d) table wines,

(e) quality wines psr, Whereas it appears advisable to provide for the addition of alcohol to grape musts imported from third countries so as to establish a practice (f) in certain cases liqueur wines, whether or not comparable to that • for Community grape musts ; imported, whereas, however, authorization for such a practice might, if granted systematically and without (g) imported wines fulfilling the requirements of restriction, disturb the market in Community grape Article 28 ( 1 ) of Regulation (EEC) No musts ; whereas the consequences of such 816/70, authorization should be examined at the end of an experimental period ; whereas, to that end, it seemed intended for the preparation of products falling justified to restrict this period to 31 December 1975 ; within heading No 22.06 of the Common Customs whereas, moreover, experience in respect of the Tariff.' products referred to in Article 4 of Regulation (EEC) No 1876/74 indicates that the provisional period should be extended from 31 August to 31 December 1975 ; whereas Regulation (EEC) No 1876/74 should Article 2 therefore be amended, The following paragraph is inserted after Article 3 ( 1 ) of Regulation (EEC) No 1876/74 :

have an actual alcoholic strength of less than Article 4 15° or more than 22° .' This Regulation shall enter into force on the third Article 3 day following its publication in the Official Journal of the European Communities. In Article 4 of Regulation (EEC) No 1876/74 the date '31 August 1975 ' is replaced by '31 December 1975 '. It shall be applicable as from 1 July 1975 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .
