fixing the monetary compensatory amounts and rates for their application

THE COMMISSION OF THE EUROPEAN ( EEC) No 651 / 78 (6), and in particular Article 1 (2 ) COMMUNITIES , thereof,

Whereas , applying the rules laid down in Articles 1 Having regard to the Treaty establishing the and 2 ( 1 ) (a) and ( la) of Regulation ( EEC ) No European Economic Community, 974 / 71 , no monetary compensatory amounts should be fixed for Denmark or Ireland , while the monetary compensatory amounts should be calculated by Having regard to Council Regulation (EEC) No applying 2-8 % for the Benelux countries , 9-8 % for 974 /71 of 12 May 1971 on certain measures of the Federal Republic of Germany and 3 • 7 % for conjunctural policy to be taken in agriculture France , for the beef and veal , sugar and isoglucose following the temporary widening of the margins of sectors ; whereas , in France , the difference of 3-7 % fluctuation for the currencies of certain Member also applies in the milk and milk products sector, and States O , as last amended by Regulation (EEC) No monetary compensatory amounts will no longer apply 987 / 79 (2), and in particular Articles 3 and 6 thereof, in the pigmeat sector ; whereas , however, since the new exchange rates are applied at different times-, the differences of 3 • 3 % for the Benelux countries and Having regard to Council Regulation (EEC) No 10-8 % for the Federal Republic of Germany should be maintained particularly for the milk and milk 878 / 77 of 26 April 1977 on the exchange rates to be products sector ; whereas , for the cereals sector in applied in agriculture (3), as last amended by Regu­ lation (EEC) No 1266 / 79 (4), France , the said staggered application of the new exchange rates and the declarations of the European Council on 5 and 6 December 1978 require the difference of 10-6% to be maintained as a Having regard to Council Regulation (EEC) No transitional measure taken within the context of the 652 / 79 of 29 March 1979 on the impact of the introduction of the F2CU into the common agri­ European monetary system on the common agri­ cultural policy ; cultural policy (5), and in particular Article 4 thereof,

— the spot market rate recorded over a given period Whereas , for the purposes of application of Article 2a for the currency of the relevant Member State of Regulation (EEC) No 974 / 71 , an exchange rate against each of the currencies of the Member for conversion of the Italian lira and the pound States which keep their exchange rates at any sterling into the currencies of the other Member given moment within a maximum spread of States should be fixed ; 2-25 % ;

Whereas the second subparagraph of Article 4 ( 1 ) of Whereas application of the provisions of Article 2 ( 4) Regulation (EEC) No 1380 / 75 lays down that of Regulation ( EEC ) No 974 / 71 results in monetary monetary compensatory amounts applicable in the compensatory amounts not being applied in the wine sugar sector should be calculated on the basis of the sector in France and in application of a reduced intervention price plus the amount of the levy monetary compensatory amount in Italy ; collected on sugar of Community origin under the arrangements for the reduction of storage costs ; Whereas , in trade with non-member countries , import charges , export refunds and export levies , fixed in ECU, are to be multiplied by a coefficient derived Whereas the monetary compensatory amounts from the percentage used in calculating the monetary provided for in Regulation ( EEC) No 974 / 71 were compensator}' amounts actually applied ; fixed by Regulation ( EEC) No 7 1 0 / 79 (s), as last amended by Regulation (EEC) No 1206 / 79 (9); Whereas Article 9 of Commission Regulation (EEC) whereas the said Regulation should be replaced by a No 1380 / 75 of 29 May 1975 laying down detailed new Regulation ; rules for the application of monetary compensatory

amounts ( 3 ), as last amended by Regulation (EEC ) No 1 1 50 / 79 (4), provides that no compensatory Whereas the measures provided for in this Regulation amounts are to apply in trade within the BLEU or to are in accordance with the opinions of all the relevant trade between the BLEU and the Netherlands , these management committees , States being treated as a single Member State ;

HAS ADOPTED THIS REGULATION : Article 4

The coefficients for carrying out the adjustments to be made pursuant to Article 7 ( 1 ) of Regulation (EEC ) No 243 / 78 to monetary compensatory Article 1 amounts fixed in advance are shown in Annex IV

hereto .

The monetary compensatory amounts provided for in Article 1 of Regulation ( EEC) No 974 /71 shall for Article 5 each Member State be as shown in Annex I hereto .

Regulation ( EEC) No 710 / 79 is repealed with the exception of the provisions on adjustment of monetary compensatory amounts fixed in advance before 2 July 1979 , which shall be repealed at the Article 2 latest six months after the entry into force of this Regulation .

The coefficients provided for in Article 4 (3) of Regu­ lation (EEC) No 1380 / 75 shall be as shown in Annex Article 6 II hereto .

This Regulation shall enter into force on 2 July 1979 .

However :

Article 3 — in Part 7 of Annex 1, and the amounts given under A in Part 8 ,

— in Annex II , the coefficients given for the sugar The exchange rates for the Italian lira, the pound and isoglucose sectors , sterling and the Irish pound to be used for the purposes of Article 2a of Regulation (EEC) No 974 / 71 shall be as shown in Annex III hereto . shall apply with effect from 1 July 1979 .

