REGULATION ( EEC) No 3285 / 75 OF THE COMMISSION of 17 December 1975 increasing and adjusting the allocation of Community quantitative export quotas for certain types of copper ash and residues, for copper waste and scrap and for lead waste and scrap

THE COMMISSION OF THE EUROPEAN increased by drawing on the Community reserve of COMMUNITIES, 810 metric tons established by Regulation (EEC) No 198 /75 ;

Having regard to Council Regulation (EEC) No 1023/70 (') of 25 May 1970 establishing a common whereas, the German-Government has expressed the procedure for administering quantitative quotas, and need to increase exports of lead waste and scrap in particular Article 2 thereof ; falling within CCT subheading 78.01 B by 50 metric tons, and for this purpose to increase the quota share allocated to Germany for 1975 ; whereas furthermore Having regard to Council Regulation (EEC) No to make better use of this quota, the quota share allo­ 321 1 /74 (2) of 17 December 1974 fixing for 1975 the cated to Ireland under Regulation (EEC) No 198/75 Community quantitative export quota for certain should be adjusted ; whereas, in order to rectify this types of copper ash and residues and for certain types situation while adhering to the criteria laid down for of copper, aluminium and lead waste and scrap, and the allocation of this quota, the Community quota for in particular Article 2 thereof ; 1975 should, exceptionally, be increased by 25 metric tons and the quota share allocated to Germany by 50 metric tons ; whereas the increase in this quota and Whereas Regulation (EEC) No 321 1 /74 fixed the 1975 the consequent increase in the share allocated to Community quantitative export quotas for the Germany for 1975 wilWnot prejudice the volume and following products at the following levels : allocation of the quota to be fixed for 1976 ;

— for copper ash and residues falling within heading No ex 26.03 of the Common Customs Tariff : Whereas the measures provided for in this Regulation 1 6 1 00 metric tons ; are in accordance with the Opinion of the Quota Administration Committee, — for copper waste and scrap falling within heading No cx 74.01 (other) thereof : 17 665 metric tons ;

— for lead waste and scrap falling within subheading 78.01 B thereof : 1 085 metric tons ;

whereas those quotas were allocated by Commission HAS ADOPTED THIS REGULATION : Regulation ( EEC) No 1 98 /75 (3) of 27 January 1975 ;

Whereas Germany, the Benelux countries and the United Kingdom have expressed the need to increase Article 1 exports of copper ash and residues falling within CCT heading No ex 26.03 ; whereas the German , Benelux and British quota shares for these products should The quota shares for copper ash and residues falling therefore be increased by drawing on the Community within heading No ex 26.03 of the Common Customs reserve of 600 metric tons established by Regulation Tariff allocated by Commission Regulation (EEC) No ( EEC) No 198 / 75 ; 198/75 are hereby increased, by drawing on the Community reserve thereby established as follows : Whereas Germany and the Benelux countries have expressed the need to increase exports of copper waste — the quota share allocated to the Federal Republic and scrap tailing within CCT heading No 74.01 of Germany : from 6 900 to 7 225 metric tons ; (other) ; whereas the German and Benelux quota shares for these products should therefore be — the quota share allocated to the Benelux coun­ tries : from 800 to 1 000 metric tons ; (') OJ No L 124, 8 . 6 . 1970 , p . 1 . Article 2 78.01 B of the Common Customs Tariff fixed by Council Regulation (EEC) No 3211 /74 is hereby The quota shares for copper waste and scrap falling increased from 1 085 to 1 110 metric tons . within heading No ex 74.01 (other) of the Common Customs Tariff allocated by the said Regulation are 2. The share allocated to the Federal Republic of hereby increased, by drawing on the Community Germany by Regulation (EEC) No 198 /75 is hereby reserve thereby established as follows : increased from 285 to 335 metric tons, and the share therein allocated to Ireland is hereby reduced from 25 — the share allocated to the Federal Republic of metric tons to nil . Germany : from 6 450 to 6 686 metric tons ; — the share allocated to the Benelux countries : from 2 050 to 2 624 metric tons . A rticle 4

Article 3 This Regulation shall enter into force on the third day following its publication in the Official Journal of 1 . The 1975 Community quantitative export quota the European Communities. It shall apply until 31 for lead waste and scrap falling within subheading December 1975 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .
