COMMISSION REGULATION ( EEC) No 1058 / 78 of 19 May 1978 correcting Regulation (EEC) No 938 /77 fixing the monetary compensatory amounts
THE COMMISSION OF THE EUROPEAN instead of from the date of application of the 1978 /79 COMMUNITIES, milk year prices for milk and milk- products ;
Whereas the monetary compensatory amounts intro Having regard to the Treaty establishing the European duced by Regulation (EEC) No 974/71 were fixed by Economic Community, Commission Regulation ( EEC) No 938 / 77 (8), as last amended by Regulation ( EEC) No 1030 / 78 (9) ; Having regard to Council Regulation (EEC) No 974/71 of 12 May 1971 on certain measures of Whereas the decisions of the Council taken on 12 conjunctural policy to be taken in agriculture May 1978 have not been fully taken into account in following the temporary widening of the margins of the Annex IV published in the latest Regulations fluctuation for the currencies of certain Member amending Regulation (EEC) No 938 /77 ; whereas this States ( ! ), as last amended by Regulation ( EEC) No Annex must therefore be corrected ; whereas due 557/76 (2), and in particular Article 6 thereof, account must also be taken of the new date of applica tion of the representative rate for pigmeat in the United Kingdom ; Having regard to Commission Regulation ( EEC) No 651 /78 of 31 March 1978 on the obligatory alterations Whereas the measures provided for in this Regulation to be made to monetary compensatory amounts fixed are in accordance with the opinion of all the relevant in advance (3), and in particular Article 1 (2) thereof, management committees ,
Whereas Article 7 ( 1 ) of Commission Regulation (EEC) No 243 /78 of 1 February 1978 providing for the advance fixing of monetary compensatory HAS ADOPTED THIS REGULATION : amounts (4 ) provides that the monetary compensatory amounts fixed in advance must be adjusted if a new representative rate comes into effect during the period of validity of the certificate ; whereas this new rate Article 1 must have been decided before the application for a certificate was lodged ; whereas this situation has arisen in certain sectors for the United Kingdom and Annex IV to Regulation ( EEC) No 938 /77 is replaced : from 12 May 1978 , the date on which the new repre sentative rates were decided in Council Regulation — with effect from 1 May 1978 , by Annex I to this ( EEC) No 976/78 (5), for Germany, France , Italy and Regulation , Ireland ; — with effect from 12 May 1978 , by Annex II to this Regulation , Whereas the Council also decided on 12 May 1978 — with effect from 15 May 1978 , by Annex III to that the representative rate for the pound sterling this Regulation , decided on 31 January 1978 in Regulation ( EEC) No — with effect from 17 May 1978 , by Annex IV to this 179/78 (6) and indicated in Article 2 ( 1 ) (h) of Council Regulation . Regulation (EEC) No 878 /77 of 26 April 1977 on the exchange rates to be applied in agriculture (7), as last amended by Regulation ( EEC) No 976/78 , should in derogation from Article 2 (6) (f) of Regulation ( EEC) Article 2 No 878 /77 apply to pigmeat from 17 May 1978

This Regulation shall be binding in its entirety and directly applicable in all Member States .
