REGULATION ( EEC) No 690 /75 OF THE COMMISSION of 14 March 1975 introducing a countervailing charge on cucumbers originating in Spain and Romania
THE COMMISSION OF THE EUROPEAN fixed in the first indent of Article 1 (2) of Regulation COMMUNITIES, ( EEC) No 519 /75 ;
Whereas for Spanish and Romanian cucumbers the Having regard to the Treaty establishing the European entry prices calculated in this way have remained at Economic Community ; least 0-50 unit of account below the reference price for two consecutive market days ; whereas a counter vailing charge has therefore to be introduced for these Having regard to Council Regulation (EEC) No cucumbers ; 1035/72 (') of 18 May 1972 on the common organiza tion of the market in fruit and vegetables, as last amended by Regulation (EEC) No 2745/72 (2), and in Whereas the entry prices available at present for these particular the second subparagraph of Article 27 (2) two exporting countries allow the application of one thereof ; charge, equal to the difference between the reference price and the arithmetic mean of the average entry prices established for each exporting country ; Whereas Article 25 ( 1 ) of Regulation (EEC) No 1035/72 provides that, if the entry price of a product imported from a third country remains at least 0-50 Whereas, if the system is to operate normally, it unit of account below the reference price for two should be calculated on the following basis : consecutive market days, a countervailing charge must be introduced in respect of the exporting country — in the case of currencies which are maintained in concerned , save in exceptional circumstances ; relation to each other, at any given moment, within a band of 2-25 % , a rate of exchange based on their effective parity ; Whereas Commission Regulation (EEC) No 519/75 (3 ) — for other currencies, an exchange rate based on the of 28 February 1975 fixing until the end of the 1975 arithmetic mean of the spot market rates of each marketing year the reference prices for cucumbers, fixed the reference price for Class I products at 57 03 of these currencies recorded for a given period, in relation to the Community currencies referred to units of account per 100 kg net for the month of March 1975 ; in the previous subparagraph ,
Whereas the entry price for a given exporting country is equal to the lowest representative prices recorded for at least 30 % of the quantities from the exporting HAS ADOPTED THIS REGULATION : country concerned which are marketed on all repre sentative markets for which prices are available, less the duties, and the charges indicated in Article 24 (3) of Regulation (EEC) No 1035/72 and whereas the Article 1 meaning of representative markets is defined in Article 24 (2) of Regulation (EEC) No 1035/72 ; A countervailing charge of 6-54 units of account per 100 kg net is applied to cucumbers, falling within Whereas it is necessary to record the prices to be CCT subheading ex 07.01 P, and originating in Spain taken into consideration on the representative markets and Romania . referred to in Regulation (EEC) No 211 8 /74 (4), as amended by Regulation ( EEC) No 385/ 75 (5 ) and if necessary to multiply the prices with the coefficients Article 2 ') OJ No L 118 , 20 . 5 . 1972, p. 1 . This Regulation shall be binding in its entirety and directly applicable in all Member States .
