COMMISSION REGULATION ( EEC) No 825 / 78 of 25 April 1978 on the sales for export of olive oil held by the Italian intervention agency
THE COMMISSION OF THE EUROPEAN called 'AIMA , shall put up for sale by tender for COMMUNITIES , export
Having regard to the Treaty establishing the European — to African countries and Madagascar, excluding Algeria, Libya, Morocco, South Africa and Tunisia, Economic Community, — to Iran , Iraq , Israel , Jordan and Lebanon , Having regard to Council Regulation No 136/66/ EEC of 22 September 1966 on the establishment of a in accordance with the provisions of this Regulation common organization of the market in oils and and of Regulation ( EEC) No 2960 /77 : fats ('), as last amended by Regulation ( EEC) No 2560 /77 (2), and in particular Article 1 1 (5) thereof, — 1 000 tonnes of extra virgin olive oil ,
— 5 000 tonnes of olive residue oil , Whereas, pursuant to Article 11 ( 1 ) of Regulation No 136/66/ EEC, the Italian intervention agency bought out of the intervention purchases made during the in large quantities of olive oil during the 1975/76 1975/76 olive oil marketing year. marketing year ; 2. The quantities awarded shall be exported in Whereas Commission Regulation (EEC) No 2960/77 bulk : of 23 December 1977 on detailed rules for the sale of olive oil held by intervention agencies (3) laid down — for extra virgin olive oil , after mixing with refined the conditions for the sale by tender of olive oil on olive residue oil , the Community market and for export ; whereas at — for olive residue oil , after refining and mixing with the present time there exist opportunities for virgin oil . exporting refined olive residue and olive oil to certain African and Asian countries ; whereas, therefore , with a view to exporting to these countries, the oils neces sary for the manufacture of the abovementioned Article 2 product should be put up for sale by tender ; The invitations to tender shall be made public on 28 Whereas, in view of the special features of the markets April 1978 . Particulars of the lots of oil offered for sale of the abovementioned countries, it should be laid and the place where they are stored shall be displayed down that the product concerned must be exported in at the central office of AIMA, Via Palestro 81 , Rome , bulk ; Italy .
Whereas, in order to ensure the proper functioning of the system described above, it should be laid down Article 3 that the security will be released only on presentation of proof that the product has reached its destination ; The minimum selling price shall be as set out in the Annex hereto . Whereas the measures provided for in this Regulation are in accordance with the opinion of the Manage ment Committee for Oils and Fats, Article 4
Tenders shall reach AIMA, Via Palestro 81 , Rome, HAS ADOPTED THIS REGULATION : Italy, not later than 2 p.m . ( Italian time) on 16 May 1978 .
Article I Article 5 1 . The Italian intervention agency, Azienda di Stato per gli interventi nel mercato agricolo, hereinafter The olive oil shall be sold by AIMA on 19 May 1978 .

Article 6 Article 18 (2) of Regulation ( EEC) No 2960/77 shall apply. The security for tender provided for in Article 8 of Regulation ( EEC) No 2960 / 77 shall be eight units of r account per 100 kilograms of olive oil . Article 7
The security provided for in Article 12 (3) of Regula The storage allowance shall be Lit 1 000 per 100 kilo tion ( EEC) No 2960/77 shall be 60 units of account grams . per 100 kilograms of olive oil .
Without prejudice to the first indent of Article 18 ( 1 ) of Regulation ( EEC) No 2960/77, the release of the Article 8 security shall be subject to proof that the product has been imported into one of the countries referred to in This Regulation shall enter into force on the day Article 1 of this Regulation , unless destroyed en route following its publication in the Official Journal of as a result of force majeure. the European Communities.
This Regulation shall be binding in its entirety and directly applicable in all Member States .

ANNEX
Minimum selling price of olive oil held by the Italian intervention agency
1 . 1 extra virgin olive oil : Lit 103 000 per 100 kilograms . 2. Basic 1.5 olive residue oil : Lit 45 000 per 100 kilograms . In the case of olive residue oil with a different degree of acidity there shall be added or deducted, as the case may be, Lit 1 100 per 100 kilograms for each degree of acidity or fraction thereof below or above 1 5° .