This Regulation shall be binding in its entirety and directly applicable in all Member

States .

4) If the product contains powdered or granulated milk (excluding whey ), the amount shown shall be increased by the following supplementary amount :

( a ) In trade with non-member countries, the coefficient 1.81 shall be applied to the supplementary amounts indicated above .

( b) In intra-Community trade and in trade with third countries , where these products contain :

— skimmed-milk powder sold and denatured in accordance with the provisions of Regulation ( EEC) No 368 /77 ( OJ No L 52 , 24 . 2 . 1977) and Regulation ( EEC) No 443 /77 ( OJ No L 58 , 3 . 3 . 1977) or for which the aid has been granted and skimmed-milk powder which has been denatured in accordance with the provisions of Regulation ( EEC) No 1844/77 ( OJ No L 205 , 11 . 8 . 1977), and

— either fish meal or fish oil and /or fish liver oil or iron carbonate and/or iron sulphate and /or copper sulphate ,

the supplementary amounts indicated above shall be multiplied by the coefficient 0-27 .

( c) When completing customs formalities , the applicant shall state on the declaration provided for this purpose the content, expressed in actual weight per tonne of finished product , of :

— powdered or granulated milk (excluding whey ),

— powdered or granulated whey ,

—■ added casein or caseinate .

(s ) In the case of products containing products falling within heading No 07.06 or subheading 11.04 C of the Common Customs Tariff, no monetary compensatory amount shall be granted on the cereal constituent. However , the amounts indicated shall apply if compensatory amounts are due to be levied .

When completing customs formalities

—- for goods being exported to a Member State the currency of which has appreciated ,

for goods being imported into a Member State the currency of which has depreciated ,

— for goods being exported to a Member State making use of the option provided in Article 2a of Regulation (EEC ) No 974 /71 ,

the applicant must state in the declaration provided for this purpose the complete composition of the product and the exact content by weight of non-milk constituents broken down by tariff heading.

3) L'octroi des montants compensatoires monétaires applicables pour ces produits est subordonné au respect des conditions pour l'octroi des restitutions visées au règlement (CEE) n° 171 /78. Au moment de l'accomplissement des formalités douanières d'exportation ou d'importation dans l'État membre qui paie le montant compensa­ toire monétaire, l'exportateur ou l'importateur concerné déclare par écrit que les produits en cause répondent à ces conditions . (3) The grant of monetary compensatory amounts in respect of these products is subject to compliance with the conditions for the grant of refunds laid down in Regulation ( EEC) No 171 /78 . The exporter or importer at the time of the conclusion of customs formalities concerning the export or the import in a Member State paying the monetary compensatory amount, shall declare in writing that the products in question fulfil these conditions . (3) Voraussetzung für die Gewährung der Währungsausgleichsbeträge fur diese Erzeugnisse ist die Erfüllung der in der Verordnung (EWG) Nr. 171 /78 aufgeführten Bedingungen für die Gewährung der Erstattungen . Der Ein - oder Ausführer erklärt schriftlich zum Zeitpunkt der Erfüllung der Ausfuhr- oder Einfuhrzollförmlich­ keiten in dem Mitgliedstaat, der den Währungsausgleichsbetrag zahlt, daß die fraglichen Erzeugnisse diesen Bedingungen entsprechen . Al momento dell'ottempera­ mento delle formalità doganali d'esportazione o d'importazione negli Stati membri che pagano l'importo compen­ sativo monetario , l'esportatore o l'importatore interessato dichiara per iscritto che i prodotti in causa rispondono a queste condizioni . (3) Voor de toekenning van de voor deze produkten geldende monetaire compenserende bedragen moet voldaan zijn aan de in Verordening (EEG) nr. 171 /78 genoemde voorwaarden voor de toekenning van de restituties . De betreffende im- of exporteur legt, tijdens het vervullen van de douaneformaliteiten bij uitvoer of invoer in de Lid-Staat die het monetaire compenserende bedrag uitbetaalt, een schriftelijke verklaring over dat de betreffende produkten aan deze voorwaarden voldoen . (3) De monetære udligningsbeløb, der anvendes for disse produkter, ydes kun , såfremt de i forordning (EØF ) nr. 171 /78 omhandlede betingelser for ydelse af restitution overholdes . Ved afslutningen af toldformaliteterne i forbindelse med udførsel eller indførsel i den medlemsstat, der betaler det monetære udligningsbeløb , skal ekspor­ tøren/importøren afgive en skriftlig erklæring om , at de pågældende produkter opfylder disse betingelser.

