COMMISSION REGULATION ( EEC) No 146/ 78 of 25 January 1978 on the delivery of various consignments of butteroil as food aid

Having regard to Council Regulation (EEC) No HAS ADOPTED THIS REGULATION : 694/76 of 25 March 1976 laying down general rules for the supply of milk fats under the 1976 food-aid programme to certain developing countries and to Article 1 certain international organizations (4), and in particular Article 7 thereof, In accordance with the provisions of Regulation (EEC) No 303 /77 the intervention agencies set out in the Having regard to Council Regulation ( EEC) No Annex shall deliver butteroil as food aid on the 1768 /77 of 25 July 1977 laying down general rules for special terms set out therein . the supply of milk fats under the 1977 food-aid programme to certain developing countries and to Article 2 certain international organizations (5), and in particular Article 7 thereof, This Regulation shall enter into force on the third day Whereas , under the food-aid programmes adopted by following its publication in the Official Journal of the Council Regulations specified in the Annex, the European Communities.
This Regulation shall be binding in its entirety and directly applicable in all Member States .

Notes : (') This Annex , together with the notice published in Official Journal of the European Communi ties No C 95 of 19 April 1977 , page 7, takes the place of an invitation to tender from the interven tion agencies concerned in cases where , under point 12, there must be a tendering procedure . (2 ) Other than those set out in Annex II to Regulation ( EEC) No 303 / 77 . ( 3 ) Only in the case of delivery ' to the port of unloading' and ' free at destination ' ; see Article 5 and the last indent of Article 13 ( 1 ) of Regulation ( EEC) No 303 / 77 . (4 ) In cases where the goods come from intervention stocks, an additional notice stating the ware houses where the product is stored will be published in the ' C' edition of the Official Journal .
( 5 ) When the unloading at the port of Assab is carried out under the supervision of an agency approved by the recipient country, the intervention agency may accept, in the place of the supporting documents referred to in Article 21 (a) of Regulation ( EEC) No 303 /77, an official state ment from such supervision agency certifying that the quantities concerned have been delivered to the ' port of unloading Assab (ship's hold)' and unloaded in that port .
