COMMISSION REGULATION ( EEC) No 255 /77 of 4 February 1977 amending Regulation (EEC) No 363/76 fixing in respect of the 1975 crop export refunds for raw tobacco

THE COMMISSION OF THE EUROPEAN Whereas the Management Committee for Tobacco has COMMUNITIES , not delivered an opinion within the time set by its chairman , Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Regulation (EEC) No HAS ADOPTED THIS REGULATION : 727/70 of 21 April 1970 on the common organization of the market in raw tobacco ('), as last amended by the Act of Accession (2), and in particular the first Article 1 sentence of the third subparagraph of Article 9 (2) thereof, The Annex to Regulation ( EEC) No 363 /76 is hereby replaced by the Annex hereto. Whereas Commission Regulation (EEC) No 363/76 of 19 February 1976 (3), as amended by Regulation ( EEC) No 1089/76 (4), fixed export refunds for certain varie­ Article 2 ties of tobacco from the 1975 crop ; In Article 2 of Regulation (EEC) No 363/76 for '30 Whereas, since Regulation (EEC) No 363/76 came June 1977' read '31 December 1977'. into force new export outlets have arisen for a further variety and for other countries and for a further period after the time limit laid down ; whereas a refund Article 3 should be granted for this variety and the list of coun­ tries of destination should be enlarged and the time This Regulation shall enter into force on the third day limit for granting these refunds should be extended to following its publication in the Official Journal of the 31 December 1977 ; the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States .
