altering the monetary compensatory amounts
THE COMMISSION OF THE EUROPEAN applicable in Italy to the abovementioned sectors and COMMUNITIES , to certain cereal products and certain goods not listed in Annex II to the Treaty should therefore be altered Having regard to the Treaty establishing the European with effect from 1 February 1978 ; Economic Community,

Whereas the abovementioned alterations also make it Whereas the monetary compensatory amounts necessary to alter the coefficients listed in Annexes II introduced by Regulation (EEC) No 974/71 were and III respectively to Regulation (EEC) No 938/77 ; fixed by Commission Regulation ( EEC) No 938/77 of 29 April 1977 ( 3), as last amended bv Regulation ( EEC) No 164/78 ( 4 ); Whereas Part 4 of Annex I to Regulation (EEC) No 938/77 was amended by Commission Regulation Whereas Council Regulation (EEC) No 878 /77 of ( EEC) No 2754/77 of 9 December 1977 altering the 26 April 1977 on the exchange rates to be applied in monetary compensatory amounts applicable to eggs agriculture (5), as last amended by Regulation (EEC) and poultrymeat (7), with effect from 1 February No 178 /78 (6), fixed new representative rates for the 1978 ; whereas the new monetary compensatory French franc, and the lira ; amounts were fixed pursuant to Article 1 of Regula tion (EEC ) No 2.754/77 subject to their alteration on the basis of the development of the exchange rates Whereas the new conversion rate takes effect in France referred to in Article 2 ( 1 ) of Regulation (EEC) for all sectors on 1 February 1978 ; whereas in Italy No 974/71 and to the adjustment of the intervention the new conversion rates apply with effect from prices for cereals in the new Member States ; 1 February 1978 to the milk and milk products, beef whereas the said price adjustments have meanwhile and veal , pigmeat sectors and sugar; come into effect; whereas, moreover, alterations in the spot rates recorded for the French franc, the lira Whereas all monetary compensatory amounts in and the pound have also occurred and have already respect of France and the compensatory amounts led to adjustments to the other monetary compensa tory amounts in force ; whereas the monetary com pensatory amounts for eggs and poultrymeat must therefore be recalculated for France, Italy, Ireland C) OJ No L 106, 12 . 5 . 1971 , p. 1 . and the United Kingdom having regard to the (2) OJ No L 67, 15 . 3 . 1976, p. 1 . abovementioned changes ; (3) OJ No L 110, 30. 4. 1977, p. 6. Whereas the measures provided for in this Regulation 2. In Part 4 of Annex I to Regulation (EEC ) are in accordance with the opinion of the relevant No 938/77, the columns France, Italia, Ireland and management committees, United Kingdom are replaced by those set out in Annex I to this Regulation.
HAS ADOPTED THIS REGULATION 3 . Annexes II and III . to Regulation (EEC) No 938/77 are hereby replaced by Annexes II and III to this Regulation. Article 1
Article 2 1 . In Parts 1 , 2, 3 , 5 , 6, 7 and 8 of Annex I to Regulation (EEC) No 938/77, the colomns France and Italia are replaced by those set out in Annex I to this This Regulation shall enter into force on 1 February Regulation. 1978 .
This Regulation shall be binding in its entirety and directly applicable in all Member States .

( a) In trade with non-member countries , the coefficient 1-71 shall be applied to the supplementary amounts indicated above. The coefficient shall , however, be 1-47 in the case of products containing skimmed-milk powder sold pur suant to Regulation (EEC) No 2054/76 ( OJ No L 228, 20. 8 . 1976 , p. 17).
( b) In intra-Community trade and in trade with non-member countries , where these products contain skimmed-milk powder and either fish meal or fish oil and/or fish liver oil or iron carbonate and/or iron sulphate and/or copper sulphate, the coefficient 0.25 shall be applied to the supplementary amounts indicated above.
( c) When completing customs formalities , the applicant shall state on the declaration provided for this purpose the content, expressed in actual weight per tonne of finished product, of :
— powdered or granulated milk (excluding whey),
— powdered or granulated whey,
— added casein or caseinate.
5) For products falling within subheading 23.07 B I c) 1 or 2 of the Common Customs Tariff, containing more than 50 % by weight of products falling within heading No 07.06 or 11.04 C thereof the monetary compensatory amounts shall be those applicable to products falling within subheading 07.06 A thereof (Regulation (EEC) No 1497/76, OJ No L 167, 26. 6 . 1976, p. 27).

