COMMISSION REGULATION (EEC) No 1813 /78 of 31 July 1978 altering the monetary compensatory amounts

THE COMMISSION OF THE EUROPEAN within the scope of Regulation ( EEC) No 1059/69 (#); COMMUNITIES, whereas it is also necessary on this occasion to take into account the fact that from 1 August 1978 new representative rates fixed by Council Regulation Having regard to the Treaty establishing the (EEC) No 878/77 of 26 April 1977 (7), as last European Economic Community, amended by Regulation (EEC) No 976/78 (8), will apply to cereals and poultry products; Having regard to Council Regulation (EEC) No 974/71 of 12 May 1971 on certain measures of conjunctural policy to be taken in agriculture Whereas the amounts in question should be following the temporary widening of the margins of calculated using the monetary differences adopted fluctuation for the currencies of certain Member for the other sectors where the new rates are already States (*), as last amended by Regulation ( EEC) applicable; No 557/76 (2), and in particular Article 6 thereof,

Whereas the measures described above would mean Having regard to Commission Regulation (EEC) that in Ireland no monetary compensatory amounts No 1516/78 of 30 June 1978 on adjustments to would be fixed for the products and goods in the monetary compensatory amounts fixed in advance cereals and poultry sectors or for those covered by and repealing Regulation (EEC) No 651 /78 (3), and Regulation (EEC) No 1059/69 ; whereas in these in particular Article 1 (2) thereof, circumstances the compensatory amounts applicable in Ireland to the goods and products indicated above should be abolished, as has already been done, with Whereas the monetary compensatory amounts effect from 24 July 1978 , for the other sectors not introduced by Regulation (EEC) No 974/71 have referred to above ; been fixed by Commission Regulation (EEC) No 1036/78 of 19 May 1978 (4), as last amended by Regulation (EEC) No 1784/78 (5); Whereas Article 7 ( 1 ) of Commission Regulation (EEC) No 243/78 providing for the advance fixing of monetary compensatory amounts (9 ) as amended Whereas the 1978/79 cereals marketing year begins by Regulation (EEC) No 1544/78 ( 10) specifies that on 1 August 1978 ; whereas from that date the new monetary compensatory amounts fixed in advance cereal prices have to be used for calculating the shall be adjusted if a new representative rate takes monetary compensatory amounts applicable to effect that was decided on before the application for cereals and to certain products and goods which fall advance fixing was lodged; whereas this situation within the milk and milk products sector or the may yet arise in the pigmeat sector in the Federal egg, poultry or albumin sectors or which come

HAS ADOPTED THIS REGULATION : Article 2 Article 1 Regulation ( EEC) No 1036/78 is hereby amended as This Regulation shall enter into force on 1 August follows : 1978 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .

( a) In trade with non-member countries , the coefficient 1.81 shall be applied to the supplementary amounts indicated above. The coefficient shall , however, be 1.64 in the case of products containing skimmed-milk powder sold pur­ suant to amended Regulation (EEC) No 2054/76 ( OJ No L 228 , 20 . 8 . 1976 , p. 17). ( b) In intra-Community trade and in trade with third countries , where these products contain : — skimmed-milk powder sold and denatured in accordance with the provisions of Regulation (EEC) No 368/77 ( OJ No L 52, 24. 2. 1977) and Regulation (EEC) No 443/77 ( OJ No L 58 , 3 . 3 . 1977) or for which the aid has been granted and skimmed-milk powder which has been denatured in accordance with the provisions of Regulation (EEC) No 1844/77 ( OJ No L 205 , 11 . 8. 1977), and — either fish meal or fish oil and/or fish liver oil or iron carbonate and /or iron sulphate and/or copper sulphate , the supplementary amounts indicated above shall be multiplied by the coefficient 0-27. ( c) When completing customs formalities , the applicant shall state on the declaration provided for this purpose the content, expressed in actual weight per tonne of finished product, of : — powdered or granulated milk (excluding whey), — powdered or granulated whey , — added casein or caseinate .

5) For products falling within subheading 23.07 B I c) 1 or 2 of the Common Customs Tariff, containing more than 50 % by weight of products falling within heading No 07.06 or subheading 11.04 C thereof the monetary compensatory amounts shall be those applicable to products falling within subheading 07.06 A thereof ( Regulation (EEC) No 1497/76, OJ No L 167, 26 . 6 . 1976, p. 27).

In trade with third countries, the coefficient 1.81 shall be applied to the supplementary amounts indicated above. The coefficient shall, however, be 1.64 in the case of products containing skimmed-milk powder sold pursuant to Regulation (EEC) No 2054/76 ( OJ No L 228 , 20. 8 . 1976).

In intra-Community trade, where the product has not been produced in accordance with Regulation (EEC) No 990/72 ( OJ No L 115, 17. 3 . 1972), the coefficient 1.81 shall be applied to the supplementary amounts indicated above. However, this coefficient shall not be applied to products consigned to Italy from another Member State in accordance with Regulation (EEC ) No 1624/76 ( OJ No L 180, 6. 7. 1976).

In intra-Community trade and in trade with third countries, where these products contain :

— skimmed-milk powder sold and denatured in accordance with the provisions of Regulation (EEC) No 368/77 ( OJ No L 52, 24. 2. 1977) and Regulation (EEC) No 443/77 ( OJ No L 58 , 3 . 3 . 1977) or for which the aid has been granted and skimmed-milk powder which has been denatured in accordance with the provisions of Regulation (EEC) No 1844/77 ( OJ No L 205, 11 . 8 . 1977),

and

— either fish meal or fish oil and/or fish liver oil or iron carbonate and/or iron sulphate and/or copper sulphate,

the supplementary amounts indicated above shall be multiplied by the coefficient 0.27.
