COMMISSION REGULATION (EEC) NQ 2499/76 of 13 October 1976 concerning an invitation to tender for the costs of delivery of skimmed-milk powder to certain third countries as food aid

THE COMMISSION OF THE EUROPEAN skimmed-milk powder to certain third countries (7), COMMUNITIES, for the 1 974 programme ; whereas it is necessary however to specify certain points, in particular the time limit for the submission of tenders and the terms Having regard to the Treaty establishing the European for delivery of the skimmed-milk powder ; Economic Community,

HAS ADOPTED THIS REGULATION : Whereas Council Regulation (EEC) No 1299/76 of 1 June 1976 on the supply of skimmed-milk powder as food aid to certain developing countries and interna­ tional organizations under the 1976 programme (3), Article 1 provides for 600 metric tons of skimmed-milk powder to be made available to Peru and 500 metric tons to 1 . Article 3 2. A tender may relate only to lots designated by the same capital letter. 1 . Delivery shall be effected : — for Lots A 1 , A 2, B and C : at a port to be designated in the tender, chosen By way of derogation from Article 3 (2) of Regulation from among ports in the Community accessible (EEC) No 2557/74, the tenderer shall indicate in his for ocean-going ships having a regular service to tender, in the case of Lots A 1 and A 2 and Lots D 1 the country of destination • to D 3, for how many lots — under the conditions — for Lots D 1 to D 3 and E : laid down — the tender is valid . at the port of Antwerp.

2. Delivery at the port of embarkation shall be effected on a date to be fixed by the intervention agency concerned which must be within , the period Article 5 laid down in the Annex .

Article 4 This Regulation shall enter into force on the day 1 . The period for the submission of tenders expires following its publication in the Official Journal of on 26 October 1976 at 12 noon . the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States .