(') L'octroi des montants compensatoires monétaires applicables pour ces produits est subordonné au respect des conditions pour l'octroi des restitutions visées au règlement ( CLE ) n " 171 /78 . Au moment de l'accomplissement des formalités douanières d'exportation ou d'importation dans l'État membre qui octroie le montant compensa toire monétaire, l'exportateur ou l'importateur concerné déclare par écrit que les produits en cause répondent à ces conditions . (3) The grant of monetary compensatory amounts in respect of these products is subject to compliance with the conditions for the grant of refunds laid down in Regulation ( EEC ) No 171 / 78 . The exporter or importer at the time of the conclusion of customs formalities concerning the export or the import in a Member State granting the monetary compensatory amount, shall declare in writing that the products in question fulfil these conditions . (3) Voraussetzung für die Gewährung der Wahrungsausgleichsbetrage für diese Erzeugnisse ist die Erfüllung der in der Verordnung ( EWG ) Nr. 171 /78 aufgeführten Bedingungen für die Gewährung der Erstattungen .. Der Ein - oder Ausführer erklärt schriftlich zum Zeitpunkt der Erfüllung der Ausfuhr- oder Einfuhrzollförmlich keiten in dem Mitgliedstaat, der den Währungsausgleichsbetrag gewährt, daß die fraglichen Erzeugnisse diesen Bedingungen entsprechen . (') La concessione degli import; compensativi monetari aoplicabili per questi prodotti è subordinata all'osservanza delle condizioni per la concessione delle restituzioni di cui al regolamento ( CEE) n . 171 /78 . Al momento dell ' ottemperamento delle formalità doganali d'esportazione o d'importazione negli Stati membri che concedono l'importo compensativo monetario, l'esportatore o l'importatore interessato dichiara per iscritto che i prodotti in causa rispondono a queste condizioni . (3) Voor de toekenning van de voor deze produkten geldende monetaire compenserende bedragen moet voldaan zijn aan de voorwaarden voor de toekenning van de in Verordening ( EEG ) nr . 171 /78 bedoelde restituties . De betreffende im- of exporteur legt, tijdens het vervullen van de douaneformaliteiten bij uitvoer of invoer in de Lid-Staat die het monetaire compenserende bedrag uitbetaalt, een schriftelijke verklaring over dat de betreffende produkten aan deze voorwaarden voldoen . ( ) De monetære udligningsbeløb, der anvendes for disse produkter, ydes kun , såfremt de i forordning (EØF) nr . 171 / 78 omhandlede betingelser for ydelse af restitution overholdes . Ved afslutningen af toldformaliteterne i forbindelse med udførsel eller indførsel i den medlemsstat, der yder det monetære udligningsbeløb , skal ekspor tøren/importøren afgive en skriftlig erklæring om, at de pågældende varer opfylder disse betingelser.

(*) The monetary compensatory amounts shall not apply to products presented in the form of meal or powder, whether or not in compounded form . ( 4) Die "Währungsausgleichsbeträge werden nicht für Erzeugnisse in Form von Mehl oder Pulver, auch in gepreßter Form , angewendet. (') The compensatory amount shall not be applied on animals imported within an annual tariff quota to be granted by the competent authorities of the European Communities : ( a) for heifers and cows, other than those intended for slaughter, of the grey, brown, and mottled yellow Simmental and Pinzgau breeds, (b) for bulls, heifers, and cows, other than those intended for slaughter, of the mottled Simmental breed, the Schwyz breed, and the Friborg breed. (*) For skimmed-milk powder sold pursuant to Regulation (EEC) No 2054/76 ( OJ No L 228 , 20 . 8 . 1976 ) the amount indicated shall be multiplied by the coefficient 0.086 .
For skimmed-milk powder consigned to Italy from another Member State in accordance with Regulation (EEC) No 1624/76 ( OJ No L 180 , 6 . 7 . 1976 ) the amount indicated shall be multiplied by the coefficient 0.59 .
For skimmed-milk powder sold pursuant to Regulation (EEC) No 368/77 ( OJ No L 52 , 24. 2. 1977) or Regulation (EEC) No 443/77 ( OJ No L 58 , 3 . 3 . 1977), consigned in the natural state to another Member State , the amount indicated shall be multiplied by the coefficient 0.15 .
2) In intra-Community trade , where the product has been denatured in accordance with Article 2 of Regulation (EEC) No 990/72 ( OJ No L 115 , 17. 3 . 1972), the basic amount and any additional amount shall be replaced by a single amount of :
— Lit 9 962 per 100 kg for Italy,
— FF 55.52 per 100 kg for France .
3) The basic amount for 100 kg of product falling within this subheading shall be equal to the sum of the following :
( a) the amount per 100 kg indicated multiplied by V100 of the weight of milk and cream contained in 100 kg of the product ;
( b) a further amount for each percentage point of sucrose content in 100 kg net of the product, equal to V100 of the amount indicated in Part 7 of Annex I to this Regulation under subheading 17.01 A (undenatured) of the Common Customs Tariff .
4) However, for butter covered by the measures provided for :
— in Regulation (EEC) No 1282/72 ( OJ No L 142 , 22 . 6 . 1972), the amount indicated shall be multiplied by the coefficient 0.42 ; — in Regulation (EEC) No 1717/72 ( OJ No L 181 , 9 . 8 . 1972), the amount indicated shall be multiplied by the coefficient 0.40 ; — in Regulation (EEC) No 349/73 ( OJ No L 40 , 13 . 2 . 1973), the amount indicated shall be multiplied by the coefficient 0.47 ; — in Regulation (EEC) No 232/75 ( OJ No L 24 , 31 . 1 . 1975), the amount indicated shall be multiplied :
— by the coefficient 0.34 where the butter is to be used in formula A products ,
— by the coefficient 0.54 where the butter is to be used in formula B products .

In trade with third countries, the coefficient 1.71 shall be applied to the amounts indicated above. The coefficient shall, however, be 1.47 in the case of products containing skimmed-milk powder sold pursuant to Regulation (EEC) No 2054/76 ( OJ No L 228 , 20. 8 . 1976).
In intra-Community trade, where the product has not been produced in accordance with Regulation (EEC) No 990/72 ( OJ No L 115 , 17. 3 . 1972), the coefficient 1.71 shall be applied to the amounts indicated above. However, this coefficient shall not be applied to products consigned to Italy from another Member State in accordance with Regulation (EEC) No 1624/76 ( OJ No L 180, 6. 7. 1976).
In intra-Community trade and in trade with third countries, where these products contain skimmed-milk powder dena tured pursuant to Regulation (EEC) No 368/77 ( OJ No L 52, 24. 2. 1977), to Regulation (EEC) No 443/77 ( OJ No L 58 , 3 . 3 . 1977), or to Regulation (EEC) No 1844/77 ( OJ No L 205, 11 . 8 . 1977), and either fish meal or fish oil and/or fish liver oil or iron carbonate and/or iron sulphate and/or copper sulphate, the amounts indicated above shall be multiplied by the coefficient 0.25 .
