COMMISSION REGULATION ( EEC) No 969176 of 27 April 1976 re-establishing the levying of customs duties on handkerchiefs of fabrics other than cotton, falling within heading No ex 61.05 , originating in developing coun­ tries to which the preferential tariff arrangements set out in Council Regulation (EEC) No 3002/75 of 17 November 1975 apply

THE COMMISSION OF THE EUROPEAN by preferential tariff arrangments, reached that COMMUNITIES, ceiling ; whereas, bearing in mind the objectives of Regulation (EEC) No 3002/75, which provides that Having regard to the Treaty establishing the European the ceiling should not be exceeded, customs duties Economic Community, should be re-established in respect of the products in Having regard to Council Regulation (EEC) No question , 3002/75 of 17 November 1975 establishing preferen­ ital tariffs in respect of certain cotton textile and like HAS ADOPTED THIS REGULATION : products originating in developing countries (!), and in particular Article 4 (2) thereof, Article 1 Whereas Article 1 (3) of that Regulation provides that As from 2 May 1976, customs duties, suspended in customs duties may, for each category of products, be pursuance of Council Regulation (EEC) No 3002/75 suspended up to a Community ceiling equal to of 17 November 1975, shall be re-established in 166 % of the sum arrived at by adding together the respect of the following products, imported into the metric tonnage of the products in question, imported Community : into the Community in 1968 and coming from coun­ tries listed in Annex B to that Regulation, but not CCT including products coming from countries already heading Description of goods covered by various preferential tariff arrangements esta­ No blished by the Community, and 5 % of the 1970 metric tonnage of such arrangments ; whereas Article ex 61.05 Handkerchiefs : 2 ( 1 ) of that Regulation provides that the levying of — Of fabrics other than cotton customs duties may be re-established at any time once the Community ceiling has been reached ; Whereas, in respect of handkerchiefs of fabrics other Article 2 than cotton, the ceiling, calculated as indicated above, should be 18 metric tons ; whereas on 16 April 1976, This Regulation shall enter into force on the third day the amounts of imports into the Community of the following its publication in the Official Journal of products in question, originating in countries covered the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States .
