REGULATION (EEC) No 1958/75 OF THE COUNCIL of 30 July 1975

extending certain transitional measures for rum, arrack and tafia in relation with certain overseas countries and territories

THE COUNCIL OF THE EUROPEAN Whereas Regulation ( EEC) No 1957/75 ( 6 ), which COMMUNITIES , enters into force on 1 August 1975 , lays down interim trade arrangements with the overseas countries and territories associated with the European Having regard to the Treaty establishing the Euro­ Economic Community similar to those laid down for pean Economic Community, and in particular Article products originating in the ACP States ; whereas 136 thereof ; Article 1 of this Regulation provides that certain products originating in the overseas countries and territories shall be imported into the Community free Having regard to the Act of Accession ( x ), and in of customs duties and charges having equivalent particular Article 119 ( 3 ) thereof ; effect ; whereas , however, the abovementioned Regulation provides for the adoption of a special Having regard to the Opinion of the Commission ; Regulation for products falling within subheading 22.09 C I of the Common Customs Tariff ; Whereas, with a view to the advance implementation of Article 2 ( 1 ) of the ACP-EEC Lomé convention Whereas , pursuant to Article 115 (3 ) of the Act of and Protocol 7 thereto , which was announced by the Accession the Council , by Decision No 75 /462/ Community when that convention was signed , the EEC (7 ) maintained in force the arrangements Council , by Regulation ( EEC ) No 1600/75 ( 2 ), provided for in Articles 109 ( 1 ), 114 and 119 ( 1 ) of opened a duty-free Community tariff quota for that Act ; products falling within subheading 22.09 C I of the Common Customs Tariff ( rum , arrack and tafia ) Whereas, pursuant to Article 119 of the Act of originating in the ACP States ; whereas special import Accession, the arrangements resulting from Decision arrangements should therefore be made for these No 70/549/EEC shall not apply in relations between products when they originate in the overseas the new Member States and the overseas countries countries and territories ; and territories ;

( a) when imported into the Member States of the tafia) originating in the overseas countries and Community as originally constituted, to the territories listed in Annex II shall be subject to the arrangements resulting from Decision No 70/549 / arrangements provided for in Article 119 (2), second EEC and from Article 119 (2 ), third subparagraph, and third subparagraphs, of the Act of Accession . of the Act of Accession ;

(b ) when imported into the new Member States, to Article 3 the arrangements provided for in Article 119 (2), first and third subparagraphs, of the Act of This Regulation shall enter into force on 1 August Accession . 1975 .

Article 2 It shall continue to apply until the entry into force The products falling within subheading 22.09 C I of of the new provisions relating to the same fields or the Common Customs Tariff ( rum , arrack and until 29 February 1976, whichever is the earlier.

This Regulation shall be binding in its entirety and directly applicable in all Member States .
