REGULATION ( EEC) No 1849/75 OF THE COMMISSION

of 18 July 1975

allocating quantitative quotas in respect of imports into the Community of certain textile products originating in Taiwan

THE COMMISSION OF THE EUROPEAN HAS ADOPTED THIS REGULATION : COMMUNITIES , , Article 1 Having regard to Council Regulation ( EEC) No 1023/70 (*) of 25 May 1970 establishing a common 1 . The quantitative quotas in respect of imports procedure for administering quantitative quotas, and into the Community established for 1975 , 1976 and in particular Article 2 thereof; 1977 by Regulation ( EEC) No 1783/75 of 10 July 1975 shall be allocated among the Member States as Having regard to Council Regulation ( EEC) No shown in the Annex hereto ; 1783 /75 ( 2 ) of 10 July 1975 on rules for imports of certain textile products originating in Taiwan, and in 2. The quota shares fixed for 1975 shall be particular Article 1 thereof; reduced by the volume of imports recorded in that year prior to the opening of the quotas concerned . Whereas Article 1 of the abovementioned Council Regulation (EEC ) No 1783 /75 establishes The Member States shall inform the Commission of Community quantitative quotas and provides that the volumes thus subtracted . such quotas must be administered by allocation among the Member States in accordance with the Article 2 criteria indicated ; The Member States may authorize imports in excess Whereas, however, the conditions at present of the quota shares as established by Article 1 , either governing the imports concerned into the Member by carrying over quantities not utilized from the States could not be fully standardized as from the quota shares of the preceding year or by advance time the quotas were opened by reason of the wide drawing on the quota shares for the following year, disparities between those conditions and of the provided that the quota share in respect of any one particularly sensitive nature of the Community textile year may not be thus increased by more than 10 % . industry and whereas for this reason the criteria of The Member States shall inform the Commission of allocation were so determined that the allocation the quantities so carried over or drawn in advance . would be only progressively adjusted to the supply requirements of the markets ; Article 3

Whereas the allocation must permit carry-over and Products covered by the Community quantitative advance drawing of quota shares as between one year quotas referred to in Article 1 which are brought into and another ; the customs territory of the Community under Whereas, in accordance with the abovementioned inward processing arrangements or under temporary Council Regulation ( EEC) No 1783/75 , products admission arrangements and re-exported from that brought into the customs territory of the Community territory in the unaltered state or after processing under inward processing arrangements or under shall not be charged against the quota shares as temporary admission arrangements and re-exported established in Article 1 . in the same state or after processing are not to be Article 4 charged against the quota shares concerned ;

Whereas the measures provided for in this Regulation This Regulation shall enter into force on the day are in accordance with the Opinion of the Quota following its publication in the Official Journal of the Administration Committee, European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States .
