REGULATION (EEC) No 1053 / 75 OF THE COMMISSION of 22 April 1975 fixing the compensatory amounts for poultrymeat

Whereas the compensatory amounts for poultrymeat The amounts provided for in Article 3 of Regulation products were fixed by Council Regulation ( EEC) No (EEC) No 235/73 as compensatory amounts for poul­ 235/73 and Commission Regulations (EEC) No trymeat for the period May, June and July 1975 are 2054/73 (4) and (EEC) No 2518 /74(5); whereas, fixed in the Annex hereto . however, the compensatory amounts are determined in accordance with Article 3 of Regulation (EEC) No Article 2 235/73 where the situation envisaged in Article 7 of Council Regulation (EEC) No 229/73 (6) of 31 January This Regulation shall enter into force on 1 May 1975.

This Regulation shall be binding in its entirety and directly applicable in all Member States .

Note : 1 . For products falling within heading No 02.03 and subheadings 15.01 B and 16.02 B I of the Com­ mon Customs Tariff, in respect of which the rate of duty has been bound within GATT, the compensatory amounts shall be limited to the amount resulting from that binding. 2. According to the provisions of Article 55 (6), first subparagraph of the Act concerning the con­ ditions of accession and the adjustments to the Treaties, the compensatory amount levied or granted by a Member State may not, with reservation to a derogation according to the second subparagraph of these provisions , exceed the total amount levied by that same Member State on imports from third countries .
