altering certain monetary compensatory amounts in the pigmeat sector

THE COMMISSION OF THE EUROPEAN Whereas provision should be made for a transitional COMMUNITIES , period to enable the trade to adapt itself to the new situation caused by the adjustment - of monetary Having regard to the Treaty establishing the compensatory amounts, bearing in mind, however, European Economic Community , the importance of this measure for the proper organization of the market; Having regard to Council Regulation (EEC ) No 974/71 of 12 May 1971 on certain measures Whereas the Management Committee for Pigmeat of conjunctural policy to be taken in agriculture has not delivered an opinion within the time limit following the temporary widening of the margins of set by its chairman , fluctuation for the currencies of certain Member States ('), as last amended by Regulation (EEC ) No 652/79 (2 ), and in particular Article 6 thereof, HAS ADOPTED THIS REGULATION :

This Regulation shall be binding in its entirety and directly applicable in all Member States .

(») L'octroi des montants compensatoires monétaires applicables pour ces produits est subordonné au respect des conditions pour l'octroi des restitutions visées au règlement (CEE) n° 171/78 . Au moment de l'accomplissement des formalités douanières d'exportation ou d'importation dans l'État membre qui paie le montant compensa­ toire monétaire, l'exportateur ou l'importateur concerné déclare par écrit que les produits en cause répondent à ces conditions. (') The grant of monetary compensatory amounts in respect of these products is subject to compliance with the conditions for the grant of refunds laid down in Regulation (EEC) No 171/78 . The exporter or importer at the time of the conclusion of customs formalities concerning the export or the import in a Member State paying the monetary compensatory amount, shall declare in writing that the products in question fulfil these conditions . (■) Voraussetzung für die Gewährung der Währungsausgleichsbeträge für diese Erzeugnisse ist die Erfüllung der in der Verordnung (EWG) Nr. 171/78 aufgeführten Bedingungen für die Gewährung der Erstattungen . Der Ein- oder Ausführer erklärt schriftlich zum Zeitpunkt der Erfüllung der Ausfuhr- oder Einfuhrzollförmlich­ keitcn in dem Mitgliedstaat, der den Währungsausglcichsbetrag zahlt, daß die fraglichen Erzeugnisse diesen Bedingungen entsprechen. (') La concessione degli importi compensativi monetari aDplicabili per questi prodotti è subordinata all'osservanza delle condizioni per la concessione delle restituzioni di cui al regolamento (CEE) n . 171/78. Al momento dell ' ottemperamento delle formalità doganali d'esportazione o d'importazione negli Stati membri che pagano l'importo compensativo monetario , l'esportatore o l'importatore interessato dichiara per iscritto che i prodotti in causa rispondono a queste condizioni. (■) Voor de toekenning van de voor deze produkten geldende monetaire compenserende bedragen moet voldaan zijn aan de in Verordening (EEG) nr. 171/78 genoemde voorwaarden voor de toekenning van de restituties . De betreffende _ im- of exporteur legt, tijdens het vervullen van de douaneformaliteiten bij uitvoer of invoer in de Lid-Staat die het monetaire compenserende bedrag uitbetaalt, een schriftelijke verklaring over dat de betreffende produkten aan deze voorwaarden voldoen . (') De monetære udligningsbeløb, der anvendes for disse produkter, ydes kun , såfremt de i forordning (EØF) nr. 171/78 omhandlede betingelser for ydelse af restitution overholdes . Ved afslutningen af toldformaliteterne i forbindelse med udførsel eller indførsel i den medlemsstat, der betaler det monetære udligningsbeløb , skal ekspor­ tøren/importøren afgive en skriftlig erklæring om , at de pågældende produkter opfylder disse betingelser. (4) Les montants compensatoires monétaires ne sont pas applicables aux produits présentés sous forme de farine ou de poudre, agglomérée ou non. (4) The monetary compensatory amounts shall not apply to products presented in the form of meal or powder , whether or not in compounded form. (4) Die Währungsausgleichsbeträge werden nicht für Erzeugnisse in Form von Mehl oder Pulver, audi in gepreßter Form» angewendet.
