REGULATION (EEC) No 3358/75 OF THE COUNCIL of 23 December 1975 amending Regulation (EEC) No 1411 /71 as regards the fat content of whole milk

THE COUNCIL OF THE EUROPEAN in their territories when the said Regulation entered COMMUNITIES, into force ; Having regard to the Treaty establishing the European Whereas, a short prolongation of the transitional Economic Community, and in particular Articles 42 period is necessary for the formal adoption of certain and 43 thereof ; amendments proposed by the Commission in the matter ; whereas, for this reason, it is appropriate to Having regard to the proposal from the Commission ; maintain the current situation up to 31 March 1976, Having regard to the Opinion of the European Parlia­ ment (') ; HAS ADOPTED THIS REGULATION : Whereas, in accordance with the second indent of Article 3 ( 1 ) (b) and with Article 6 ( 1 ) of Council Regu­ Article 1 lation (EEC) No 141 1 /71 (2) of 29 June 1971 laying down additional rules on the common organization of In Article 6 (2) of Regulation (EEC) No 1411 /71 , the the market in milk and milk products for products date '31 December 1975' shall be replaced by '31 falling within heading No 04.01 of the Common March 1976'. Customs Tariff, as last amended by Regulation (EEC) No 1 556/74 (3), only milk with a fat content of at least Article 2 3-5 % may be sold in the Community as whole milk for direct consumption ; whereas under Article 6 (2) of This Regulation shall enter into force on the third day that Regulation Member States were allowed, up to 31 following its publication in the Official Journal of December 1975, to maintain the provisions applicable the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States .