(3 ) The basic amount for 100 kg of product falling within this subheading shall be equal to the sum of the following components : ( a ) the amount per 100 kg indicated multiplied by 1/100 of the weight of the lactic part contained in 100 kg of product. However, where whey and/or lactose have been added to the product, the amount resulting from the preceding calculation shall be : — multiplied by the weight of the lactic non-fat part, other than the added whey and/or lactose, contained in 100 kg of the product, and then — divided by the weight of the non-fat lactic part contained in 100 kg of the product ;

(b ) an additional amount for each percentage point of sucrose content of 100 kg net of the product, equal to 1/100 of the amount indicated in Part 7 of this Annex under subheading 17.01 A ( undenatured ) of the Common Customs Tariff.

When completing customs formalities, the applicant shall state on the declaration provided for this purpose : — the actual content by weight of added whey and/or added lactose per 100 kg of finished product, and, in particular : — the lactose content of the added whey .

4) However, for butter covered by the measures provided for :

— in Regulation ( EEC) No 1282/72 ( OJ No L 142 , 22 . 6 . 1972), the amount indicated shall be multiplied by the coefficient 0.40 ;

— in Regulation ( EEC) No 1717/72 ( OJ No L 181 , 9 . 8 . 1972), the amount indicated shall be multiplied by the coefficient 0.40 ;

— in Regulation ( EEC) No 649/78 ( OJ No L 86, 1 . 4 . 1978 ), the amount shall be multiplied by the coefficient 0-40 ; — in Regulation ( EEC) No 232/75 ( OJ No L 24 , 31 . 1 . 1975 ), the amount indicated shall be multiplied : — by the coefficient 0.33 where the butter is to be used in formula A products , — by the coefficient 0.53 where the butter is to be used in formula B products -,

,5 ) For imports into the United Kingdom from New Zealand pursuant to Protocol 18 , the monetary compensatory amount shall be £ 4.970 per 100 kg and the coefficient shall not be applied to the special levy .

6) With respect to cheese rinds and wastes the monetary compensatory amount applicable shall be that applicable to products of subheading 04.04 E I c) of a fat content , by weight, in the dry matter of 10 % or more . Products unfit as such for human consumption shall be regarded as cheese wastes.

7) When completing customs formalities , the applicant shall state in the declaration provided for this purpose the content , expressed in actual weight per 100 kg of finished product, of : — powdered or granulated milk (excluding whey), — powdered or granulated whey, — added casein and/or caseinate .

In trade with non-member countries, the coefficient 1.81 shall be applied to the supplementary amounts indicated above .

In intra-Community trade, where the product has not been produced in accordance with Regulation ( EEC) No 990/72 ( OJ No L 115, 17. 3 . 1972), the coefficient 1.81 shall be applied to the supplementary amounts indicated above. However, this coefficient shall not be applied to products consigned to Italy from another Member State in accordance with Regulation (EEC) No 1624/76 ( OJ No L 180, 6. 7 . 1976).

In intra-Community trade and in trade with third countries, where these products contain :

— skimmed-milk powder sold and denatured in accordance with the provisions of Regulation (EEC) No 368/77 ( OJ No L 52, 24. 2. 1977 ) and Regulation ( EEC ) No 443 /77 ( OJ No L 58 , 3 . 3 . 1977 ) or for which the aid has been granted and skimmed-milk powder which has been denatured in accordance with the provisions of Regulation (EEC) No 1844/77 ( OJ No L 205, 11 . 8 . 1977),

and

— either fish meal or fish oil and/or fish liver oil or iron carbonate and/or iron sulphate and/or copper sulphate,

the supplementary amounts indicated above shall be multiplied by the coefficient 0-27.

8) The basic amount for 100 kg of product falling within this subheading shall be equal to the sum of the following components :

( a) the amount per 100 kg indicated . However, where whey and /or lactose have been added to the product, the amount indicated shall be :

— multiplied by the weight of the lactic non-fat part other than the added whey and/or added lactose product, and then — divided by the weight of the non-fat lactic part contained in 100 kg of the product ;

( b ) an additional amount for each percentage point of sucrose content of 100 kg net of the product, equal to 1/100 of the amount indicated in Part 7 of this Annex under subheading 17.01 A ( undenatured) of the Common Customs Tariff.

10) In the case of products to which whey and/or lactose have been added, no compensatory amount shall be granted. However, the amounts indicated shall apply if compensatory amounts have to be charged .

When completing customs formalities :

— in respect of exports from a Member State with an appreciated currency,

— in respect of imports into a Member State with a depreciated currency,

— in respect of exports from a Member State making use of the option provided for in Article 2a of Regulation ( EEC ) No 974/71 ,

the applicant shall state on the declaration provided for this purpose whether or not whey and/or lactose have been added to the product.

( u ) For cream covered by the measures provided for in Regulation ( EEC ) No 649/78 ( OJ No L 86, 1 . 4 . 1978), the monetary compensatory amount shall be multiplied by the coefficient 0.40.

( 12 ) For cheeses manufactured exclusively from sheep or goat milk :

— the analysis check shall be carried out by immunological methods such as double immuno-diffusion and radial immuno-diffusion , supplemented as necessary by electrophoresis of the caseins ,

— the party concerned shall be obliged , when completing the customs formalities , to state in the declaration provided for this purpose that the cheese in question was manufactured exclusively from sheep and/or goat milk.
