REGULATION ( EEC) No 2074/ 75 OF THE COMMISSION of 7 August 1975 amending Regulation ( EEC) No 2013 / 75 opening an invitation to tender for the mobilization of common wheat and maize as food aid for the World Food Programme

THE COMMISSION OF THE EUROPEAN Whereas the measures provided for in this Regulation COMMUNITIES, are in accordance with the Opinion of the Manage­ ment Committee for Cereals, Having regard to the Treaty establishing the European Economic Community ; HAS ADOPTED THIS REGULATION : Having regard to Council Regulation No 120/ 67/ EEC ( 1 ) of 13 June 1967 on the common organiza­ tion of the market in cereals, as last amended by Regu­ Article 1 lation (EEC) No 665/75 (2) ; In Regulation ( EEC) No 2013 /75 the following Article Having regard to Council Regulation (EEC) No 4a has to be added : 1 693/72 (3) of 3 August 1972 laying down the condi­ tions for the mobilization of cereals as food aid , and 'Article 4a in particular Article 6 thereof ; If the tenderer is unable to deliver the £;oods in compliance with Article 1 (3) on the date g'ven in Whereas Commission Regulation ( EEC) No the notice of invitation to tender as a result of the 201 3 /75 (4) of 1 August 1975 has opened an invitation to tender for the mobilization of common wheat and late availability of the vessels to be used for sea transportation , the resulting costs shall be borne maize as food aid for the World Food Programme ; whereas a check has revealed that due to a material by the intervention agency.' error it is necessary to supplement the Regulation in question to make clear, if force majeure makes it Article 2 impossible to complete the operation in question within the set time limits who is to bear the liability This Regulation shall enter into force on 8 August 1975 . for any resulting costs ;

This Regulation shall be binding in its entirety and directly applicable in all Member States .
