REGULATION ( EEC) No 2801 / 75 OF THE COMMISSION of 29 October 1975 concerning the quality of durum wheat that can be taken over by the interven­ tion agency in Italy for the 1975/76 marketing year

THE COMMISSION OF THE EUROPEAN Whereas the measures provided for in this Regulation COMMUNITIES , are in accordance with the Opinion of the Manage­ ment Committee for Cereals, Having regard to the Treaty establishing the European Economic Community ; Having regard to Council Regulation No 120 / HAS ADOPTED THIS REGULATION : 67/ EEC (') of 13 June 1967 on the common organiza­ tion of the market in cereals, as last amended by Regu­ Article 1 lation ( EEC) No 665/75 (2 ), and in particular Article 7 ( 5) thereof ; By derogation from Article 2 (2) of Regulation (EEC) No 1492/71 the Italian intervention agency may, Whereas , owing to unfavourable weather conditions in during the 1975/76 marketing year, accept durum Italy this year, a very high percentage of durum wheat wheat of which no more than 60 % of the grains have grains had wholly or partly lost their vitreous aspect ; wholly or partly lost their vitreous aspect. whereas therefore provision should be made to apply in respect of the 1975/76 marketing year in Italy the derogation referred to in Article 2 (3), fourth indent of Article 2 Commission Regulation (EEC) No 1492/71 (3) of 13 July 1971 fixing the procedure and conditions for the This Regulation shall enter into force on the day taking over of cereals by intervention agencies, as last following its publication in the Official Journal of amended by Regulation ( EEC) No 1 422/72 (4 ) ; the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States .
