altering the monetary compensatory amounts

THE COMMISSION OF THE EUROPEAN market rates recorded for the Italian lira pursuant to COMMUNITIES, Regulation (EEC) No 1380/75 for the period 5 May to 11 May 1976 show that the difference has changed by more than one point from the percentage taken as a basis when the monetary compensatory amounts were Having regard to the Treaty establishing the European last fixed ; Economic Community,

Having regard to Council Regulation ( EEC) No 974/ 71 of 12 May 1971 on certain measures of Whereas Article 2a of Regulation ( EEC) No 974/71 conjunctural policy to be taken in agriculture provides that in cases where a product exported from following the temporary widening of the margins of one Member State is imported into a Member State fluctuation for the currencies of certain Member which has to grant a compensatory amount on States ('), as last amended by Regulation ( EEC) No imports, the exporting Member State may in agree­ 557/76 ( 2 ), and in particular Articles 3 and 6 thereof, ment with the importing Member State pay the compensatory amount which should be granted by the importing Member State ;

Whereas the monetary compensatory amounts provided for in Regulation ( EEC) No 974/71 were fixed by Commission Regulation ( EEC) No 572/76 of 15 March 1 976 (3 ), as last amended by Regulation Whereas at the joint meeting of the Agricultural ( EEC) No 1061 / 76 (4 ) ; Management Committees on 30 April 1976, the repre­ sentatives of all the other Member States stated that their governments wished to apply Article 2a of Regu­ Whereas, under Article 3 of Regulation ( EEC) No lation ( EEC) No 974/71 with effect from 17 May to their exports to Italy and the United Kingdom in 974/71 , the monetary compensatory amounts must be 1976 ; whereas the representatives of the latter altered if the difference referred to in Article 2 ( 1 ) of that Regulation changes by one point or more from Member States recorded their governments' agreement with the measure ; whereas the United Kingdom the percentage taken as a basis for the previous stated by telex of 6 May 1976 that it wished to make fixing ; whereas the compensatory amounts must be use of the abovementioned facility in respect of altered in accordance with the change in this differ­ ence ; exports to Ireland and the latter Member State is in agreement ; whereas, therefore, the exchange rate for conversion of the lira and the pound sterling into the currencies of the other Member States should be Whereas detailed rules for the application of monetary fixed ; compensatory amounts were laid down by Regulation ( EEC) No 1380 / 75 of 29 May 1975 ( 5 ), as last amended by Regulation ( EEC ) No 1 040 / 76 ( b) ; whereas the spot

HAS ADOPTED THIS REGULATION : Article 2

Article 1 Annex III to this Regulation is to be added to Regula­ tion ( EEC) No 572/ 76 . 1 . The; column headed ' Italia in Annex I to Regula­ tion ( EEC) No 572/ 76 is hereby replaced by that in A rticle 3 ' Annex I to this Regulation .

2 . Annex II to Regulation ( EEC) No 572/ 76 is This Regulation shall enter into force on 17 May hereby replaced by Annex II to this Regulation . 1976 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .

(') The compensatory amount will not be levied on animals imported within an annual tariff c > t.i to be granted by the competent authorities of the European Communities : ( a ) for heifers and cows , other than those intended for slaughter, of the grey , brown , and mottled yellow Simmental and Pinzgau breeds, ( b ) for bulls , heifers , and cows , other than those intended for slaughter , of the mottled Simmental breed , the Schwyz breed , and the Friborg breed .
